Markley FlmPr Marian T_ Smith Don DeFord Mildred Alsdorf Chuck Deschenes , Commissioner Chairman Commissioner , Commissioner , County Attorney , Clerk of the Board , County Administrator when the following proceed!ngs, among others were had and done, to -wit: RESOLUTION NO. 91-025 A RESOLUTION CONCERNED WITH THE kPPROVAL OF A SPECIAL USE PERMIT APPLIrpTION FOR A TiMPORARY COMPRESSOR SITE FOR NORTHWEST PIPELINE CORPORATION. WHEREAS, the Board of County Commissioners of Garfield County Colorado, has received application from Northwest Pipeline Corporation for a Ter;;porar_y Compressor Site on the Following described tract of land: (in the State of Colorado and the County of Garfield); and A tract of land located in the SE 1/4 NE 1/4 of Section 34, Township 6 South, Range 95 West of the 6th Principal Meridian. WHEREAS, the Board held a public hearing on the llth day of February, 1991,.upon the question of whether the above-described Special Use Permit should be granted or denied, at which hearing the public and interested persons were given the opportunity to express their opinions regarding the issuance of said Special Use permit; and WHEREAS, produced at determination the Board on the basis of substantial competent evidence the aforementioned hearing, has made the following of fact: 1. That proper publication and public notice was provided as required by law for the hearing before the Board of County Commissioners, 2. That the hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that hearing. 3. That the proposed use consistent with the intent of the Garfield County Zoning Resolution. 4. For the above stated and other reasons, the proposed use is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado that the Special Use permit be and hereby is authorized permitting the use of the above described tract of land for a Temporary Compressor Site upon the following specific conditions: BOOK 80i PAGE 5I 1. All proposals of the applicant shall be considered conditions of approval unless stated otherwise by the Board of County Commissioners. 2. The applicant, contractor, and subcontractors shall notify the County Clerk's office and Assessor's office to ensure proper licensing and assessment of equipment and vehicles based in `the operation, prior to final approval. 3. An approved Air Pollution Emission Permit from the Colorado State Department of Health shall be submitted for the Compressor station. 4. The applicant shall have 120 d:ys from the date of the Resolution of Conditional Approval to meet all conditions set forth in the Resolution. The Conditional Use Permit shall be issued when all conditions are met and shall expire 120 days after issuance, unless construction or use has commenced. 5. The temporary unit shall be allowed temporarily and shall be removed by February 11, 1992. 6. The compressor shall be adequately muffled. Noise generation shall be in compliance with State Statutes. 7. The applicant shall provide a copy of the lease with the landowner prior to operation. 8. The applicant shall demonstrate the authority to use all private access roads to the site. 9. The applicant shall provide a reclamation plan providing for the restoration of the site to its original condition. Certified weed free seed and mulch shall be used in the revegetation. Monitoring for noxious weeds shall occur for 2 years. The site shall be reclaimed within 120 days of the permit expiration date.
