NOTICE OF DECISION
TAKE NOTICE that Public Service Company of Colorado with Xcel Energy has applied
to the Director of the Building and Planning Department, Garfield County, State of
Colorado, to request a supplemental amendment to the land use permits/approvals for
the Rifle Substation on a property situated in the County of Garfield, State of Colorado;
to -wit:
Legal Description: Township 6 South, Range 93 West, 6th P.M.
Section 14: SE% NEY4 SW1/4, NE% SE'/4 SW/4, SW' SE%4
Practical Description:
Description of Request:
(Generally described as being located on Lot 1 and 2 of
Section 14, Township 6 South, Range 93 West of the 6th
Principal Meridian, County of Garfield, State of Colorado)
Located just east of the City of Rifle, at 620 County Road
319, Rifle, CO 81650.
To allow the building footprint shown for the previously
approved amendment, which allowed modifications to the
site for the construction of a 3,000 sq.ft. storage structure, to
be shifted south approximately 20 ft. No other changes are
proposed.
The Director Decision pursuant to Section 4-107(A)(5)(a) of the Garfield County Unified
Land Use Resolution of 2008 (ULUR) as amended was issued on March 14, 2012 and
is that the Application was determined to be a non -substantial change and to
administratively approve the amendment request subject to the following conditions:
a. All prior approvals including but not limited: (i} Resolution No.80-243 and
conditions of approval for the Public Service Company of Colorado — Xcel Energy
Rifle Substation; and (ii) Public Service Company of Colorado — Xcel Energy
Amended Land Use Change Permit -- Special Use Approval dated 10/24/11,
shall remain in effect except as amended herein.
b. The storage structure shall be limited to a maximum of 3,000 sq.ft. and shall
comply with all zoning and building code requirements including grading and
drainage for the proposed improvements. The Building footprint shall be shifted
south approximately 20 ft. as shown on the revised site plans.
c. The building permit submittal shall contain storm water management plans and
best management practices prepared by a licensed professional engineer for the
relocated drainage swale adjacent to the building and any other related storm
water impacts.

Mr. Hartmann,
We are please to provide you with this summary letter and attached drawings in the submittal of
Amendment Application for the proposed Xcel Rifle Substation Operations. This projects intends to
update a movement of a building location of a proposed 3000 square foot storage building as a
"Non -substantial Change" as defined in the Garfield County Unified Land Use Resolution of 2008 in
Section 16-101 as it relates to our submitted application last August and September of 2011. Please
refer to the revised site plans attached with this application. We have also attached ASI##01 Change
Narrative document from Swanson Rink's office that further describes the changes to the site.
As indicated on the attached site plans, Xcel needs to shift the location of the proposed 3,000 SF
building due to a discovered utility easement during the site construction in January.

Project Narrative
Mr. Hartmann,
We are please to provide you with this summary letter and attached drawings in the submittal of
Amendment Application for the proposed Xcel Rifle Substation Operations. This projects intends to
provide an addition of a 3000 square foot storage building as a "Non -substantial Change" as defined
in the Garfield County Unified Land Use Resolution of 2008 in Section 16-101. Please refer to the
previous letter dated June 27, 2011 attached with this application.
A proposed new 3000 square foot storage building will be located approximately 159'-0" south of an
existing warehouse/garage building that is to remain. The proposed storage building is intended to
store equipment and company vehicles. Consequently, this building will not be inhabited by
employees as the existing warehouse/garage will continue to serve as the primary building of
operation and occupancy at this site. Currently, the design of this new storage building will comprise
of a simple pre-engineered building with meta! panel siding and will include four garage bay doors
that face north toward the parking lot and a side man 3'-0" wide service door for access. Refer to the
attached drawings for further details. There will be limited site improvements around this new storage
facility to accommodate necessary drainage and grading around the building and the redefined
asphalt parking lot. Currently, there are no to minimal landscaping shrubs at this facility. Because of
the type of use of this building and the operations of this utility substation, we are asking the County
of Garfield Planning to waive any landscape requirements that would normally be required for a
minor amendment application.

1430-0281 as required in the Garfield County Unified Land Use Resolution of 2008 in Article 4
Section 4-107A(6), the public notification of the Garfield County's decision has been given to the

Dear John:
Your application submitted on behalf of Public Service Company of Colorado and Xcel
Energy, for a Second Amendment to a Land Use Permit/Approval associated with the Rifle
Substation was deemed technically complete today, March 14, 2012. This determination
is in part made possible by the Director's waiver of some submittal requirements provided
with the original amendment request.
The Application requests a Non -Substantial Amendment to the recently approved
amendment (SUAA-6958) to allow the building footprint for the proposed 3,000 sq.ft.
storage building to be shifted to the south 20 ft. The property is located at 620 County
Road 319, Rifle, CO 81650. The site is also known by Assessor's Parcel No. 2177-144-
00-126. The Application information contained updated site plans and drainage plans as
appropriate for the shifted building footprint. The relocation is required based on the
discovery of a major underground electric line within the original building footprint. No
further information is requested to complete the Application.
Based on the Staff review and pursuant to Section 4-107(A)(5)(a), and Section 16-101,
Definition of Non -Substantial Change of the Garfield County Unified Land Use Resolution
of 2008, as amended (ULUR), the Director of the Garfield County Building and Planning
Department has determined that the Amendment request is considered to be a Non -
Substantial change and has approved the proposed amendment to the Land Use Change
Permit.
Based on this determination no referrals shall be required. This determination is subject to
the following conditions:
a. All prior approvals including but not limited: (i) Resolution No.80-243 and conditions
of approval for the Public Service Company of Colorado — Xcel Energy Rifle
Substation; and (ii) Public Service Company of Colorado — Xcel Energy Amended
Land Use Change Permit — Special Use Approval dated 10/24/11, shall remain in
effect except as amended herein.

b. The storage structure shall be limited to a maximum of 3,000 sq.ft. and shall comply
with all zoning and building code requirements including grading and drainage for
the proposed improvements. The Building footprint shall be shifted south
approximately 20 ft. as shown on the revised site plans.
c. The building permit submittal shall contain storm water management plans and best
management practices prepared by a licensed professional engineer for the
relocated drainage swale adjacent to the building and any other related storm water
impacts.
d. The amended site plan shall be attached as an exhibit to the Amended Land Use
Change Permit issued for the non -substantial Amendment request.
In accordance with Section 4-107(A)(6), this review letter — notice of decision, will be sent
to the Board of County Commissioners which have a 14 day review period in which to
decide whether to reconsider (call up) the Director's Decision.
You are also required to send a notice of decision to all adjacent property owners within
200 ft. of the subject property within 5 working days of this decision. A courtesy notice
form is attached for your convenience. The Applicant must verify all information provided
in the notice and correct any deficiencies such that proper notice in form and substance
can be established. The mailing must be completed no later than March 21, 2012. Please
present to the Building and Planning Department copies of certified return receipts from
your mailings once completed.
Please note that if no request for reconsideration is filed with the County within 14 days of
the date of the Director's decision, it shall become final.

Colorado, to request a supplemental amendment to the land use permits/approvals for
the Rifle Substation on a property situated in the County of Garfield, State of Colorado;

To allow the building footprint shown for the previously
approved amendment, which allowed modifications to the
site for the construction of a 3,000 sq.ft. storage structure, to
be shifted south approximately 20 ft. No other changes are •
proposed.
The Director Decision pursuant to Section 4-107(A)(5)(a) of the Garfield County Unified
Land Use Resolution of 2008 (ULUR) as amended was issued on March 14, 2012 and
is that the Application was determined to be a non -substantial change and to
administratively approve the amendment request subject to the following conditions:
a. All prior approvals including but not limited: (i) Resolution No.80-243 and
conditions of approval for the Public Service Company of Colorado — Xcel Energy
Rifle Substation; and (ii) Public Service Company of Colorado — Xcel Energy
Amended Land Use Change Permit — Special Use Approval dated 10124111,
shall remain in effect except as amended herein.

Attached is the Director's Decision Letter approving with conditions a supplemental request for a non -substantial
amendment to an existing Land Use Change Permit/Approval for Public Service Company and Xcel Energy for

Recently, the General Contractor discovered an existing electrical easement containing an electrical feeder main that will
require movement of our new proposed storage building approximately 20'-0" away from it's current location. This change
will also eliminate one of our civil storm drainage drop structures from the scope. Our project team needs instructions from
Garfield County of how you wish for us to process these changes on the permit plans/planning documentation as it relates
to your anticipated timeline review and items needed from us as a resubmitted package.
If possible, please let us know ASAP as we need to inform Xcel of the timeline of these changes.
