Dear Mr. Jarman:
Encana Oil & Gas (USA) Inc. (Encana) has transferred the Orchard Compressor Station to Grand River
Gathering, LLC (Grand River). Encana requests that all permits associated with the Orchard Compressor
Station, including Special Use Permits authorized by Resolutions 2005-75 and 2006-104 and building
permits BLCO-7-11-2126, BLCO-7-11-2127, 10422, 10242, 10880, and 9741 and any future
correspondence be transferred and directed to Grand River effective October 27, 2011.
As existing permittee, I hereby agree to the transfer of the above -referenced permits and all
responsibilities thereof.

RE: Una Substation Capacitor Banks for EnCana's Orchard Mesa Compressor Station
Mr. Walker:
After reviewing the documents you have provided regarding planned improvements at Excel's
Una Substation, in particular, Resolution 2005-75 and the October 9, 2006 Board of County
Commissioners (BoCC) minutes, it is apparent to staff that the additional capacitor banks needed
to provide adequate power supply to EnCana's Orchard Mesa Compressor Station are a planned
component of previous land use change permits.
Condition number 8 of Resolution 2005-75 clearly indicates that the gas compressor units were
to be converted to electric power as soon as an adequate power source is available. In addition,
the October 2006 BoCC minutes reiterated the need to upgrade the electrical source m order to
switch to electric compressors as a condition to an amendment to the previous land use approvals
and to comply with a Colorado Oil and Gas Conservation Commission Noise Mitigation Plan.
With the information provided staff has determined that no additional land use change permits
are required.

Attached as PDFs are a vicinity map (Una -vicinity map), a survey map (fax -draft parcel boundaries)
and the initial general arrangement (initial -0902-001 001 S02), and the ultimate general arrangement
(ultimate -0902-001 001S01) for the proposed Una Substation.
Public Service Company of Colorado (PSCo) plans to build the initial phase before the end of
October. EnCana has requested the service in a very short time frame. The ultimate arrangement has
a longer lead time and will serve the same function as the initial phase while providing redundancy
within the system. EnCana has a substation on another area of the larger parcel, but because of
increased demand another facility is required. Space constraints near the existing substation and
other factors led to PSCo agreeing to build and own a new facility that will mainly serve EnCana's
Orchard Compressor Station. To be clear, this facility will be tied into the electric transmission system
that serves the area, but the bulk of the load on the nearby 69kV transmission line is from EnCana's
operation. This is similar to a new interchange that is tied into the larger transportation system, but
functionally serves one large traffic generator.
During our conversation on June 15, I referred to PSCo's facility as a capacitor bank. The proposed
facility uses a capacitor bank instead of breakers. A breaker and capacitor bank basically serve
the same function, which is, they regulate the flow of electricity. Capacitor banks are smaller in size
and have other technical differences. So while this facility uses a capacitor bank, it also includes
transformers, switches and other equipment that for all intents and purposes makes it behave like a
substation.
I am requesting a finding from the Planning Division that EnCana's Orchard
Special Use Permit Resolution No 2005-75 can be amended to include Una
operation of the Orchard Compressor Station.

Re: Special Use Permit for Processing and Material Handling of Natural Resources for the Orchard
Compressor Station, Resolution 2005-85

On Monday, August 15, 2005, the Board of County Commissioners (BOCC) approved the request for a
Special Use Permit for Processing and Material Handling of Natural Resources for the Orchard
Compressor Station based on compliance with certain conditions. EnCana Oil & Gas (USA) Inc.
(EnCana) is providing this letter and attached documentation as proof of compliance. For your reference,
the BOCC conditions appear in italicized font and the EnCana response occurs in normal font.
That all representations of the Applicant, either within the application or stated at the hearing before
the Board of County Commissioners, shall be considered conditions of approval unless explicitly
altered by the Board.
EnCana has and will comply with all representations within the application and stated at the hearing
before the Board of County Commissioners.
,2. That the operation of the facility be done in accordance with all applicable federal, state, and local
regulations governing the operation of this type of facility.
EnCana operates the compressor station in accordance with all applicable federal, state, and local
regulations governing the operation of this type of facility.
�3. The County Reserves the right to retain outside expertise, at the expense of the applicant/operator
of the facility, in order to conduct tests or analyses of the physical nature, water chemistry, or
groundwater properties on or away from the site.
EnCana will provide financial resources to the County for the expenses to conduct tests or analyses
of the physical nature, water chemistry, or groundwater properties on or away from the site.
4. That this facility is for the sole use of the applicant. if any other entities are to be added as users,
then they would be subject to an additional SUP as well as rules and regulations administrated by
the COGCC.

If any other users were to be added as operators of the compressor station, EnCana and the
additional user would submit an additional SUP to the County. The COGCC does not regulate
compressor stations.
The applicant shall submit a weed inventory and control plan of the subject property.
Refer to Attachment 1 for a copy of the Integrated Vegetation and Noxious Weed Plan.
The applicant shall comply with all standards as set forth in 5.03.08 "Industrial Performance
Standards" of the Garfield County Zoning Resolution of 1978 as amended.
Volume of sound generated shall comply with the standards set forth in the Colorado Revised
Statutes.

Every use shall be so operated that the ground vibration inherently and recurrently generated is not
perceptible, without instruments, at any point of any boundary line of the property on which the use
is located.
EnCana will conduct operations at the compressor station in such a manner as to not create
vibrations that would be perceptible at the property line. Vibrations are not noticeable at the nearest
property line and vibration at the property line is not expected to occur.
Emissions of smoke and particulate matter: every use shall be operated so as to comply with all
Federal, State and County air quality laws, regulations and standards.
Smoke is not produced at the Orchard Compressor Station. EnCana operates the compressor
engines in compliance with air quality permits received from the Colorado Department of Public
Health and Environment Air Pollution Control Division.
d. Every use shall be so operated that it does not emit heat, glare, radiation or fumes which
substantially interfere with the existing use of adjoining property or which constitutes a public
nuisance or hazard. Flaring of gases, aircraft warning signals, reflective painting of storage tanks, or
other such operations which may be required by law as safety or air pollution control measures shall
be exempted from this provision.

The Orchard Compressor Station does not emit heat, glare, radiation, or fumes under normal
operating conditions. Flaring of gas occurs occasionally due to abnormal, emergency, or
maintenance conditions; however, fumes do not substantially interfere with the existing use of
adjoining property or constitute a public nuisance or hazard.
Storage of flammable or explosive solids or gases shall be in accordance with accepted standards
and laws and shall comply with the national, state and local fire codes and written
recommendations/comments from the appropriate local protection district regarding compliance with
the appropriate codes.
No flammable or explosive solids or gases will be stored at the Orchard Compressor Station.
/f. No materials or wastes shall be stored at the compressor station in such a form or manner that they
may be transferred off the property by any reasonably foreseeable natural causes or forces.
No materials or wastes will be stored at the compressor station in such a form or manner that would
allow off-site transport by any reasonable foreseeable natural causes or forces. EnCana will adhere
to the SWMP to prevent stormwater run-off.
�7. The applicant shall identify all wildlife and possible impacts the compressor station will have and
propose a mitigation plan.
EnCana completed a wildlife assessment at the Orchard Compressor Station to identify any potential
impact to wildlife. Refer to Attachment 3 for a copy of the Wildlife Assessment.
✓ 8. The applicant shall, as soon as electric power is available, convert the compressor units to electrical
power.
EnCana received approval from the BOCC through a Special Use Permit in Resolution 2006-104 to
install electric -driven compressor units. As of November 2007, EnCana has completed the
installation of one electric -driven compressor unit, and plans to install a second electric -driven
compressor unit in the summer of 2008.
If you are satisfied that EnCana has met the conditions of approval, please issue the Special Use Permit
for this facility. If you need additional information or have any questions, please contact me.
