This soil formed in alluvium derived from sandstone and shale. The surface layer is loam about 12 inches thick. The subsoil is sandy clay loam about 21 inches thick. The substratum is gravelly sandy clay loam or very gravelly sandy loam to a depth of 60 inches. Permeability is moderate, and available water capacity is moderate. Effective rooting depth is 60 inches or more. Runoff is medium, and the erosion hazard is moderate. POTTS LOAM, 6 TO 12 PERCENT SLOPES This deep, well -drained soil is on mesas, benches, and sides of valleys. This soil formed in alluvium derived from sandstone, shale, or basalt. The surface layer is loam about 4 inches thick. The subsoil is clay loam about 24 inches thick. The substratum is loam to a depth of 60 inches. Permeability is moderate, and available water capacity is high. Effective rooting depth is 60 inches or more. Runoff is medium, and the erosion hazard is high. 66 TORR1ORTHENTS-CAMBORTHIDS-ROCK OUTCROP COMPLEX, STEEP This broadly defined unit consists of exposed sandstone and shale bedrock, loose stones, and soils that are shallow to deep over sandstone and shale bedrock and stony basaltic alluvium. Torriorthents make up about 45 percent of the complex, Camborthids make up 20 percent, and Rock outcrop makes up 15 percent. The Torriorthents are on foothills and mountainsides below Rock outcrop. The moderately steep Camborthids are on lower toe slopes and concave open areas on foothills and mountainsides. Torriorthents are very shallow to moderately deep. They are well to somewhat excessively drained. They generally are clayey to loamy and contain variable amounts of pebbles, cobbles, and stones. Permeability is slow to moderate, and water holding capacity is very low to low. Effective rooting depth is 10 to 40 inches. Runoff is very rapid, and erosion hazard is very high. Camborthids are shallow to deep and are well -drained. The applicant is requesting to split three 35 or more acre parcels into 12 lots. The proposed source of water is one common well per three lots. A review of our records indicates that permits 178797, 176762 and 178798, copies attached, were issued for domestic use on parcels 17, 18 and 19, respectively. Each permit allows water from the well to be used for up to three single family dwellings, the irrigation of not more than one (1) acre of home gardens and lawns and the watering of domestic animals. The applicant proposes to divide Lots 17 and 19 into three (3) lots each while Lot 18 will be divided into six (6) lots. Pursuant to §30-28-136(1)(h)(I), C.R.S., the State Engineer's Office offers the following opinion for your consideration regarding material injury to decreed water rights and the adequacy of the proposed water supply: Pursuant to §37-92-602(3)(b)(III), the cumulative effect of all such wells in the subdivision shall be considered in determining materially injury for which the water supply plan has not been recommended for approval by the state engineer. In this case, the water supply for the division of land for Lot 18 has not been recommended for approval by this office. As such, the applicant must obtain a water augmentation plan approved by the Water Court in Glenwood Springs prior to the issuance of any well permits for said subdivision. This proposal will create 12 single-family Tots on approximately 129.35 acres, The proposed water supply for this development Is to be provided by a central water distribution system supplied by four on-site wells. A water allotment contract with the West Divide Water Conservancy District (District) was Included In the submittal materials, Based upon information in the submittal, the State Engineer's Office offers the following opinion pursuant to Section 30-28-136(1)(h)(I), C.R.S., for your consideration regarding material injury to decreed water rights and the adequacy of the proposed water supply: It appears this office previously commented on this development In a letter to Garfield County dated September 6, 1994 (copy enclosed), Our comments from that letter still apply with the following additions: 1. The well permits referenced (nos. 178797, 176762, and 178798) were issued pursuant to Section 37-92-602 (3)(b)(II)(A), C.R.S., as the only wells on parcels of 35 acres or more, The use of water from each of these wells is limited to fire protection, ordinary household purposes inside three single-family dwellings, the irrigation of not more than one acre of home lawns and gardens, the watering of domestic animals. The use of these wells cannot exceed the permitted amounts, and these wells cannot be connected into a central system that ties two or more wells together, Although not specified, it appears the fourth well may be permit no. 177789. No information concerning the proposed use of the water allotment contract with the District was provided. The water allotment contract references three wells that are to be connected into a central distribution system that will serve all 12 lots. If the applicant proposes to divert water pursuant to the allotment contract, new well permits must be obtained. Since the location of this development appears to be outside of the area approved in the District's substitute water supply plan, it is unlikely that well permits could be issued without a plan for augmentation approved by the Division 5 Water Court. 3. We are unable to comment on the adequacy of the water supply without an engineering or geotechnical study documenting the physical availability and dependability of ground water for the proposed uses at this site. As outlined in the statutes, Section 30-28-133, C.W.S., the subdivider is required to submit adequate evidence that a water supply that is sufficient in terms of quality, quantity, and dependability will be available to ensure an adequate supply of water. If the proposed wells are operated pursuant to the terms and conditions of the above referenced permits (issued pursuant to Section 37-92-602(3)(b)(II)(A), CRS.), there is a presumption of no material injury to decreed water rights. It is our opinion that if the wells are not operated pursuant to the above referenced well permits, or if the applicant proposes to operate three wells pursuant to the water allotment contract with the District, then material injury to decreed water rights may occur if diversions are made without a court approved plan for augmentation, The filing of a plan for augmentation and the subsequent judicial review and final decree should provide adequate terms and limitations to protect decreed water rights.
