Dear Ms. Patrick:
Flaving reviewed the proposed Silt Hoights Subdivision sketch plaq we note that the
irrigation ditch depicted on the sketch plan and which runs through Lots 1, 2 and 3 is
actually the Farmer's Irrigation Company canal.
The Farmer's Irrigation Company (FICo) canal systern is managed and operated by Silt
Water Conservancy District (SWCD). FICo has a long established right-of-way of 50
feet from the waters edge on both sides of the ditch for access and maintenance along its
canal system. Our By-Laws prohibit the erection of structures of any type within twenty-
fwe (25) feet of centerline of the canal on both sides, except for right angle crossings of
fences, roads or pipelines. We have specific guidelines and specifications for the
construction of these crossings. A permit for such crossings must be obtained from Silt
Water Conservancy District before any construction can take place.
We strongly advise that the ElCo canal depicted on the Preliminary Plan and Plat be
specifically marked as the FICo Canal with notes that no structures may be erected within
the 25 foot centerline easement.
Also, be advised that no water may be pumped or otherwise used from this ditch unless
the ground has historically been irrigated with either FlCo water or Silt Project water, and
the land owner must own either Silt Project or FlCo water.

Dear Mr. Barbee:
We have reviewed the above referenced proposal to subdivide a parcel of approximately 24.6 acres into
9 lots, ranging from2.2to 4.2 acres each, with one single family dwelling on each lot. The applicant proposes to
provide water through a central water system, utilizing the well with Permit No.46427-F pursuant to contract No.
95081sJS(a) with the West Divide Water Conservancy District (the District). A copy of the contract was not
provided. Sewage disposalwill be through individual septic systems.
Although well permits for the intended this use may be available if the well is included in the District's
temporary substitute supply plan, the existing well permit and contract do not allow the intended use, no new
well permit application has been submitted for review by this office, and there is no guarantee that a well
permit can be issued. Furthermore, to be considered a legally reliable source of water the well should be
included in a court approved augmentation plan, since there is no guarantee that a temporary substitute
supply plan will be renewed. No information was provided on the adequacy of the water supply.
Based on the above, it is our opinion, pursuant to Section 30-28-136(1XhXl), that the proposed water
supply will cause material injury to decreed water rights. Due to insufficient information we cannot comment
on the physical adequacy of the water supply. lf you or the applicant has any questions concerning this
matter, please contact Craig Lis of this office for assistance.

Letter of Review:
A tract of land of approxim ately 24.6 acres zoned A/RyRD in portions of Section 4 and 9,
Township 6 South, Range 92 West of 6th P.M., Garfield County, Colorado.
The site lies adjacent to Highway 6 on the South and CR 216 on the East. The
application proposes that this property be split into nine lots (9) ranging in size from 2.2
acres to 4.2 acres.
Material presented for review:

After examination of the presented material, I have the following comments:
1) Access: As access on Highway 6 has been the historical access for two existing
residences, I don't foresee any problem with having a single family residence on Lot
5 also use this access. lf Lots 4, 5 or 6 change from single family to multi-family or
commercialthen this access would have to come under close scrutiny. Access to CR
216 will need to be reviewed and approved by the Road Department, Planning
Department or my department prior to this new access being accepted into the
sketch plan. I would not anticipate this being a problem, but untilwe get someone out
to the site and look at surrounding uses and volumes, this is not an approved
access.

2) Water: I understand that the existing well is capable of pumping 15 gpm, however, I
do not see the well permit that tells me how much water this well is allowed to pump.
I need to be sure that this well is permitted to supply at least 9 lots 300 to 400 gallons
(100-125 gallons per person) per day. Also what size of storage tank is proposed
and how will the water be treated (specifically by what type of equiprnent and
processes) to assure potability? I noted that the current disinfeciion method is
"Clorox", this will not be an appropriate treatment method for the additiona! planned
residences. A reliable proven commercialsysiem wiii be Recessary as wiii be a
detailed monitoring plan to assure that someone is legally responsible to assure that
allwater provided is of potable quality.
3) Wastewater: I will need to have information on the distance and cost of tying into the
nearest regional/community centralized waste treatment facility. Only if this option is
proven cost prohibitive, will individual or community septic systems be considered.
As source well water is coming from the same area that could be potentially treating
waste, this concern will need to be addressed in detail. The preferred method of
waste treatment is centralized sewage treatment.
4) Drainage: I would like to see detailed drainage and irrigation plans. Typically gentle
slopes are not of significant concern. However, when irrigation is introduced
into/across an area of high shrink-swel! potentia! soils, a plan for where and how the
subdivision will be irrigated as well as where excess and runoff water will go is
necessary.
5) Roadway: see comment 1
6) Geology /Soils: see comment 4
7) Wildlife/Ecology: I would like to see the topic addressed in written form to assure that
examination has been made of wildlife habitats and migration routes, wetlands,
nesting areas, etc. I would anticipate that this ilt'cperlr would not be significantly
impacted, but need to have these issues fornnallyr addressed.
Summary:
This subdivision, as presented, is fairly simple and direct, Ho',vcvc:', Access, Water
Supply, Waste Treatment, Drainage, and Ecology have not been addressed with the
appropriate degree of depth necessary for approval.
Conclusion:
Based on the documentation presented, I recommend that this application be denied
until such a time when appropriate examination of concerns is presented
