COUNTY OF GARFIELD ) At a regular meeting of the Board of County Commissioners for Garfield County, Colorado, held at the Courthouse in Glenwood Springs on Monday, the 22' day of June, A.D., 1998, there were present: Marian I. Smith Larry McCown John Martin , Comm'_ssioiier Chairperson , Commissioner , Commissioner Don K.DeFord , County Attorney Mildred Alsdorf , Clerk to the Board When the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 98- 43 A RESOLUTION CONCERNED WITH THE VACATION OF THE FINAL PLAT FOR THE SIERRA PINON SUBDIVISION WHEREAS, Barton F. Porter (Porter) entered into a Subdivision Improvements Agreement for Sierra Pinon Subdivision on May 13, 1996, recorded in the office of the Clerk and Recorder of Garfield County, Colorado as Reception No. 492862. WHEREAS, Porter agreed to complete certain public improvements within the subdivision by Septembe-,1, 199 and to have said improvements certified as being constructed in accordance with the requirements of the agreement by a professional engineer; and WHEREAS, Porter has not provided said certification nor are the improvements in compliance with the Subdivision Improvement Agreement. WHEREAS, the Subdivision Improvement Agreement reads, in part: "In the event the Owner/Subdivider fails to comply with the terms of this agreement, including the terms of the Preliminary Plan, the County shall have the ability to vacate the Final Plat as it pertains to lots which have not been conveyed for and at 1110 ,ininiinuy�iiniiiiniini_uiin 2 of 3 R 0.00 D 0.00 GARFIELD COUNTY CO market value to bona fide purchasers, which purchasers are not related to the Owner/Subdivider." NOW, THEREFORE, BE IT RESOLVED by the Commissioners of Garfield County, Colorado that parcels in the Sierra Pinon Subdivision which are identified as having not been conveyed to another by Porter in the records of the Garfield County Assessor's office (Final Plat Reception No. 492861, as amended at Reception No. 502866), are vacated from the Final Plat of the Sierra Pinon Subdivision and that Porter shall be responsible for providing the certification of a Colorado Registered Engineer that all improvements have been completed as per the Subdivision Improvement Agreement and all terms of the subdivision approval. BE IT FURTHER RESOLVED, that the Garfield County Building Department not issue any building permits for parcels in the Sierra Pinon Subdivision which are identified as having not been conveyed to another by Porter in the records of the Garfield County Assessor's office until all improvements required by the Subdivision Approval process have been completed and certified.
