BACKGROT]I\ID AI\ID DESCRPTION OF THE PROPOSAL Final Plat of the "Up Cattle Creek Subdivision" was recorded on May, 1972. At the time of recording, the plat reflected home site locations as circles on each parcel. Typically, home site locations specific to the subdivision will be shown as building envelopes with specific dimensions. The circles were not legally described or given any measurable size. A rough estimation by staff shows the existing building circle to be approximately 65' in diameter. The applicant is proposing a diameter of approximately I I 5' . The proposed building circle would completely encompass the old circle with the increase in size affecting the south, west, and east portions. There was a residence on the property ttrat was destroyed by fire. The current owner purchased the property after the home was destroyed. It is the owner's intention to build a residence on the property in approximately the same location. Due to the small size of the former residence, geographic features, and septic concems the applicant is proposing to increase the building "circle". A letter dated October 10, 2005 from the Up Cattle Creek HOA has been submited with the application materials. This letter is in support ofthe applicants request stating that the HOA sees no issues with visual impacts or negative property values. The proposed increase in size will satisfr all Garfield County zoning and subdivision requirements specific to the ARRD Zone. Additionally, all setback requirements in relation to properly lines will be met. Amended Plat for Lot 11 Up Cattle Creek Subdivision 2. AUTHORITY $6:10 of the Subdivision regulations states that an amendment may be made to a recorded plat, if such amendment does not l) increase the number of suMivision lots or dwelling units, or 2) result in the major relocation of a road or add new roads. This request will not result in either of the two aforementioned standards and Stafffinds these standards are met. 3. STAf,'F RECOMMEITDATION The Applicant has provided all required documentation and has satisfied the applicable standaxds for a plat amendment. Therefore, Staffrecommends the Board of County Commissioners, pursuant to $6:10 of the Subdivision Regulations of 1984, as amended, approve this amended plat request with the following conditions: That all representations of the Applicant, either within the application or stated at the meeting before the Board, shall be considered conditions of approval. All plat notes from the original Final Plat ofthe Up Cattle Creek Subdivision shall be shown or referenced on this amended plat. Within 90 days ofapproval, the Amended Final Plat shall be reviewed (papercopy), then signed and dated (mylar copy) by the County Surveyor, then signed and dated by the Chairman of the Board and recorded in the Clerk and Recorder's Offrce of Garfield County. The Amended Final Plat shall meet ttre minimum CRS standards for land survey plats, as required by Colorado state law, and approved by the County Surveyor and shall include, at a minimum, the infornation outlined in Section 5:22 of the Garfield County SuMivision Regulations. 1. 3. Chairman Martin swore in the speakers. Amended Plat located at the end of Cactus Flats Road, Lot 1 I Up Cattle Creek Subdivision on 4.44 Acres zoned ARRD. Therefore, Staff recommends the Board of County Commissioners, pursuant to $6:10 of the Subdivision Regulations of 1984, as amended, approve this amended plat request with the following conditions: 1. Applicant - Richard covered everything. A motion was made by Commissioner McCown and seconded by Commissioner Houpt to approve the amended plat amendments with the 3 conditions in the staff report.
