HomeMy WebLinkAbout3.0 First Amended Special Use PermitReceptiont: 778417 11;3012009 01 18 24 PM Jean Rlberico 1 of 4 Ret: Fee.$0.00 Dor Fee 0 00 GARFIELD COIIWTY CO First Amended SPECIAL USE PERMIT for A property owned by Oxy USA WLP LP located on 5 -acre portion of a property containing approximately 13,918 acres located near the end of CR 312 (Conn Creek Road) in SW I/ of the SW % of Section 32, Township 6 South, Range 97W approximately 14 miles northwest of DeBeque; and Parcel ID: 2169-214-00-026 In accordance with and pursuant to the provisions of the Garfield County Unified Land Use Resolution of 2008, as amended and Resolution No. 2005 — 88, the following activity is hereby authorized by an Amended Special Use Permit: To add two (2) temporary compressors, one (1) dehydration unit, seven (7) above -ground tanks (300/400 bbl) and expansion of the control room by 171 sq. ft. to the existing and permitted natural gas conditioning and compressor station to specifically include the following as represented on the Amended Site Plan attached hereto: This First Amended Special Use Permit is issued subject to the conditions set forth in the above-mentioned resolution and conditions attached to this permit (Exhibit A) and Amended Site Plan (Exhibit B) and shall be valid only during compliance with such conditions and other applicable provisions of the Garfield County Unified Land Use Resolution of 2008, as amended, Building Code, and other regulations of the Board of County Commissioners of Garfield County, Colorado. Jarman, AI Dane ll' I II Reception4: 778417 11/3002009 01.18 24 PM Jean 0lber,uo of a Fen Fee $0 00 Onc Fee 0 00 t4PRFIF1 0 COFINTY Exhibit A 1) All temporary facilities and any associated site disturbance shall not be located within 35 -feet of Conn Creek; 2) All temporary facilities approved via this amendment shall be removed and relocated to Conn Creek Compressor / Treatment Facility II approved under Resolution 2009-32 once that facility is constructed; 3) That the operation of the facility be done in accordance with all applicable federal, state, and local regulations governing the operation of this type of facility. 4) That the Applicant shall comply with the fire protection provisions included in the rules and regulations of the Colorado Oil and Gas Conservation Commission (COGCC) and the International Fire Code as the Code pertains to the operation of this facility. 5) Volume of sound generated shall comply with the standards set forth in the Colorado Revised Statutes. 6) Vibration generated: the facility shall be so operated that the ground vibration inherently and recurrently generated is not perceptible, without instruments, at any point of any boundary line of the property on which the use is located. 7) Emissions of smoke and particulate matter: the facility shall be so operated so as to comply with all Federal, State and County air quality laws, regulations and standards. 8) Emission of heat, glare, radiation and fumes: the facility shall be so operated that it does not emit heat, glare, radiation or fumes which substantially interfere with the existing use of adjoining property or which constitutes a public nuisance or hazard. Flaring of gases, aircraft warning signals, reflective painting of storage tanks, or other such operations which may be required by law as safety or air pollution control measures shall be exempted from this provision. 9) Any storage area for uses not associated with natural resources shall not exceed ten (10) acres in size. 10) Any lighting of storage area shall be pointed downward and inward to the property center and shaded to prevent direct reflection on adjacent property. 11) Water pollution: in a case in which potential hazards exist, it shall be necessary to install safeguards designed to comply with the Regulations of the Environmental Protection Agency before operation of the facilities may begin. All percolation tests or ground water resource tests as may be required by local or State Health Officers must be met before operation of the facilities may begin. 12) That all proper building permits are obtained for the structures associated with the operation of the Compressor prior to the issuance of a Special Use Permit. 13) That the Applicant shall comply with the following requirements of the County Road and Bridge Department: a. The weight limit for CR 204 and CR 213 are 80,000 Ibs. for 5-axel and 45,000 lbs. for 3-axel vehicles. b. Dust control shall be required at all times on CR 213 either by applying Mag. Chloride or continuous watering of the road. Mag Chloride application will be applied by County provider and back charged to Occidental Oil & Gas Corp. 14) No more than 5 vehicles per day shall be allowed to access the facility. 15) The Applicant shall honor, to the extent possible, the recommendation by the Division of Wildlife that prohibits construction activity between December 1st, and April 15th.
