If the proposed Insured has or acquires actual knowledge of any defect, lien, encumbrance, adverse claim or other matter affecting the estate or interest or mortgage thereon covered by this Commitment other than those shown in Schedule B hereof, and shall fail to disclose such knowledge to the Company in writing, the Company shall be relieved from liability for any Toss or damage resulting from any act of reliance hereon to the extent the Company is prejudiced by failure to so disclose such knowledge. If the proposed Insured shall disclose such knowledge to the Company, or if the Company otherwise acquires actual knowledge of any such defect, lien, encumbrance, adverse claim or other matter, the Company at its option may amend Schedule B of this Commitment accordingly, but such amendment shall not relieve the Company from liability previously incurred pursuant to paragraph 3 of these Conditions and Stipulations. 3. Liability of the Company under this Commitment shall be only to the named proposed Insured and such parties included under the definition of Insured in the form of policy or policies committed for and only for actual loss incurred in reliance hereon in undertaking in good faith (a) to comply with the requirements hereof, or (b) to eliminate exceptions shown in Schedule B, or (c) to acquire or create the estate or interest or mortgage thereon covered by this Commitment. In no event shall such liability exceed the amount stated in Schedule A for the policy or policies committed for and such liability is subject to the insuring provisions and the Conditions and Stipulations and the exclusions from coverage of the form of policy or policies committed for in favor of the proposed Insured which are hereby incorporated by reference and are made a part of this Commitment except as expressly modified herein. 4. PU+,NNER Re: Rifle Creek Estates, Filing #2 The planning staff is not in support of a request for division into two to three acre parcels within this area. This property is within a logical expansion area for the City of Rifle. Development of two acre parcels within this area will make future urbanization of this area very difficult for the following reasons: 1. Two acre parcels are very difficult to divide into city sized lots. When a person places a residence on a two acre or smaller parcel, the dwelling is usually placed within the center of thelot. Placement of a dwelling in such a manner usually makes development of city lots (7,000 to 15,000 square feet) impossible. 2. Landowners within such developments have very little, if any, incentive to annex to a city. As a result, the city can assume that these lands will not be available for expansion of the city at some future time. This would require the city to develop in other directions, which may not be as logical as this area. In an area situated such as this property, the preferred development would be large lots varying between five to ten acres or cluster development of a portion of the site to city densities. The staff recognizes that city annexations may not occur within this area for some time, but would caution the county on approving developments resulting in lot sizes varying from one-half to five acres in size within areas where logical city expansions could occur. If the county finds they can approve this request, the following observations can be made: 1. A secondary access should be provided to this area for fire protection purposes. 2. The existing access to Highway 325 does not provide a perpendicular movement for automobiles leaving the site.
