which lease was recorded in Book 473 at Page 146 as Recep-

This is a recofltrnendati.on for referral of the Mitchell Creek P.U.D. to the Planning
Commission. The lulitchell- Creek P.U.D. is located along County Road I30 & 132
in West Glenwood along Mitchell Creek. The proposal is for 29 single family units
fronting on the creek.
ACCESS: off 132 Road and 130 Road.
WATER: from the West Glenwood Water District.
SEWER: combination of septic systems and the l,r7est Glenwood Sanitati-on District.
The proposal also includes a greenbelt along the Creek for public dedication
and a smal1 park site in the southwestern portion of the site.

SUM}IARY:
This is a public hearing with the m{neral right holders and for a final decision
on the final p1at. The Turkts are subdividing on 8.36 acre parcel into 2 lots
of 4 acres and 4.36 acres through the full review process because the original
parcel was created by exemption with the restriction that no further splits be
allowed by exemption.

The meeting was called to order at 7:04 P.M. by Arnold l"lackley.

FIRST ITEM ON THE AGENDA: I Trrrk Subdivlsion Final Plat. '')
Davis reviewed the request for two single fanr-ily lots of 4.36 acres and 4.00 acres
on 8.36 acre located approximately 1.25 rniles north of New Castle on County Road 245.
He said that a pump test had been completed, as well as a water quality test on the well;
easements had been located on the final plat; and a 40' right-of-way has been dedicated
along County Road 245; and a fee will be paid for the school assessment. In conclusion,
all conditions of the preliminary p1-at have been met. One item that will go into the
convenants will be that a reverse osmosis system will go into place to remove the selenium
from the \{ater to bring it into compliance with the State Health Department.
Davi-s asked Earl if it would be appropriate to have the chairman sign the final plat
without the County Surveyor's signature.
Earl said that he saw no problem wi-th that.
Davis stated that the staff reconunendation for the Turk Subdi-vision is for approval with
no conditions, those being met at prellminary plat.
Dale Albertson moved to recommend approval of the Turk Subdivision with no conditions.
Barbara Lorah seconded the motion.

SECOND ITEM ON THE AGENDA: Cottonwood Industrial Park P.U.D.-Sketch Plan.
Arnold appointed Dale Albertson chairman of the meeting for this item on the agenda,
due to a possible conflict of interest. He also indicated that he would not participate
in discussion or vote on the proposal.
Davis reviewed the P.U.D. stating that the main difference from when the Planning
Commission saw this plan before is that the expansion of the existing mobile home park
has been eliminated. The whole project is now a P.U.D. The new proposal is for 22
industrial/wholesale commercial lots on 33.18 acres located approximate]ry 2\ miles
easE of R;iftre on Highway 6 & 24. The waEer is to come from the exlsting water system
in Cottonwood Park and sewer will be served by the lagoon system in Cottonwood Park.
John Schenk, proponent of this P.U.D., stated his reasons for eliminating the mobile
home park expansion. After considering what the meetings with Davis and Lee produced,
he felt that the staff was saying that the property lras better suited for the uses already
out there, mainly industrial-type businesses and not residential. The uses Cottonwood
is proposing are mainly Lhe same as Eastview P.U.D. Cottonwood does have an agreement
with Eastview, though not a formal one at this time, that they will serve Eastview sel^Iage
from their lagoon system. IO7" of the Cottonwood P.U.D. is open space. The existing
ditch will be relocated through the open space.
John went on to say that a car dealership is desired as one of the uses on the front
part of the parcel. He sees that use becorning a transportation center with warehousing
of vehicles, a depot, storage, motor vehicle repair, etc, as well as vehicle sales.
Davis then reviewed this parcel and development in comparison to the comprehensive
plan. He read the concerns of the planning staff. There is a .36 acre tract of land
that cannot be considered in the P.U.D. because the title is in question. Davis asked
Earl if it was possible to avoid creating a separate parcel by leaving out the .36 acre
tract.
Earl felt it was out of the Commlssiont s hands since the proponents do not ovm the
.36 acre tract. No considerati-on can be given to it, nor could it be added to the P.U.D
later. The P.U.D. process would have to be initiated again for the small piece of property
in questi-on.
After the last of the concerns had been read by Davis, Schenk addressed theu. IIe
said that he had no problems wiEh any of the concerns of the staff, however, r,r-Ith
regard to the uses, corrnercial use is definitely being consi-dered by Cottonwood for an
auto sales, dealership, etc. A dealership, he felt, was an appropriate place for repair
of vehicles and everything associated w-ith it.
Davis said that if the Planning connnission elects to go with the corrmercial use' it would
open up the whole area to this type of use. Eastview had gone r,r-ith industrial uses, not
commercial.
Schenk felt that he had comprorrised by only putting a couunercial use on the front part
of this parcel. He believes that Rifle needs a major auto dealership.

plat for the Turk Subdivision along with the $58.00 filing fee.
We believe the following conditions placed on the Prelimi-nary
Plat approval have been met:
1. A pump test and water quality analysis has been
performed on the well for Lot 2. (See enclosed
copies)
2. Easements for power lines are on the final plat.
3. A forty foot ROW from Ehe centerline of County
Road 245 has been provided.
4. $200.00 will be given to the school district
prior to the issuance of the resolution on
the final p1at.
Please note that all the supplemental informati-on furnished wlth

A water sample from the well in Lox 2 of the Turk Subdivision has
been tested and was found to conEain selenium in concentrations
which exceed Lhe maximum contaminant leve1s for inorganic chemlcals
as presented in the Primary Drinking Water Regulations for the
State of Colorado. Failure to remo"re selenium could subject per-
sons drinking this water Eo a public health hazard. Thus the lot
purchaser will be required to provide evi-dence to the Garfield
County Building Department pri-or to the issuance of a certificate
of occupancy that treatment methods have been installed i-n the
residence which reduce concentrations of selenium i-n water which
will be consumed to levels below those presented in the Primary
Drinking Water Regulations (0.01 mC/1).
One treatment method which will remove selenium is reverse osmosis.
Several manufacturers of water conditioning equipment have avail-
able point of use type reverse osmosis units which can supply
sufficient quantities of treated water to meet drinking and cooking
demands for a single family residence. The approximate installed
cost of such a unit i-n December of 1981 is $
In addition, the analysi-s shows that the well water for Lot 2
contains sulfide, total dissolved solids, hardness, and iron in
concenErati-ons which exceed normally recommended limi-ts. The
above constituents at the concentrations found do not represent
public health hazards but do degrade the quality of water for
domestic purposes. Thus, prospective 1ot purchasers sha11 be
aware that additional treatment may be necessary depending upon
how high of quality of water they desire.
