Fees: Base Fee is an estimate of the average number of hours of staff time devoted to an application, multiplied by an hourly rate for the personnel involved. The Board recognizes that the land use application process time varies and that an Applicant should pay for the total cost of the review which may require additional billing. Hourly rates are based on the hourly salary, and fringe benefits costs of the respective positions combined with an hourly overhead cost of the office will be used to establish the actual cost of County staff time devoted to the review of a particular project. The increased runoff amount is summarized in 'fable 4 of the Engineering report, which is shown below. It is not known when or exactly where lot improvements will be constructed. Because the runoff does not increase until the lot improvements occur, we are requesting a design waiver to defer the detention structure construction until the lot is built upon. Another point of concern is that location of 1SDS systems and related leach fields are not known. ]here is a concern that building a detention structure in appropriate areas within the subdivision may interfere where a potential I5D5 system may be for a specific lot. 'l'he required detention volume has been divided equally between the lots. The construction requirement has been noted on the civil plans, on the subdivision plat, and in the I -10A covenants. All comments have been addressed adequately except for the following: 1. The Applicant requests a waiver for construction of the siormwater detention ponds and proposes to have the detention constructed by future lot owners. The method of implementation and arguments for are understood. The primary reason for the recommendation against is the precedence that is set then for passing of the construction of subdivision improvements off on lot owners. 2. Lot 3 is basically a divided lot that is split by the road/easement and is a deficiency in the requirements of the code. County Legal staff will need to advise the BoCC. 3. It will be up to the BoCC to determine if the Applicant has provided sufficient justification to grant the waiver the road requirements. 5. The Revegetation and Weed Management Plans included in the application are acceptable. The applicant has identified the surface area of pipeline disturbance on lands within Garfield County's jurisdiction as 107.8 acres. A revegetation security of $269,500 (107.8 acres x $2500/acre) is recommended. The applicant has prepared a security of $269,730 and included a copy of the security within the application. The $269,730 amount is acceptable. The security shall be held by Garfield County until vegetation has been successfully reestablished according to the Reclamation Standards in the Garfield County Weed Management Plan. It is the responsibility of the applicant to contact the County, upon successful revegetation establishment, to request an inspection for security release consideration. The Reclamation Standards at the date of permit issuance are cited in Section (s) 4.06, 4.07 and 4.08 of the Garfield County Weed Management Plan (Resolution #2002-94). The result of that hearing was issuance of recommendation to the Board of County Commissioners to approve the subdivision subject to conditions. Those conditions were itemized as the following: 1 That all representations made by the Applicant in the application, and at the public hearing before the Planning Commission shall be considered conditions of approval, unless specifically altered by the Board of County Commissioners. 2. The Preliminary Plan approval shall be valid for a period of one (1) year. 3. Plat Notes The Applicant shall comply with the final plat requirements in addition to those requirements contained within the Garfield County Unified Land use Resolution of 2008, as amended (ULUR): a. The Final Plat shall contain the following notes: Control of noxious weeds is the responsibility of the property owner; ii. No open hearth solid -fuel fireplaces will be allowed anywhere within the subdivision. One (1) new solid -fuel burning stove as defined by C.R.S. 25-7-401, et.seq., and the regulations promulgated thereunder, will be allowed in any dwelling unit. All dwelling units will be allowed an unrestricted number of natural gas burning stoves and appliances; iii. All exterior lighting shall be the minimum amount necessary and that all exterior lighting shall be directed inward and downward, towards the interior of the subdivision, except that provisions may be made to allow for safety lighting that goes beyond the property boundaries; iv. Colorado is a "RIGHT -TO -FARM" state pursuant to C.R.S. 35-3-11, Et. Seq. Landowners, residents and visitors must be prepared to accept the activities, sights, sounds and smells of Garfield County's agricultural operations as a normal and necessary aspect of living in a county with a strong rural character and a healthy ranching sector. However, state law and county policy provide that ranching, farming and other agricultural activities and operations within Garfield County shall not be considered to be nuisances so long as operated in conformance with the law and in a non - negligent manner. Therefore, all must be prepared to encounter noises, odor, lights, mud, dust, smoke, chemicals, machinery on public roads, livestock on public roads, storage and disposal of manure, and the application by spraying or otherwise of chemical fertilizers, soil amendment, herbicide, and pesticides, any one or more of which may naturally occur as part of legal and non -negligent agricultural operations; v. All owners of land, whether ranch or residence, have obligations under state law and county regulations with regard to the maintenance of fences and irrigation ditches, controlling weeds, keeping livestock and pets under control, using property in accordance with zoning, and other aspects of using and maintaining property. Residents and landowners are encouraged to learn about these rights and responsibilities an act as good neighbors and citizens of the county. A good introductory source for such information is "A Guide to Rural Living & Small Scale Agriculture" put out by the Colorado State University Extension Office in Garfield County; vi. Based on the analysis of the sub -soils on the property, Individual Sewage Disposal Systems and foundation designs are required to be conducted by a registered professional engineer licensed to practice within the State of Colorado. These studies and plans shall be submitted with individual building permit application for each lot. The cost of these studies shall be bome by the individual property owner; vii. A Site-specific soils and foundation investigation shall be submitted with the Building Permit application for each lot within the Froning Subdivision; viii. Restrictions regarding animal control, fencing rand prevention of conflicts with wildlife shall be included in the protective covenants compliant with the recommendations of Colorado Wildlife Science, LLC contained in a report dated August 2010; ix. All streets are dedicated to the public use but wilt be owned and maintained by Homeowner's Association. All streets will be constructed to standards consistent with Article VII, Section 7-307 Roadway Standards, of the ULUR, unless specific sections have been waived by the Board of County Commissioners. Repair and maintenance shall be the responsibility of the incorporated Homeowners Association of the subdivision; x. The mineral rights have not been severed from the surface parcels however the future sale of the sites may sever these rights. In order to inform future owners that mineral rights may be severed a plat note regarding this fact must be included on the final plat. 2 4. FINAL PLAT The Final Plat shall contain the following certificates as contained within the Plat Certificate Appendix of the ULUR: i. Certificate of Dedication and Ownership; ii. Lienholder Consent and Subordination Certificate, if applicable: iii. Board of County Commissioners Certificate; iv. Title or Attorney Certificate; v. Treasurer Certificate of Taxes Paid; vi. County Surveyor Certificate; vii. Clerk and Recorder Certificate; viii. Surveyor Certificate. 5. WATER REQUIREMENTS a. The Applicant shall obtain a well permit for the subdivision as required by the Division of Water Resources and this well permit shall be considered a submittal requirement at final plat; b. The Applicant shall include the terms and conditions of water decree case no. 06CW195 in the Subdivision Improvements Agreement and Restrictive Covenants; c. The applicant shalt provide a tetter from the Carbondale & Rural Fire Protection District regarding the sufficiency of the water storage tank to meet fire flow as well as domestic and irrigation uses. If the Fire District recommends additional storage capacity the Applicant shall be required to revise the construction pians and cost estimates in compliance with this requirement; d. The Applicant shall submit the results of well testing as required by Section 7-104 B. of the ULUR with the Final Plat application, The report shall provide data sufficient to demonstrate provision of adequate water quantity and quality to serve the lots in the subdivision; e. If water quality analysis requires treatment of the water the Applicant shall provide design of the treatment system and cost estimates as a submittal requirement at final plat; f. The HOA shall be transferred the water rights, well permit and all easements and facilities related to the water system for this subdivision; g. The subdivision covenants, or other HOA documents, must include description of the right of each lot to use the water, must adequately describe the maintenance requirements of the system, and must assign authority to the HOA to collect fees associated with the use and maintenance of this system. This documentation shall be considered a final plat submittal requirement and shall be reviewed by the County Attorney's office for a determination of sufficiency. 3 6. ROAD REQUIREMENTS Should the Planning Commission support the requested waivers regarding road standards a condition should be included which requires the applicant delineate adequate snow storage areas on the final plat and create easements for the areas. The easements shall be dedicated to the Homeowner's Association. Should the Planning Commission not support the requested waivers then a condition should be included which requires that the subdivision comply with the minimum standards in Section 7-307 of the ULUR. 7. SUBDIVISION IMPROVEMENTS AGREEMENT a. The Applicant shall provide a site grading plan demonstrating how flows from the existing basins will be mitigated with the submittal of any building permit on the newly created lots. This shall also be required as a plat note on the Final Plat and within the covenants; b. The retaining walls required by the subdivision shall be designed and included in the subdivision improvements agreement. Adequate easements must be created and the easements dedicated to the HOA who will be responsible for ongoing maintenance of these structures; c. Should additional water storage be required, based upon requirements of the Carbondale & Rural Fire Protection District, the Applicant shall provide an updated design and revise the cost estimates. 8. COVENANTS a. Section 3.12, Recreational Vehicles (RV), which permits RV's to be used for occupancy by the owners of a lot or their guests for up to 60 calendar days, shall be amended to states that RV's can be on the site for up to 14 calendar days; b. Section 3.18, Variances, shall be amended regarding the ability of the ACC or the Board of the Association allowing for variance from the provision of the covenants. The ACC or the Board may only grant variances that do not affect the compliance of the subdivision with the Unified Land Use Resolution of 2008, as amended; c. The covenants shall include requirements related to the on-site retention required for each lot including the specifications for the retention; d. The covenant shall include requirements for fire sprinklers in the single family homes within the subdivision covenants including, but not limited to, water pressure/booster pump requirements. 9. IMPACT FEES a. The Applicant shall submit an appraisal with the Final Plat application so that calculation of the amount of the fee -in -lieu payment of school land dedication for the subdivision can be calculated. Payment of the fee -in lieu will be required prior to approval and recording of the final plat for the subdivision; 4 b. Prior to approval and recordation of the final plat The Applicant shall be required to comply with Resolution 2008-05, the required residential impact fee for the Carbondale and Rural Fire Protection District. A letter from the District regarding satisfaction of payment must be submitted to Building & Planning prior to plat approval. 10. As a final plat submittal requirement the Applicant shall provide information regarding completion of the formation of an incorporated homeowner's association. 11. The Applicant shall delineate and legally describe all easements on the final plat and convey all easements to the responsible entity. This dedication shall be in a form acceptable to the County Attorney's Office and transfer shall occur at the time of recording of the final plat. These easements shall include, but are not limited to all easements of record, utility easements, drainage easements, water system easements, stormwater drainage easements, open space and any internal roads required as a part of this development. 12. Final plat submittal requirements shall include a Storm Water Management Plan that focuses on erosion control that prevents the detachment of soil rather than sediment control, which focuses on removal of soils particles from runoff. 13. A note shall be required on the Final Plat for the Froning Subdivision which clearly identifies Lot 3 as one ±5 -acre parcel permitted to contain one single family. The access road runs through the lot however this `splitting' of the parcel does not create more than one parcel comprised of the 5 -acre area. This recommendation shall be forwarded to the Board of County Commissioners at their regular meeting to be held on August 13, 2012. Pursuant to the requirements of the ULUR public notice shall be as follows; F. Notice of Public Hearing. Certain land use change applications will require a public hearing. Unless otherwise provided by these Regulations, when a public hearing is required the following public notice shall be required. 1. Notice by Publication. At least thirty (30) and not more than sixty (60) calendar days prior to the date of a scheduled public hearing before the Planning Commission, and at least thirty (30) and not more than sixty (60) calendar days prior to the date of a scheduled public hearing before the Board of County Commissioners, the applicant shall have published a notice of public hearing in a newspaper of general circulation in the area that the proposed land use change is located. Publication of said notice shall follow a form prescribed by the County. 2. Notice to Adjacent Property Owners. Except for text amendments to the provisions of this Resolution and existing Planned Unit Developments, at least thirty (30) and not more than sixty (60) calendar days prior to the date of a scheduled public hearing, the applicant shall send by certified mail or by a nationally recognized overnight courier, return receipt requested, a written notice of the public hearing to the owners of record, as shown in the office of the County Clerk and Recorder or Assessor at least 30 days prior to sending notice, of all 5 adjacent property within a 200' radius. Within the same time period written notice shall be provided to owners of mineral in interests in the property (other than construction materials as defined in Section 34-32.5-10 CRS, as amended) in accordance with Section 24-65.5-101, et seq., CRS, as amended. (Resolution 2009 - 53) 3. Posting of Notice. Except for text amendments to the provisions of this Resolution and existing Planned Unit Developments, at least thirty (30) and not more than sixty (60) calendar days prior to the date of a scheduled public hearing the applicant shall post a notice of the public hearing on the property. Such notice shall consist of at least one sign facing each adjacent road right-of-way, and located so as to be fully visible from the road right-of-way generally used by the public. Such signs shall be provided to the applicant by the Planning Department. (Reso 2009 - 53) The notice shall include the property's legal description, a short narrative describing the current zoning and proposed land use change, and an announcement of the date, time and location of the scheduled hearing, names of the owners of the property and their designated representative. Proof of Notice. At the public hearing, the applicant shall provide proof of publication, proof of notification or attempt of notification of adjacent property owners, and proof of posting notice on the property. The applicant shall provide proof of notification or attempt to notice owners of mineral interest in the subject property. SE has marked up the staff report that you previously sent a few days ago. I will try to be brief, as you have heard most of our comments previously. p.11. Retaining walls. Report notes concern becuae of lack of design. There is a design for retaining walls on page c.4.1 of the civil plans. Fire District letter of May 5, 2011. This letter states that the 10,000 storage is acceptable. In one or two places of the report my reading is that they have not commented, and then in one place it notes that they have. Condition 5.c (p 29) requires a letter from Carbondale Fire related to sufficiency of storage in order to satisfy fire flow, domestic and irrigation uses. I assume this condition is placed in there in case Fire Department standards (or other criteria) change in future prior to construction of the subdivision_ Please advise. p. 18. (8)Defensible Space. States that Defensible space is not mentioned in covenants. Defensible space information is contained in Section 19 of the application binder and is intended to be in Exhibit B of covenants (see my letter from 5-25-12 in intro section). This letter deals with a number of issues and outlines whether they are in the covenants- or will be- with the Final Plat submittal). p. 19. exterior lighting. There is a draft plat note in the application and lighting is included in section 3.9c of covenants. It is implied that it is not addressed. p. 20-21. Solid fuel burning devices. Says not in covenants (but page 22 notes that it is in covenants). They are addressed in Section 3.9d of covenants. p.21. Discussion of Lot 3 under Section 2 (Subdiv Lots). 2' paragraph talks about "Planning Commission should evaluate....". Should be updated to say PC considered and recommended approval of waiver, and now BOCC needs to evaluate, etc. p.22. Drainage/detention. Says requirements and standards not addressed in covenants. While they may need to be supplemented, they are contained in Section 10.10 of covenants. p. 24 - 3.b. Discussion says that culvert at intersection required to alleviate drainage. There is already an existing culvert at intersection, and 2 other culverts will be provided as part of plan. Lot 3 design waiver: The 2008 Unified Land Use Resolution (code) section 7-402 (F) states "No lots shall be divided by County or municipal boundaries or roads. Regional detention ponds were considered for this site as well, but because of the rural location of the project, the steep terrain, and the storm runoff split to the east and west (separate basins which is unusual for a small project) we deemed regional ponds not feasible for this project. Also regional ponds would increase the disturbance area on the east side of the project because it would need to be located near the outflow point (lowest elevation) of the project. The primary purpose of the long time period between the original hearing (May 11, 2011) and the continued date was so that the potential affordable housing amendments may have a chance to wind its way through the zoning amendment process. A hearing on Affordable Housing proposed amendments is scheduled for October 10th, so at least that is moving forward. The issue is that even if relevant portions of the Housing one text amendments are adopted, they will of course not be effective on October 12th'. You may know more about the precise status of the amendments and whether it is wise to hold the continued hearing for the Froning Preliminary Plan Application on October 12th. If you feel it is prudent to wait until the November or December Planning Commission meetings, that is acceptable to the applicant and design team. That being said, we feel it is best to submit at this time written comments about issues that are still outstanding. Attached you will find a Letter from Sopris Engineering discussing outstanding engineering items as well as an updated set of civil engineering plans. There are also a number of outstanding planning related items. Affordable Housing 1.0 Affordable Housing As mentioned in the application, our interpretation of Article VIII (Affordable Housing) of the ULUR is that the Affordable housing requirement does not apply. We also appreciate the fact that the Planning Commission and staff has worked with the Development Team and others in the community regarding this issue. That being said, it appears that Article VIII will be subject to a public hearing on October 10th and the present "trigger" for requiring affordable housing may be modified. If this happens, it appears that the Froning Family Subdivision application would not require the provision of affordable housing. Plat Notes and related Conditions The majority of the items below noted as 2.01 to 2.11 relate to issues that need formal plat notes or need to be provided for in the Declaration of Protective Covenants (Covenants) in some manner. These items and some other engineering related issues were noted in a fetter from the Mountain Cross Engineering dated April 26, 2011 to County staff. These items are addressed in the attached letter from Sopris Engineering (SE). SE has also updated the civil engineering plans in order to resolve as many engineering issues as possible at this time. Impact Fees, HOA documents and easements 6.01 School land dedication fee -in -lieu An appraisal for the purpose of calculating the amount of the fee -in -lieu payment for school land dedication will be provided as part of the Final Plat application. 6.02 Fees to Carbondale & Rural Fire Protection District (C&RFPD) The residential Impact fee to the C&RFPD will be paid and documentation provided prior to the execution of the Final Plat. The necessary agreement with the Fire district will be signed at that time as per C&RFPD policy. 6.03 Incorporation of HCA Documentation regarding incorporation of the HOA will be provided per ULUR requirements. The By -Laws and draft covenants were provided as part of the Preliminary Plan Application. 6.04 Description and conveyance of easements As per the proposed condition in the staff report, the Applicant will delineate and legally described all easements on the Final Plat and convey to the responsible party as required. In regards to steep road grades during snow and ice conditions. r It is agreed that the steep road grades can be difficult during snowy and icy conditions. As is true of many rural areas in Garfield County, the proposed development is in steep mountainous terrain. Y The proposed access road onsite, although steep, is an improvement over the existing condition. The site is also predominately south facing with reddish native soils which are not likely to create long periods of ice problems. The proposed HOA will plow and maintain the access road during winter driving conditions, and will place sand or gravels in ice problem areas as necessary. This matches the existing maintenance that currently is being done for the existing access road. In regards to 10,000 gallon water tank storage adequacy. ✓ Please refer to the May 5, 2011 Fire District letter in response to 10,000 gallon water storage adequacy. • Per the water usage calculations in the SE Engineering report, the peak day demand for the subdivision is 5,250 gpd. Per information provided by the applicant, the sustained flow rate for the existing well is 15 gpm. This flow rate will be confirmed by a 24 hour pump test for Final Plan. ✓ The tank will be filled via a float system, and will be continuously filled as the ►water is being used. During the peak day demand, the fill time at 15 gpm (900 gph) is less than 6 hours. Under this condition, the tank will be at or near full at all times, which provides for an adequate fire protection water source. ✓ Because the water storage system is also the potable water source, the fire storage size should also minimize the potential for black water. 5. In regards to tire hydrant location and differing pressures. ✓ PIease refer to the May 5, 2011 Fire District letter in response to the fire hydrant locations and pressures. 6. In regards to the individual booster pumps for sprinkler systems. Final design of the sprinkler system and the booster pumps will occur during the building permit process. Required flows are a part of the final building design. The covenants ►will be amended to add the fire sprinkler language from the May 5, 2011 fire district response letter. 7. In regards to the concentrated drainage flow concerns. • We have analyzed the road from STA 13+00 to 15+00, and also over the entire road section, to address concentrated flows. The delineated drainage sub basin on the west side of the road at STA 13+00 is 0.14 acres. The peak runoff for a high intensity 100 year 5 minute storm using the rational method was 0.40 cfs (Q-CiA=0.50*5.78*0.14). This runoff is not concentrated but instead will sheet flow over a broad 50' length of the road do►wn from STA 13+00, with a depth of flow over this width of 0.14". The majority of the access road follows the existing road alignment which is generally on the broad ridge that separates flow onsite to the east and the west. Because of this, any concentrated flow that hits the road is minimal, and generally will be allowed to follow the natural drainage paths. The roadside drainage swalcs will earry the storm runoff to culverts proposed at STA 2+75, 7+40, and at the offsite driveway intersection with the onsite access road at STA 3+20+, 8. In regards to Lot 5 drainage easement. As stated in our response to 7. above, concentrated flows from the road will be minimal. Where possible, flows should be allowed to follow the natural drainage paths. Station 11+50 is one of the minor natural drainage paths onsite. As such, any drainage diversion should be the responsibility of the Lot 5 owner at the time of construction, and a drainage easement will not be necessary. A drainage easement would be required only if increased flows from upstream development impacts the downstream lot. 9. In regards to two access points to Lot4. The west access to Lot 4 will be closed and revegetated. This requirement is noted on the plans. 10. In regards to the proposed retaining wall design, The proposed boulder wall shown is at a 1'II:1'V slope. The detail of the boulder wall is provided on sheet C4.1 of the civil plans. 11. In regards to the Guard Rail evaluation comment, r It is our opinion that guardrails are not necessary for this very low volume, low speed access. The access road through the steep slope areas is generally straight with minor bends. The cross slope of the proposed access road is also sloped in toward the uphill side of the road. The 2001 AASHTO publication Guidelines for Geometric Design of Very Low - Volume Local Roads (ADT < 400) states that, because of costs and the low frequency of collisions with the guardrail, this generally makes it impractical for use on roads with very low traffic volumes. Engineering judgement should be exercised for placement of guardrails for extremely severe conditions. It is our opinion that this site does not warrant guardrails. 12. In regards to well and tank telemetry switches. The water system and tank details will be provided for final plan. It is anticipated that the well and tank control will be via a float system. 13. Water Quality testing will he performed for the final plan. 14. A 24 hour pump test will he provided at final plan. 15. Pending BOCC determination, individual detention pond requirements will be added to the covenants. 1 6. The covenants will address public improvement costs and the associated cost sharing agreement. In response to the Garfield County Road & Bridge request for proposed drainage culverts: • The onsite roadside drainage swales will carry the storm runoff to culverts proposed at STA 2+75, and at the offsite driveway intersection with the onsite access road at STA 3+20+-. This will maintain the storm water runoff in the historic drainage paths onsite. • The existing 15" culvert under CR 107 was inspected and the location has been added to the civil plans. The contractor must submit for and receive a storm water management permit prior to construction onsite, and the implementation and maintenance of these storm water burps will be done by the contractor. The SWMP and erosion control notes, details, and schematic locations on the grading plan are intended to direct the contractor with the onsite implementation and methods. In response to the 2011 traffic counts on CR 107 • We have reviewed the July 2011 traffic counts provided to you by Kathy Easticy. The 2011traffrc counts (1209/7=173 ADT) are significantly lower than the previous counts in 2002 (250 ADT). • Based on this data, the existing level of service has improved. Because the amount of traffic is less, the traffic problems are less on County Road 107. • CDOT had no referral comments for this project with the old traffic data. Eastley Subject: Some Development Team comments on Froning Prelim Plan Dear Kathy: Thanks for providing the Staff Report for the Froning Preliminary Plan Application is a timely fashion so that we can address some of the issues identified by staff prior to the meeting. A number of the items identified in your staff report in our opinion have been addressed in the covenants and are intended to be mitigated as part of the development of the property. if these need enhancement, we are committed to working with staff to make these items acceptable. The items addressed in the covenants which have been identified in your staff report are: • Requirements for individual drainage/detention on each building site: Section 10.10, p. 23. This section requires full grading and drainage plan to be submitted by a qualified engineer as part of the design review process. The detention requirement is also outlined as a plat note. • Defensible Space. This is Exhibit B of the covenants (noted on page 29). In fact, Defensible Space was noted as being so important to the project that it has its own separate section of the application (Section 18). Defensible space is also mentioned in section 3.9 (f) (trees and landscaping) and other appropriate sections of the covenants. • Architectural control for visual mitigation: An entire section (10) is devoted to Design Review and section 10.6 specifically addresses Lot 1 and 4, which are the most visible lots. • Article 9 addresses shared costs which include road maintenance, snowplowing, share of maintaining the water system and sharing in the legal and monetary cost of complying with the water augmentation plan. • Section 10.10 (pages 21 — 22) lists specific documents that need to be submitted with the Design Review packet including fencing detail, Landscape Plan, engineered foundation plan, Site Specific soils and Percolation Test and design of an ISDS by a Licensed Engineer. The covenants may not have been specific enough in noting that the subdivision road will be dedicated as well as the water system for the project. We will include any restrictions related to "use" necessary for the water system. We will also comply with Best Management Practices for mitigating Fugitive Dust and site reclamation where appropriate. It was always our understanding that additional information regarding the well and water system would be required at time of Final Plat. This includes a 24 hour pump test; water quality report and updating the well permit as required. It was always our understanding that the Building Codes would require sprinkling of the structures when the project would be built out, and booster pump if necessary. The water service lines have been sized for this purpose. We will be happy to address this in the covenants to staff satisfaction. The current owner plows the snow and has a workable system for doing this. We will submit a "snow plowing" plan if you would like that as a condition of approval. We may have missed "bear proof" trash cans, but will comply with this and other directives related to wildlife protection with future submittals and final approval documents. The Design team will be prepared to address issues related to road grade, intersection with CR 107 and drainage design and easements at the meeting. Please contact me if you need to discuss any of the above. I would like to resolve as many issues as possible prior to the Hearing and leave as much time as possible to discuss important technical items. Technical completeness review has resulted in identification of additional information necessary to proceed with the application: 1. The purpose of traffic study is to analyze the impact of proposed developed on existing roads and to determine the standards which need to be applied to proposed roads within the development. CR 107 serves the subject property where an existing driveway provides sole access to three adjacent single family properties. The traffic study should consider the total vehicle trips that access the county road at the site of the proposed "public" access roadway. Adequate access easements are required —a 30' access easement to serve the lots to the south is noted, but a reception number has not been identified. Does this document currently exist? 2. The ULUR requires review of conformity with the Comprehensive Plan of 2030, including compliance with the Future Land Use Map (FLUM). The FLUM designation of the site is `Medium' which recommends a density range of 1 unit per 6 to 10 acres. Pursuant to the chart on Page 26 the 1 dwelling unit per 6 acres requires that at least 70% of the property be reserved as "Open Land". This can be done by dedication of easements to the proposed Homeowners' Association, creation of building envelopes that clearly defines the area outside of the envelopes as open land, dedication of the land conservation group or organization. It appears that the proposed area of building envelopes is 7.22 -acres or 23.4% of the site — leaving 76,6% of the property as "open land" (less the road). 3. The ULUR does not distinguish between "new" and "existing" lots — the request is to create five single family lots ranging from ±5 --10 acres. The Froning's interpretation of the affordable housing requirements is one that staff has not encountered in the past however we will move forward with the review and scheduling of PC hearing. Staff will have to consider whether or not we would support this interpretation. 4. The Title Commitment must be updated and deeds must be provided to demonstrate proof of ownership. 5. Both the Title Commitment and letter of authorization include provisions that indicate a trust is associated with ownership of the site, if so we need statements of authority and/or trust documents to designate a person authorized to sign on behalf of the trust. 6. I was unable to locate that the Lapaila Exemption information within the application. It is our opinion that this variance request for Froning meets these standards. The sections 1-6 from the code and our narrative explanation for each one arc listed below. Section 4-301 B. Standards for Approval of Variance Requests. The following standards shall be satisfied for approval of a request for variance from specific regulatory provisions of this Code. 1. Special Circumstances or Conditions Exist. The following circumstances or conditions exists with respect to the Froning Family Subdivision: a. Exceptional topographic conditions of the property. The existing topography onsite and of the general area requires steep road grades. The topography onsite adjacent to the access road is steeper than 1.5' horizontal to 1'vertical.lne existing access road onsite has sections with road grades equal to 14%. Sections of County Road 107 before the access to the site, have slopes greater than 14%, and CR 107 just after the site is at an 18% road grade. 2. Not a Result of the Actions of Applicant. The majority of the site is undisturbed existing conditions, not previously modified by the applicant. 3. Strict Application Consequence. Strict adherence to the road standards would result in a significant increase in site disturbance. Each variance requested reduces the site disturbance, which reduces the difficulty and hardship of the access road construction. a. The elimination of the 2' road shoulder variance from Station 1+00 to 6+00 is where the access road passes through steep slope areas of greater than 1.5' horizontal to I'vertical, and has significant cuts. An increase in overall road width increases the site disturbance_ In the steep slope areas an increased width would result in disturbance of the steep slope adjacent to the existing road. Any disturbance to the existing steep slope will require retaining walls. b. The variance from the Minimum Radius is at the access road intersection with CR 107. Thereafter the minimum radius will match the minimum 50' radius for a semi -primitive road as required by code. The proposed access road will match the existing access road location and elevation with some grading improvements. The intersection and the first 150 feet of the access road go through the steepest portions of the site. During previous design iterations for the proposed access road, the road was designed with a 50' centerline radius. This resulted in significant impacts to the adjacent slopes. Structural retaining walls would be required for greater than 100' lineal feet with heights in excess of 10'. c. A variance request from 10% to 12%, allows the proposed access road to more closely match the existing grade, and to follow the existing road alignment. In order to minimize site disturbance in this area, existing road grades onsite and on the county road are greater than 12%; some areas approach 18%. A proposed maximum'road grade of 10%, while achievable over the entire length of the access road, would approximately double the volume of cut and double the volume of fill required on the access road. 4. Variance is Necessary for Relief. As evident by existing road conditions in this area, construction should minimize site disturbance by using a reduced road width and curve radius, and an increase in the maximum road grade. 5. Not Detrimental to the Public Good. Granting the variances for the Froning Subdivision will not cause substantial detriment to the public good. The proposed access is a private road for the benefit of lots onsite, adjacent land owners, and emergency vehicular access. a. The Carbondale Rural Fire Protection District has indicated that the existing access road intersection with the corresponding widened section of CR 107 is acceptable, and provides adequate access for emergency vehicles. The Fire district has performed a preliminary review of the proposed access road design and expressed approval of the design modifications made to the access road. Per their letter dated June 4, 2010 (included in application), they have tested their largest tandem axle fire apparatus and found access to be acceptable. 6. Variance Will Not Impair the County's Zoning Plans. The variances requested will not impair the intent and purpose of the Code. The proposed access road with the variances granted will improve the existing access conditions. David Pesnichak is the County Planner for this project and he will review the project information and staff comments. This is a Sketch Plan Application for the Froning Subdivision. Five single-family residential lots are proposed from 30.97 acres. Access will be off of CR 107. The applicant proposes to have potable water provided by a central distribution system supplied by individual wells and sewer will be handled through ISDS. The current zoning of the property is A/R/RD and the Comprehensive Plan designation in Study Area 1 is "Low Density Residential (10+ acres per dwelling unit). The proposed density of this subdivision is 6.194 acres per dwelling unit. The A/R/RD zone district was discussed related to setbacks, maximum lot coverage, building heights, minimum lot sizes and uses allowed. A slide of the proposed site plan was shown. Existing now are two parcels. Parcel 1 is 18.5 acres and parcel 2 is12.39 acres in size. The application states that the Applicants are in the process of creating a single -ownership LLC. Currently there is a single-family home and a detached garage located on the 18.5 acre parcel. Slides of the surrounding area and the property were shown. There are some severe slopes on the property which exceed 40%, mainly to the south and west. A proposed site plan was shown with the proposed building envelopes. All lots will have access to CR 107 via internal road streets. The applicant is proposing a 40' right-of-way to accommodate access to the proposed lots. The internal roads are to be owned by the HOA and dedicated to the public. Road will have to meet the semi - primitive road standards. The applicant is also proposing to realign approximately 320 feet of the access road from CR 107. There is a turnaround proposed on Lot 1. The Carbondale Fire District indicated that the proposed access and turnaround appear to be adequate for emergency apparatus. Garfield County Road & Bridge made recommendations and comments. (See Exhibit F & H) There are a lot of publicly owned lands around this parcel. There are also major slope hazards on this property. This property is contained within a Visual Corridor. Major issues: • Density. The Comprehensive Plan designation is low density at 1 home per 10 acres. This proposal is 6.19 acres per dwelling. • Not sure if there is a guest house currently on this property or not. None is proposed. • Density not appropriate for this area. • Moderate to high fire danger in this area. • Unimproved gravel roads. • Slopes afflicting property. Planning Commission Minutes February 14, 2007 Staff recommends to reduce the density to 1 dwelling unit per 10 acres and to prohibit guest houses and accessory dwelling units. Standard RE- 1 and Fire Protection District impact fees will be required to be paid at the Final Plat stage. The property is not located within a traffic study area so no road impact fees will he required. A number of recommended plat notes 1 covenants were listed on pages 15 & 16 of the stair report. John McCarty with Otak introduced himself. Also present for the applicants tonight to answer any questions arc Sopris Engineering and HP Geotech who helped with review of proposal_ Paul and Linda Froning are here tonight representing the rest of the family. Applicants intend to combine the two parcels and create a 5 lot subdivision. John would like to have Linda & Paul speak first because they have a letter that they would like to read into the record. Linda Froning stated they purchased the 18 acres in 1985 as an investment into their future and thought that they could later subdivide off two lots to pay for their retirement. Linda Froning read their request and reasons into the record. Years ago they had come to the County and spoke to Mark Bean about what they were proposing which was five acre lots and Mark gave there encouragement that this would be okay for the area. They have spoke to neighbors, the DOW, the Fire District and have worked with engineers to help them to come up with this proposal. Paul Froning spoke next. They have worked hard to talk to neighbors to come up with a plan that is appropriate for this area. What we are trying to do here is for our family. Mr. Froning thinks this is appropriate for the area. John McCarty will speak next. Property is in the SE portion of the County and it is ii4 mile from Highway 82 and Highway 133. A slide was shown of the neighborhood character and the proximity to public lands. John stated there are a lot of 5 acre parcels in this area already as well as some larger ones heading up CR 107. CR 107 is a gravel and dirt road. John also mentioned that currently there is no guest house on the property and none are proposed. Applicant wants to keep consistent with the under lying zoning and the comprehensive plan. Capacity of land can handle a greater level of density. Think they can minimize impact to visibility and wildlife with building envelopes to preserve natural character of landscape. Will stay off of steep slopes. Will have landscape guidelines. Will improve roads by realigning road. Have internal access to BLM. Applicant met with the DOW and they had a few suggestions such as no perimeter fencing. Don't find constraints in building on these lots because building envelopes proposed are in the 0 to 20% slope areas. Applicant says roads are good for the proposed density. Seem to be more in -sink with moderate density design. ISDS constraints are moderate. Letters from neighbors were shown and all of thein are in favor of this development. This development is in close proximity to the Town of Carbondale for amenities. A 10,000 gallon water storage tank is proposed. Staff indicated that this 2 Planning Commission Minutes February 14, 2007 proposal is within a view corridor. Additional slides were shown from Highway 82 and Highway 133. There are 3,000 acres of public land in close proximity to the Froning property. Visual mitigation is being proposed by the Froning's such as sighting on building envelopes and certain color restrictions. Moved back to the Commission for questions. Terry Ostrom asked about the access to BLM between lot numbers 4 & 5 and can that be accessed by the public. Paul Froning said they propose that for users of the subdivision. John McCarty said where the access point is located that there is an access already. They are not precluding public access_ Shirley Brewer restated that slopes where building envelopes will be are 0-20%. John McCarty brought up the site plan on the overhead and showed where the proposed building envelopes would be and setbacks from future right-of-way. Trying to locate envelopes on more gentle slopes and cluster so they are all in general vicinity of each other. Linda Froning said they have looked at building site and think they have chosen the best areas. David Pesnichak said this proposal is within the two mile sphere of influence for the Town of Carbondale. John McCarty said from what he recalls, this is not within their urban growth area. David Pesnichak said he did forward this application to the Town of Carbondale and no comments were received. David Pesnichak said he was not sure when the 10+ acres plan came into play. The plan David is using to review this application is the Comprehensive Plan of 2000. The drive will fall into the semi -private driveway regulations which states that no driveways can be over 10% slope. Moved out to the public for comments. None were received so we came back to the Cdtnrnission for final summation. Cheryl Chandler commented that she would like to see all of the covenants run with the land so there is no further subdivision_ That if there are any minerals that they be conveyed with land. Does something need to be done to shoulder the road? CR 107 is used tremendously by hikers and bikers. This is a very busy road. This doesn't look like a clustered development. If you want more density will need to see more clustering. Carolyn Dahlgren would like to ask a question. Because this is a Sketch Plan application, the County Attorney's Office did not really do a really fine tune review of the ownership documents but it appears to her that this was part of a previous exemption. Are there any covenants or plat notes from that exemption that you need to be careful of for developing limitations. John McCarty said he didn't think so based on all of the documents he has seen. Carolyn Dahlgren said that will be important at the preliminary plan stage. -3 Planning Commission Minutes February 14, 2007 Fred Jarman said there are wildfire hazard problems in this area. John McCarty sees this as preservation of vegetation and not adding more. Only area allowed for improvements would be within the building envelope. Terry Ostrom mentioned he is not sure that clustering and preserving sage brush go together. Fred Jarman asked is there another way out from CR 107. Paul Froning said road goes to Quizenberry's property. Mr. Froning said they have proposed a turnaround on their property. Fred Jarman mentioned the standards in the Subdivision Regulations. County prohibits dead-end cul-de-sacs without secondary exit. Carolyn Dahlgren asked applicant, have they talked to Road & Bridge about what you are referring to as "The old County Road" that goes through the Quizenberry's. John McCarty said no and it looks like it hasn't had traffic in many, many years. Carolyn Dahlgren stated that may still be a county road. Need to do some research on that. If it a county road than it may need to be vacated. David Pcsnichak said that the Road & Bridge Department didn't have too many comments. Currently 5 homes use this access point and that would increase to 9. Sketch Plan continents are good for one year from tonight's meeting date.
