Box 3687 Grand Junction, CO 81502 Re: Rifle Creek Estates, Filing 2, Preliminary Plan Dear Andrew: On July 7, 1999, the Board of County Commissioners moved to conditionally approve the Rifle Creek Estates, Filing 2, Preliminary Plan. The conditions are as follows: In order to protect the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County: That all representations of the applicant, either within the application or stated at the meeting before the Board of County Commissioners, shall be considered conditions of approval; 2. In order to protect the health, safety, morals, convenience, order, prosperity and welfare the citizens of Garfield County: That approval of this preliminary plan renders all previously approved preliminary plans concerning this site null and void; 3. Pursuant to Section 4:33 of the Subdivision Regulations: That the 1978 Garfield County Zoning Resolution, as amended, the Garfield County Subdivision Regulations of 1984, the Garfield County Comprehensive Plan, the Garfield County road standards and policies, the Rifle Comprehensive Plan, and all other applicable local, state, and federal regulations, resolutions, plans, and policies be complied with. 4. In order to protect the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County: A note indicating the potential raw water contamination should be included on the final plat. 5. Pursuant to Section 5:31 (H): That the applicant shall submit $200.00 in School Site Acquisition Fees for each newly created parcel at the time of final plat; Tel: 945-R212/Fax: 945-7785 109 Rth St._ Ste_ 303 Glenwood Snrinuc_ CO R1601 6. Pursuant to Section 9:34: That the applicant shall dedicate all streets m the Subdivision to the County. Repair and maintenance shall be the responsibility of the Rifle Creek Homeowners' Association; 7. Pursuant to Section 4:34 of the Subdivision Regulations: This Preliminary plan approval shall be valid for one (1) year (until July 7, 2000). 8. Pursuant to Section 4:33 G: The recommendations of the Rifle Fire Protection District, dated 6/4/99, concerning defensible space, driveways, and posting of addresses shall be followed. A Plat note shall indicate that defensible space shall be maintained. The specifications made about driveways, address lettering, and defensible space shall be incorporated into the covenants. The applicant shall forward information regarding pressures and flow rates to the Fire District for review and approval. 9. In order to protect the health, safety, morals, convenience, order, prosperity and welfare the citizens of Garfield County: Site specific percolation tests and the other recommendations made by Atkins & Associates shall be followed. 10. In order to protect the health, safety, morals, convenience, order, prosperity and welfare the citizens of Garfield County: Detrimental construction practices, such as removal of vegetation, shall be prevented and the other recommendations made by Lincoln DeVore, in their report dated 5/21/81, shall be followed. A resolution to this effect will be written by this office, signed by the Board of County Commissioners, and recorded in the Clerk & Recorder's Office.
