HomeMy WebLinkAbout18 - Meeting Summary Notes held with Staff & Antero 07.16.2009• Meeting Summary Meeting: Meeting between Antero representatives and County Planning, Legal, and LGD Staff Where: County Administrative Building in Glenwood Springs (Building &`P'lanni g Department) When: Thursday, July 16, 2009 (9:00 to 11:00 AM) RE: Public engagement strategies & Critical Paths for County Major Impact Review for Special Use Permit and the GOGCC's Comprehensive Drilling Plan (CDP) for drilling in Battlement Mesa PUD The topics of the meeting included how Antero and the County would best engage citizen participation / comments for residents of Battlement Mesa and also work together to begin to outline the two regulatory processes for the County and the State. A few main points included: 1) The County would allow Antero to submit one application that included all the elements of the drilling project (drilling locations, water impoundment, and pipe and road network system) into one application. [It was understood that each pad (and supporting infrastructure would be assessed individually within the application.] In this way, the County would look at the entire project as well as the specific impacts from specific elements of the plan in their review. 2) The County's referral process (initial referral to the BOCC) for a Major Impact Review (MIR) was amended so it's an automatic referral to the Planning Commission and the application will not go to the BOCC first. 3) County Legal Staff will look for the application to include a position on how the original Surface Use Agreement can be replaced with a newer version and if there were any reliance's on the old one for other property owners within Battlement Mesa PUD. 4) County Staff anticipates holding a public meeting in Battlement Mesa to hear from its citizens on their concerns about drilling in the community. This meeting is anticipated to be in early August, 2009. 5) Antero and Staff worked through the following process outline as a "critical path" for this project review with both Garfield County and COGCC: Garfield County "Major Impact Review" (MIR) process for a Special Use Permit for "Extraction of Natural Resources" Colorado Oil and Gas Conservation Commission process for a Comprehensive Drilling Plan (CDP) "Initiation Meeting" with COGCC (Held: June 15, 2009) Application is deemed "Technically Complete" (September 15, 2009) Staff refers Application to State Agencies, local districts and County Departments for review comments (Comments back by October 15, 2009) County Planning Commission Public Hearings (Held: November 15- December 15, 2009) "CDP Consultation Process" with: A. DOW; B. CDPHE; C. Battlement Mesa Community; D. Garfield County LGD (This process is to determine project impact mitigation and BMPs to be incorporated into the CDP) (Finish in October 2009) Garfield County Board of County Commissioner Public Hearings (Held: January 15 — February 15, 2009) Antero Completes "Draft Outline" of CDP based on comments from Consultation Process and County referral comments from the MIR review process. Coyle Date: June 2, 2009 Re: Battlement Mesa Zoning Regulations Enclosed are; 1) The Battlement Mesa Zoning Regulations; 2) letter from Exxon Company to Battlement Mesa Partners dated December 12, 1989, 3) Surface Use Agreement between Battlement Mesa Partners, et al. and Barrett Resources Corporation dated August 6, 1990. 1 • f Observations: 1) It appears that because other state agencies (DOW and CDPHE) do not have a formal CDP process, Antero will need to begin the consultation process with them as early as possible; 2) The timelines in this outline are general in nature and do not include unforeseen changes such as how long it takes to get a SUP application to be Technically Complete or any continuances that may occur; 3) County will work to hold as many public hearings in the Battlement Mesa Community; 4) The County's MIR / SUP process structure is beneficial to the CDP process where the County's referral process will inform the state agencies of the project and all of the referral comments that come back can be incorporated into the "consultation process" and the draft of the CDP; • • attle 5.7,05 • opitillgo#0.00, 5 rr �� 5: tt • MorousARN IE6A • • Edward A.
