Commissioner Assistant, County Attorney Clerk of the Board , County Administrator were when the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 87- 86 A RESOLUTION CONCERNED WITH THE APPROVAL OF A ZONE DISTRICT AMENDMENT REQUEST BY THE H. P WILLIAMS TRUST WHEREAS, the Board of County Commissioners of Garfield County have heretofore adopted and enacted a Zoning Resolution for Garfield County, Colorado, including as a part thereof, certain zoning maps regulating permitted uses upon the lands within Garfield County, Colorado; and WHEREAS, C.R.S. (1973) 30-28-109 through 3.0-28-116 provide for the approval of all zoning plans and the adoption and amendment of regulations and resolutions to implement such zoning plans by the Board of County Commissioners of a given county; and WHEREAS, the H. P. Williams Trust has applied to the Board of County Commissioners for a zone district amendment on a parcel of land located on the following described parcel: See Exhibit "A" for such property to change from Agricultural/Residential/Rural Density Zoning to Commercial/Limited zoning; and WHEREAS, the Garfield County Planning Commission having considered such application in conformity with the provisions of the Zoning Resolution of Garfield County, Colorado, recommended to the Board of County Commissioners of Garfield County that the said request for a zone district amendment be approved, for the reasons set forth in the record of its actions; and WHEREAS, this Board has given notice of public hearing upon such application by publication in a newspaper of general circulation in Garfield County, appearing in the Glenwood Post on July 17,'1987 and such hearing having been held on August 17, 1987 and this Board having given full consideration to the evidence -submitted thereat; and WHEREAS, this Board, based upon the record in connection with said application, maks the following .findingsin respect thereto, towit: 1. Thatallapplicable regulations regarding a Zone.`Distri'ct Amendment have been complied with including, but not limited to, Section 10.00 of the Garfield County -Zoning Resolution of,1978, as amended. f421 Page Two B,�QK 720 P. -G -t101. 2. That proper publication and public notice was provided as :required by law for the hearing bt,fore the Board of County Commissioners. 3. That the public hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at the meeting. 4. That the proposed zoning is in general compliance with the recommendations set forth in the Comprehensive Plan for the unincorporated areas of the County. 5. That the proposed zoning is in general compliance with surrounding land user atiU zoning in Garfield County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado, that the request of the H. P. Williams Trust for a zone district amendment be approved rezoning the above descr!-)ed parcel from Agricultural/Residential/Rural Density to Commercial Limited. Paces 4 and 5 as recorded in the Office of the Garfield County Clerk and Recorder, State of Colorado, whence the north- east corner of said Section 35 bears N' 06°04'10" W 2094.80 feet; thence S 30'17'30" E 166.46 feet to a point on the northerly right-of-way line of the Denver & Rio Grande d) Western Railroad; thence along the northerly right-of-way line of said Denver & Rio Grande Western Railroad the follow-- ing two courses: more or less_ 1) S 59-42'30- W 486.83 feet; thence 2) 513.99 feet along the arc of a 1382.70 foot radius curve to the ,right havim a central angle of 21'1755" and subtending a chord bearing S 70'21'28" W 511.04 feet to a point on the said southerly right-of- way iine of Interstate 70 as recorded in said Book 437 at Pages 4 and 5 in the Office of the Garfield County Clerk and Recorder; thence along the said southerly right-of-way line of Interstate 70 the fol- lowing four courses: a) N 28'29'30" E 41.90 feet; thence b) �, 39'55'30" E 244.10 feet; thence c) 1\ 39°42'30" E 540.90 Leet; thence d) N 69'45'30" E 185.50 feet, to the point of begin -ming containing 3.793 acres, more or less_
