HomeMy WebLinkAbout3.0 Resolution 77-107RES0LUTI0N$t77-107 WHEREAS, JAMES CUSEO, has petitioned the Board of County Commissioners of Garfield County, Colorado, for an exemption under C.R.S. (1973) Section 30- 28-101 (10) (a) - (d) as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted September 1, 1972 and amended April 14, 1975, Sections 1.02.17 (d) and 3.02.01, for the division of a 39.63 acre tract of land into two tracts of 20 and 19.63 acres, more or less, and said 39.63 acre tract is particularly described as follows: A parcel of land situated in the W1/2SE4 and the E%SW4 of Section 20, Township 7 South, Range 87 West of the Sixth Principal Meridian, County of Garfield, State of Colorado, said parcel of land is described as follows: Beginning at a point at a fence as constructed and in place whence the Southeast Corner of said Section 20 bears: S. 89° 42' 37" E. 2298.28 feet; thence N. 890 32' 41" W. 1704.22 feet along said fence; thence N. 000 33' 05" E. 23.76 feet; thence N. 300 52' 30" E. 295.04 feet; thence N. 520 49' 40" E. 296.18 feet; thence N. 220 03' 00" E. 161.00 feet; thence N. 430 58' 44" E. 153.18 feet; thence N. 040 02' 52" E. 83.11 feet; thence N. 030 48' 09" W. 90.77 feet; thence N. 090 07' 30" E. 123.63 feet; thence N. 200 44' 16" W. 61.38 feet; thence N. 210 20' 15" W. 74.08 feet; thence N. 030 14' 50" E. 144.14 feet, more or less to a point on the North line of said E 5 W4; thence N. 890 40' 47" E. 162.28 feet along the North line of said E 2Sti! 4; thence North 28.05 feet; thence S. 890 34' 39" E. 1008.53 feet along the Southerly fence line of a County Road as constructed and in place; thence South 1316.31 feet, to the point of beginning. The above described parcel of land contains 39.63 acres, more or less. WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that he desires said exemption for the purpose of re -sale into single-family residential acreage; and, WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board of County Commissioners that there is a reasonable probability of locating domestic water on each of said tracts, that there is adequate ingress and egress to said tracts, that the location of septic tanks will be permitted by the Colorado Department of Health, that the requested division is in accordance with the general purposes and intent of the Subdivision Regulations of the State of Colorado and the County of Garfield and should, therefore, be exempted from the definition of the terms "subdivision" and "subdivided land" as set forth in C.R.S. (1973) Section 30-28-101 (10) (a) - (d) as amended; NOW THEREFORE, upon motion of by JlaVeiv‘ prise_ seconded and carried, said 39.63 acre tract of land is hereby exempted from such definition and transfer of said tract may be made by division into two tracts of 20 and 19.63 acres, more or less, all as is more fully described above, and further, that said exemption is conditioned upon the Petitioner obtaining a proper legal description of said tracts prior to any conveyance thereof, and further, that no additional exemptions on these tracts of 20 and 19.63 acres be allowed. A copy of the instrument(s) of conveyance when recorded shall be filed with this Resolution. Dated this day of JoVah,v_ , 1977.
