HomeMy WebLinkAbout2.0 BOCC Staff Report 02.05.1990REQUEST: APPLICANT: LOCATION: BOCC 2/5/90 PROJECT INFORMATION AND STAFF COMMENTS Special Use Permits for Two (2) Natural Gas Wells. Fina Oil and Chemical Company Well #14-22, SW 1/4 Section 22, T6S, R94W. Well #3-28, NW 114, Section 28, T6S, R94W. The well sites are located approximately 5 miles southwest of Rifle off the I-70 frontage road. SITE DATA: Each drilling site will consist of 1.25 acres. WATER: To be hauled to the site. SEWER: Portable chemical toilets. ACCESS: Proposed and existing access road off I-70 Frontage road. EXISTING AND ADJACENT ZONING: A/R/RD I. RELATIONSHIP TO THE COMPREHENSIVE PLAN The sites are located in District C, Rural Areas with Minor Environmental Constraints as designated on the Comprehensive Plan Management District's Map. II. DESCRIPTION OF THE PROPOSAL A. Site Description: The sites are located in rural portions of the County with land uses in the vicinity primarily open space, natural resource extraction and ranching. Both sites are located between 1-70 and the Colorado River. B. Project Description: The applicant proposes to drill a natural gas well on each site, with operations to begin in January, 1990. III. MAJOR ISSUES AND CONCERNS 1. No County roads are proposed to be used for access to the well sites. Access will be via the State maintained I-70 frontage road and private access roads. 2. The well sites are located on surface ownership of William Clough. The applicant has submitted copies of surface agreements and rehabilitation plans. 3. The applicant has also submitted copies of the State Oil and Gas permits to drill for each site. 4. Locations of the proposed wells are identified on the attached map. (See page'i IV. SUGGESTED FINDINGS 1. That proper publication and public notice was provided as requited by law for the hearing before the Board of County Commissioners. 2. That the hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that hearing. 3. That the application is in compliance with the Garfield County Zoning Resolution of 1978, as amended. 4. That for the above stated and other reasons, the proposed use is in the best interest of the health, safety, morals convenience, order, prosperity and welfare of the citizens of Garfield County. V. RECOMMENDATION APPROVAL, with the following conditions: 1. All proposals of the applicant shall be considered conditions of approval unless stated otherwise by the Board of County Commissioners. 2. The applicant and driller shall notify the County Clerk's office and Assessor's office to ensure proper licensing and assessment of equipment and vehicles based in the operation, prior to final approval. 3. The applicant shall comply with all applicable State and Federal Agency requirements and obtain all appropriate permits. 4. That a mist control be placed at the end of the blooey line to control dust during drilling for the purposes of air quality control. 5. That weed free seed and mulch be utilized for reclamation and that there be continued monitoring of the reclamation by the applicant or applicant's delegate. 6. That the applicant shall provide evidence acceptable to the Board of County Commissioners that all utility companies operating in, or with equipment in the vicinity of, the well sites have been notified, to assure no damage occurs to existing utility facilities. Said evidence shall include letters from utility companies indicating that they have been notified, written statements by the applicant indicating that there are no utilities in the area, and/or written statements from the applicant outlining their working relationship and notification policies with local utility companies. 7. The applicant shall have 120 days from the date of the Resolution of Conditional Approval to meet all conditions set forth in the Resolution.
