Cerise Earl Rhodes Mildred Alsdorf when the following proceedings, among others were had and lone, to -wit: Commissioner Chairman Commissioner Commissioner County Attorney Clerk of the Board RESOLUTION NO. 83-24 A RESOLUTION CONCERNED WITH -THE APPROVAL OF A SPECIAL USE PERMIT .APPLICATION BY':.: PUBLIC SERVICE COM''ANY OF COLORADO. WHEREAS, the Board of County Commissioners of Garfield County has received an application frc.n Public Service Company of Colorado for a special use permit for, a utility line; specifically, a 69 KV electric transmission line (built to 115 KV standards) on the following described tract of land: Public Service Company of Colorado's existing 69,000 volt electric transmission line will be rerouted beginning at a point on the existing Cameo -Shoshone 69,000 volt transmission line approximately 3/4 mile East of No Name Creek in Section 1, Township 6 South, Range 98 West of the Sixth Principal Meridian; thence northerly and norteasterly through Sections 32 and 33, Township 5 South, Range 88 West of the Sixth Principal Meridian; thence southeasterly and easterly through Section 1, Township 6 South, Range 89 West and Sections 6 & 5, Township 6 South, Range 88 West of the Sixth Principal Meridian to a point on the existing Cameo - Shoshone 69,000 volt electric transmission line East of Grizzly Creek, through portions of unsurveyed land all roughly paralleling the North side of the proposed I-70; all in the County of Garfield, State of Colorado. WHEREAS, pursuant to required public notice, the Board conducted a public hearing on the 13th day of September, 1982, upon the question of whether the above described special use permit should be granted or denied, atwhich hearing the public and interested Persons were given the opportunity to express their opinions regarding the issuance of :. said special.use permit; and WHEREAS, the Board, on the basis of the evidence produced at the aforementioned hearing, has made thefollowing determinations of fact: 1... That proper po$ting, publication, and public notice. was provided as required by law for the hearing before. the Board of County Commissioners; 2. That all hearings before the Board of County Commissionerswere extensive and complete, that all pertinent facts, matters and issues were:submitted;.and that all interested parties were heard at that hearing; 3. That the proposed special use conforms to Section 5.03 concerning the Approval of Disapproval of a Petition for a Special Use, of the Garfield County Zoning .' Resolution; 4. That the proposed land use will be compatible with existing and permitted - land uses in all directions. NOW, THEREFORE, BE IT RESOLVED by the Commissioners of Garfield County, Colorado, that a special use permit be and hereby is authorized permitting the use of the above described tract of land for a utility line; specifically, a 69 KV electric transmission line (built to 115 KV standards) upon the following specific conditions: 1. That the use of the tract of land comply with all present and future regulations of Garfield relating to a utility line in the zone district in which the property is now or inay later be located; 2. That, prior to the issuance of the authorized special use permit, the above described tract of land shall be severed from any other tract of land upon which there may exist a principal use, unless such other such principal use has been terminated ... at the time of the issuance of the special use permit; 3. All proposals of the applicant shall be considered conditions of approval unless stated otherwise by the Board of County Commissioners; 4.. The applicant shall submit an as -built legal description of the transmission, line to the, Planning Division within 60 days ofproject completion; 5. The applicant shall submit copies of. their State and Federal agency: approvals (BLM, Forest Service, State Highway Department)` to the Planning Division prior to..:. issuance of the Special Usa Permit, BOOK €19 N!nE 4 6. The applicant shall submit evidence of their legal right of entry to any private lands crossed by the electrical transmission line to the Planning Division prior to the Public Hearing with the Board. of County Commissioners; 7. The permit issued hereunder shall extend only to the location and operation of a 60 KV transmission line (built to 315 KV standards) and the temporary staging area; 8. Any disturbance to existing vegetation resulting from dismantling of. the: old line shall be revegetated as per the revegetatim plan for new proposal; . 9. The applicant must receive this Special Use Permit within one year of its approval and authorization..
