At a regular meeting of the Board of County
Commissioners for Garfield County, Colorado, held at the Commissioners'
Meeting Room at the Garfield County Courthouse in Glenwood Springs on
the 17th day' of July A.D. 1989 , there were present:.

RESOLUTION NO. 89-111
A RESOLUTION CONCERNED WITH THE APPROVAL OF THREE SPECIAL USE PERMIT
APPLICATIONS BY CHEVRON U.S.A., INC.
WHEREAS, the Board of County Commissioners of Garfield County,
Colorado, has received applications from Chevron U.S.A., Inc. for three
Special Use Permits for two natural gas wells and temporary office/storage
yard on the following described tracts of land:

(in the State of Colorado and the County of Garfield); and
WHEREAS, the Board held a public hearing on the 3rd day of July,
1989, upon the question of whether the above-described Special Use permits
should be granted or denied, at which hearing the public and interested
personspersons were given the opportunity to express their opinions regarding the
issuance of said Special Use permits; and .
WHEREAS, the Board on the basis of substantial competent evidence
produced at the aforementioned hearing, has made the following
determination of fact:
1. That proper publication and public notice was provided as required
by law for the hearing'before the Board of County Commissioners.
2. That the hearing before the Board of County Commissioners was
extensive and complete, that all pertinent facts, matters and
issues were submitted and that all interested parties were heard
at that hearing.
3. 'That the application is in compliance with the Garfield County
Zoning Resolution of 1978, as amended.
4. For the above stated and other reasons, the proposed use is
best interest of the health, safety, morals, convenience,
prosperity and welfare of the citizens of Garfield County.

NOW, THEREFORE, BE IT RESOLVED by the.Board.of County Commissioners of
Garfield County, Colorado that the Special Use permits be and hereby are
authorized permitting the use of the above described tracts of land for
natural gas wells upon the following specific.conditions:

1. All proposals of the applicantshall be considered..conditions of
approval unless stated otherwise by the Board of County
Commissioners.
2. The applicant and•driller•shall notify the County Clerk's office
and the Assessor's office to ensure proper licensing and
assessment of equipment "and vehicles based in the operation prior.
to final approval
3. The applicant and driller shall notify the County Road and Bridge
Department, prior to moving a drilling rig across County roads.
In addition, the applicant shall provide on-going maintenance to
County Road 204 and 211, under supervision of the Road and Bridge
supervisor, including, but not limited to, returning the County
road to not less than it's condition prior to the commencementof
drilling activities. The County roads shall be returned to said
condition at such time as the .wells are drilled, completed, or
equipped for production. Dust control measures will be utilized
as needed.
4. The applicant's $100,000 road bond shall be adequate to insure
compliance with Condition #3 and shall be maintained in place
.until such time. as the _wells have been drilled, completed, or
equipped for production.
5. The applicant shall comply with all applicable State and Federal
Agency requirements and obtain all' appropriate permits.
6. •The applicant shall obtain Road Cut Permits as required by the.
Garfield. County Road and Bridge Department, for all new access;
points off County roads.
7. The applicant shall obtain Garfield County Board of Health
approval for the use of temporary holding tanks for sewage
disposal.
8. The applicant shall provide detailed descriptions of the location`
of the temporary office site and temporary storage area. In
addition, site plans for both uses shall be submitted along with
plans. for removal and restoration by January 1, 1991.
9. The 'applicant shall have 120 days from the date of -the Resolution
'Of Conditional Approval to meet all conditions set forth in'the
Resolution. The Special Use permit shall be. issued when all•
conditions are met and shall expire 120 days after issuance,
unless construction or use has commenced.
