Colorado 'has received an application from Gary: Energy Corporation for a, Special Use Permit:' for construction and operation of a'.8`5/.8" Grans mission pipeline in the rollowing`descriaed corridor To .begin in Garfield" County in T7S,' R96W in NW 1/4 :of Section 2, traversing Section 2 in a southeasterly direction .into. the SW 1/4 of. Section 1, turning due south, traversing the.. west" 1/2. of ..Section 12, into the . NW .1/4 :of 'Section 13. Runs southwesterly nto.'the NE 1/4 of Section 14, traversing' .into the . SE ;1/4 Section 14, turns due south in the NE 1/4 of Section. 23, . then`-. follows: U.S.Highway right-of-way 6 & 24 to a point in T8S,.R97W in the "SE 1/4 of Section 12. WHEREAS, pursuant to required public :notice , the.Board:conducted..a public . hearing on the 19th "day of:' September , 1983, upon.the -ques.tion`..of whether the above-described special use. permit should ''b: granted- or denied, at which hearing the public and interested . per sons were . given, the opportunity to express their opinions regarding the issuance of special use permit; and, WHEREAS, the Board on the:basis of the. evidence produced.at the aforementioned hearing, has made the following'deterrninations of.fact: 1. That application has been filed in accordance with Section .5.;:03:„o the Garfield County Zoning Resolution of i9784 -as 'amended; 2. Proper.pubiic notice: was provided'. as required by of the.Garfield County Zoning Resolution. of 1978, as Section `.9..03.04 amended; 3::: The proposed use is compatible' with the uses existing and, permitted:in the district in which it is to be located, provided that certain hereinafter contained conditions be complied with; and, 4 That neither the impact on .traffic volume and safety or on utilities, or any other impact of the special use will be' injurious to: the :established neighborhood 'or zone district in which the -"special use is :to be located: NOW, ;THEREFORE, BE IT.`RESOLVED by ;the , Board of County Commissioners `.o Garfield County, .'Colorado, that a special use 'Permit he and hereby: is authorized permitting:the use of the above-described c.orridor .:for .:the construction and operation of 8 5/8" transmission 'Pipeline, upon the:, following specific conditions being. met or agreed upon prior. to construction;: 1. That 'prior to :issuance of the subject special use.- Permit the applicant shall obtain and Submit -to the GarfieldCounty Department ::of Development/Planni.ng Division copies of • a) ,All' permits .from- other . governmentai entities;. b).'The specific -location of the easerient "and "..easel ent: ,agr.e.erients with. :pr ivate and : public . landowners: 3.: That. the applicant will : demonstrate prior ,to : issuance of said.,: • Special Use Permit that it:. has provided •adequate security by bond.:or:' some similar security acceptable. to the County, for :County:=road maintenance a1drepair a8: deemed -appropriate: by the Board of County Commissioners:and County.Road Supervisor 4 That the appl ican.t will demonstrate prior: to issuance ;of said Special :Use Permit that it has provided :adequate, : secur'ity :by bond or some .simii ar security::acceptable to ..the County in ,the amount of $50,:000 for site -`rehabilitation after .:construction for' all:. pLivate.• lands crossed, 5. That upon an .allegation by an affected landowner .or govenmental entity, the Board shall investigate .compliance' with the `conditions of approval,, as provided . fot- in. Section 9.01:06 of the :Garfield --;County.. Zoning: Resolution of 1.97:8, as .amended; 6. That theproof o.f publication be presented to .the Department 'of Development/Planning Division. 7: That all access roads on private lands: be: temporary roads ,which, flail"l be recontoured -and :revegetated .or: -•completion .of construction,. :unless:a different type ;of.:access - road .is agreed upon- by the landowner involved; 8. That a general emergency spill contingency pian; be submitted prior,. to actual construction and the final Department of. Transportation emergency : spill contingency plan be submitted prior to actual operation; p ration: 9. At the time of a spill, if any, the applicant shall be responsible• for clean up and :reclamation of the affected.:property. Upon a showing to the Board of County Commissioners : of the failure of the applicant • to show financial responsibility to the above actions, the Board of County Commissioners shall consider suspension and revocation of the subject- land use permit; 10.
