ACKNOWLEDGMENT OF PARTIAL SATISFACTION
SUBDIVISION IMPROVEMENTS AGREEMENT
KNOW ALL MEN BY THESE PRESENT that:
WHEREAS, Michael N. Hammes and Lenore L. Hammes (hereinafter "Owner"), entered
into a Subdivision Improvements Agreement with the Board of County Commissioners of Garfield
County, Colorado (hereinafter "Board") dated July 12, 1999, recorded in Book 1154 at Page 1 as
Reception No. 553271 of the Garfield County records on October 5, 1999, for the improvements of
the West Rimledge Subdivision; and
WHEREAS, the obligations of the Owner have been partially satisfied in part, as verified in
a statement from Roger Neal, High Country Engineering, dated October 15, 1999, and the Owner
agrees that the Board shall retain and hold the sum of $23,690.00, which sum shall be security for
performance for work remaining to be completed consistent with various uncompleted
improvements described in the Subdivision Improvements Agreement.
NOW THEREFORE, at the request of the Owner and in consideration of the premises and
prior agreements, the Board hereby acknowledges the partial satisfaction of the Subdivision
Improvements Agreement entered into by the Owner and the Board for the West Rimledge , and
releases security m the amount of $82,259.50.

RE: West Riniledge Subdivision - Final Release of Collateral
HCE Project No. 97046.01
Gentlemen:
Please find enclosed a copy of the cost estimate itemizing the completed public improvements to
date for West Rimledge Subdivision.
Based on periodic observations of the construction in progress, the road and earthwork
improvements listed in the above referenced Pay Request for the Subdivision have been completed
in compliance with the Subdivision's Improvement Agreement, approved construction documents,
and Garfield County Regulations. This statement of completion shall in no way relieve any other
party from meeting requirements imposed by contract or other means, including commonly
accepted industry practices. On the owner's behalf, we are requesting the release of the collateral
being held by the county for the completed construction. The release amount to date totals
$82,259.50. The only items remaining to be completed are the telephone line and the
revegetation.
