PLANNER: ACZ Inc. LOCATION: A parcel of land situated in a portion of Lots 9, 19, 20, 29, and 30, in Section 6, T8S, R10214; located approximately 14 miles north of Loma on State Hwy 139. II. DESCRIPTION OF THE PROPOSAL A. Site Description: The site is located in a very rural portion of the County, with adjacent land uses primarily ranching and open space. Existing improvements of the site include a corral and outbuildings, an abandoned house and a stock pond. The applicant has represented that the nearest occupied dwelling is the Young ranch, approximately 1 mile northwest of the site. The site has moderate to gentle slopes, with vegetation consisting mainly of sparse bushes and sagebrush. Two large cottonwood trees on the site will not be disturbed, in accordance with the Division of Wildlife comments. B. Project Description: The applicant proposes to develop a gravel pit, with an asphalt or concrete plant on the site, for use in association with contracts for reconstruction of portions of State Hwy 139. Commencement of activity is proposed for June, 1988, with termination anticipated in December, 1988. The actual gravel extraction area will consist of approximately 5.9 acres. A portable gravel crusher will be operated in the pit, to be replaced by a portable asphalt or concrete plant upon completion of gravel crushing and IV. V. Nfarev ' stockpiling. Only one processing facility will be operated at a time, with all equipment properly permitted with the State. It is estimated that hauling from the site will utilize a maximum of 133 round trips per day. Additional facilities are to include: mobile office, weighing facility, parking, tool storage and water storage pond. Improvements to the access road will include widening, graveling, culverting where necessary, and dust suppression measures. Reclamation is proposed to occur immediately following completion of the State Highway Contract, in accordance with Soil Conservation Service recommendations. MAJOR ISSUES AND CONCERNS 1. The applicant should submit verification that a valid State Highway Access Permit exists or has been approved for the proposed use for this site. 2. The applicant has represented that the proposed use would be temporary. Providing ample time for unexpected delays, it is recommended that the permit expire on 12/31/89, and that reclamation be completed within one year of that date. SUGGESTED FINDINGS 1. That proper publication and public notice was provided as required by law for the hearing before the Board of County Commissioners. 2. RECOMMENDATION APPROVAL, with the following conditions: 1. All proposals of the applicant shall be considered conditions of approval unless stated otherwise by the Board of County Commissioners. 2. That the applicant submit verification that a State Highway Access Permit has been approved for the proposed use for this site. 3. The applicant shall comply with all applicable State and Federal Agency requirements and obtain all appropriate permits, including MLRB approval. 4. That the Special Use Permit shall expire on December 31, 1989, and that reclamation of the site be completed within one year following its' expiration. 5. The applicant shall have 120 days from the date of the Resolution of Conditional Approval to meet all conditions set forth in the Resolution.
