W. WEA VER EXEMPTION FROM AGRICULTURAL I RESIDENTIAL I RURAL DENSITY AND COMMERCIAL GENERAL TO LIGHT INDUSTRIAL Parcels 1and2 (Parcel ID): 2179-192-00-498 WHEREAS, the Board of County Commissioners of Garfield County, Colorado received a request from the Estate of Thelma Weaver represented by Carter & Sands, P. C., to rezone Parcels I and 2 of the J. W. Weaver Exemption from Agriculture I Residential I Rural Density and Commercial General to Light Industrial; WHEREAS, Parcel I and 2 of the J. W. Weaver Exemption were approved by the Board of County Commissioners in 1994 which is memorialized in Resolution 94-034; WHEREAS, Parcel 2 of the J. W. Weaver Exemption was rezoned from Agriculture I Residential I Rural Density and Commercial General in 1994 and is memorialized in Resolution 94-118; WHEREAS, on Wednesday, November 9th, 2005, the Garfield County Planning Commission, in a public meeting, forwarded a recommendation of approval to the Board of County Commissioners for the proposed zone district amendment finding that the conditions of the neighborhood have changed to such a degree to support the requested zone change from Agriculture I Residential I Rural Density and Commercial General to Light Industrial; .-. 111111111111111111111111111111111111111111 lllll llll llll 687911 12/07/2005 02:05P 81752 P992 M ALSDORF 2 of 3 R 0.00 D 0.00 GARFIELD COUNTY CO WHEREAS, the Board of County Commissioners held a public hearing on the 21s• day of November, 2005 upon the question of whether the zone district amendment should be granted or denied, at which hearing the public and interested persons were given the opportunity to express their opinions regarding the issuance of said amendment; and WHEREAS, the Board of County Commissioners, on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determination of facts: I. That proper notification was provided as required by law for the meetings and hearings before the Planning Commission and before the Board of County Commissioners. 2. That the public meetings and hearings before the Planning Commission and the Board of County Commissioners were extensive and complete; all pertinent facts, matters and issues were submitted; and that all interested parties were heard at those hearings. 3. That the application has met the requirements of the Garfield County Zoning Resolution of 1978, as amended. 4. That the conditions of the neighborhood have changed to such a degree to support the requested zone change from Agriculture I Residential I Rural Density and Commercial General to Light Industrial. 5. That the proposed zone district amendment has been determined to be in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado, that based on the determination of facts set forth above, the request is approved to rezone Parcels I and 2 of the J. W. Weaver Exemption from Agriculture I Residential I Rural Density and Commercial General to Light Industrial. Dated this 5th day of December, A.D. 2005. GARFIELD BOARD COMMIS~INlS.
