RESOLUTION NO.. 81-141
A RESOLUTION CONCERNED WITH. 'I'lHE APPROVAL OF A SPECIAL USE PE•RMI.T
APPI:,ICA'I.'ION BY MOBILE PREMIX COMPANY:
WHEREAS, the Board of County Commissioners of Garfield County
has received an application tr.on Mobile Mix, inc. , for a special
use permit for industrial Operations limited to extraction of sand
and. gravel -and operation of a concrete batch plant on the following
described tract of land: •
Part of the NE 1/4SE11, NW:SEr; , SE tiSI .L , HE4SW 1/4 , N1^t SWt
SW1/4SW A, SI 4SWti and. ail .1. of the SWISEta , Section 7 and
part: of the 1'IE4NFAi, NW t1E; and NI NNW , Section 18,
T. 6 S., R. 92 W., Gth P.M., Garfield County, Colorado,
described in an instrument recorded in the Office •
of the Garfield County C 1.c.r'k ' and .Recorder at Book 364, .
Page 158; and
WHEREAS, pursuant to required public notice, the Board conducted
a public: hearing on the 4th day of May, •1981, upon the question -of
whether the above described special use permit should be granted or
denied, at which hearing•.Lhe pubi.ic and interested persons were
given the opportunity te express their. opinions r-ec-arding the issuance
of said special use permit; and
WHEREAS, the Board, on the basis of the evidence produced •art. •
the aforementioned hearng, has made the following determinations
of fact:
1. The proposed use is compatible with the uses existing .and
permitted in -the. district in Which it• is to be • located,. provided
that certain hereinar.fter contained conditions be compliedwith.
2. That a substantial amount of traffic, specifically, 130
•
'round trips of heavy trucks :per day, will be generated by the proposed
indust.r.ial operation, virtually allof which traffic will require
access. to Interstate Highway 70, the only present available .access
to which is located south of Rifle, four miles distant from the
proposed site and accessible only by gravel and chipped and sealed
County roads.
3.• That the impact on traffic volume and safety, and other
impacts of the special use, specifically, certain damage to County
roads affected by the proposed industrial operations,• will be injurious
to the established •neighborhood or zone district in which the special
use is to be located unless arrangements are made by applicants to
.either- improve the affected County roads to the extent that the Board
is satisfied that such County roads are able to withstand the antici-
pated traffic loads and volume, or that direct access is arranged
for such truck traffic from the subject larrcis to Interstate Highway.

NOW, THEREFORE, BE IT RESOLVED by the Commissioners of Garfield
County, Colorado, that a special use permit be and hereby is .authorized

of a concrete batch plant, .upon the following specific conditions:

1. That the use of the tract of land comply with all present
and future regulations of Garfield County in the zone district in
which the property is now or may later be located.
2. That, prior to the issuance of the authorized special .use
permit, but in no event -later than six months from the adoption of
this r.esol.ution, the applicant shall present evidence demonstrating
to the satisfaction of the Board that either (1) the County reads
affected by the proposed operations will be improved to the extent
and in such manner that those roads rihall be able to withstand
anticipated traffic loads; and volume, or (2). that direct access to
Interstate Highway 70 will be available to the proposed industrial
operation in order that such traffic related to• the proposed operation
will..not traverse any County road prior to entering upon interstate
Highway 70.
3. That, in the event the Applicant is unable to demonstrate
to the Board the satisfaction of either of the above conditions
within the time now or herca f te7 r provided, the Board shall have
the authority to determine such failure,- in which event this reso-
lution shall operate as a determination that the special use permit
is denied, for the reasons set forth in paragraphs 2 and 3 of the
findings of fact hereinabove stated,

RESOLUTION NO. 84- 48
RESOLUTION CONCERNED WITH THE CERTIFICATION OF COMPLIANCE OF•
CONDITIONS BY THE MOBILE PRE:I•iIX COMPANY FOR A SPECIAL USE PERMIT FOR
THE LOESCH PIT
WIJEREAS, Garfield County, Colorado, is a legal and political
subdivision of the State of Colorado for which the Board of County
Commissioners is authorized to act;
WHEREAS, the Board of County Commissioners of Garfield County,
Colorado, has previously adopted the Garfield County Zoning
Resolution of 1978, as amended;
WHEREAS, pursuant to said Resolution, the Board of County
Commissioners has previously adopted Resolution No. 81-141, which
authorized the issuance of a special use permit for extraction of
natural -resources on certain property in the unincoporated portions
of Garfield County, Colorado;
WHEREAS; by Resolution No. 83-141, the Board of County
Commissioners of Garfield County, Colorado, granted an extension of
time to Mobile Premix Company to demonstrate compliance with the
conditions set forth in Resolution No. 81-141; and
WHEREAS, the Board of County Commissioners of Garfield County,
Colorado, has determined that the conditions, set forth in
Resolution No. 81-141, have been complied with.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Garfield County, Colorado, that the special use
permit, issued to Mobile Premix Company for the above-described real
property, is good and valid from this day henceforth; and
FURTHER, that Mobile Premix Company has complied with all
conditions, set forth in Resolution No. 81-141, and need not take
any further action by means of construction or otherwise, for said
permit to be and remain valid.
Upon motion duly made and seconded, the foregoing Resolution
was adopted by the following vote:
