HomeMy WebLinkAboutResolution 2008-39■III Reception#: 746335 04/11/2008 08:51:10 RM JeanRlberico 1 of 3 Rec Fee:$0.00 Doc Fee :0.00 GARFIELD COUNTY CO STATE OF COLORADO ) )ss County of Garfield } At a regular meeting of the Board of County Commissioners for Garfield County, Colorado, held in the Commissioners' Meeting Room, Garfield County Plaza Building, in Glenwood Springs on Monday, the 6h day of April, 2007, there were present: John Martin , Commissioner Chairman Lg,= McCown , Commissioner Tresi Hoppt , Commissioner Don DeFord , County Attorney Jean Alberico , Clerk of the Board Ed Green , County Manager when the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 2008-39 A RESOLUTION CONCERNED WITH THE APPROVAL OF A ZONE DISTRICT AMENDMENT FOR A PROPERTY OWNED BY EYE -SEVENTY, LLC DESCRIBED AS PARCEL A, AMAYA/MADRID EXEMPTION FROM AGRICULTURAL RESIDENTIAL RURAL DENSITY TO LIGHT INDUSTRIAL Parcel ID: 2179-192-00- 608 WHEREAS, the Property is located on County Road 352, west of Garfield County Airport, containing approximately 8.39 acres, WHEREAS, on Wednesday, July 11'x', 2007, the Garfield County Planning Commission, in a public meeting, forwarded a recommendation of approval to the Board of County Commissioners for the proposed zone district amendment finding that the conditions of the neighborhood have changed to such a degree to support the requested zone change from Agricultural Residential Rural Density to Light Industrial; WHEREAS, the Board of County Commissioners held a public hearing on the 6th day of August, 2007 upon the question of whether the zone district amendment should be granted or denied, at which hearing the public and interested persons were given the opportunity to express their opinions regarding the issuance of said amendment; and WHEREAS, the Board of County Commissioners, on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determination of facts: mill 11111 Reception#: 746335 04111!2008 08:51:10 AM Jean Alberico 2 of 3 Rec Fee,$0.00 Doc Fee:0.00 GARFIELD COUNTY CO 1. That proper notification was provided as required by law for the meetings and hearings before the Planning Commission and before the Board of County Commissioners. 2. That the public meetings and hearings before the Planning Commission and the Board of County Commissioners were extensive and complete; all pertinent facts, matters and issues were submitted; and that all interested parties were heard at those hearings. 3. That the application has met the requirements of the Garfield County Zoning Resolution of 1978, as amended. 4. An error was made in establishing the current zoning. 5. That the conditions of the neighborhood have changed to such a degree to support the requested zone change from Agricultural Residential Rural Density to Light Industrial 6. That the proposed zone district amendment has been determined to be in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado, that based on the determination of facts set forth above, the request is approved to rezone the Property from Agricultural Residential Rural Density to Light Industrial.
