BEFORE THE BOARD OF COUNTY COMMISSIONERS OF
GARFIELD COUNTY, COLORADO
PETITION FOR EXEMPTION
Pursuant to C.R.S. 30-28-101 (10) (d) (1973) and Section
1.02.17 d. of the Garfield County Subdivision Regulations,
the undersigned, James Noennig, Trustee, respectfully peti-
tions the Board of County Commissioners of Garfield County,
Colorado, to exempt by Resolution the subdivison of the
parcel of land, more fully herein described, from the require-
ments of the Garfield County Subdivision Regulations, and
for the reasons set forth herein.
1. Petitioner is the owner of a tract of land approxi-
mately 139.96 acres in area, located approximately one mile
southeast of Catherines Store in the Missouri Heights area
of Garfield County. Petitioner desires to divide the tract
into two (2) parcels of approximately 105 acres and 34.96
acres. (See surveyed plat map attached as Exhibit "A" hereto.)
2. The Petitioner believes the request is justified
for the following reasons:
a. The requested division is in accordance with the
general purposes and intent of the subdivision regula-
tions of the State of Colorado and the County of Garfield.
b. The minimum acreage required is 35 acres.
It would seem to be within the spirit of the subdivision
laws to round off an acreage amount to the nearest 1/10
or 1/100, which in this case would be 35.00.
