HomeMy WebLinkAbout01.04 Forest ServiceDECISION NOTICE AND FINDING OF NO SIGNIFICANT IMPACT FOR TUCKER AND FRASE ROAD EASEMENT USDA Forest Service Rocky Mountain Region White River National Forest Rifle Ranger District Garfield County, colorado Decision and Reasons for the Decision It is my decision to issue a road easement to Tucker and Frase partnership. The easement will authorize reconstruction on portions of Forest Development Road 824 (Beaver Creek Road), as well as relocation of the road in other areas. An Operating Plan with construction stipulations and standards must be signed as a condition of the easement. In addition the Partnership must grant two reciprocal trail rights-of-way. Tucker and Frase Partnerships applied for authorization to access their property and haul privately owned timber across the Beaver Creek Road. Section 1323 of the Alaska National Interest Lands Conservation Act (ANILCA), of December 2, 1980 provides a qualified statutory right of access to owners of land which is surrounded by federal lands. The landowners are currently working with Garfield County to obtain a Special Use Permit for harvesting private land timber. Forest Service direction is to minimize environmental damage while allowing roads, which will over the long-term, be acceptable transportation facilities. The existing road has pitches which exceed Forest Service standards, is causing sediment to flow into Beaver Creek and would not allow the private landowners to use their private lands as proposed. Key issues considered in the analysis were a) slope stability hazard associated with development of portions of a new road,; b) landowners desire to access and manage their property; c) effects on range improvements; and d) effects on public access. Other additional issues were considered but not found to be within the scope of the National Forest System lands analysis or key issues. The White River National Forest Land and Resource Management Plan was consulted when analyzing the proposal. No direction was found that would require a different decision. Alternatives Considered The following alternatives were considered. 1) No Action. As previously mentioned, ANILCA provides that a landowner is entitled to reasonable access to their private inholding. The No Action alternative in this case would be to leave Forest Development Road 824 as it currently is and authorize access across the existing road. 2. Proposed Action. This alternative would authorize construction and reconstruction of the road facility according to design plans submitted by Tucker and Frase Partnership. They proposed using Forest Service design standards. 3. Geotechnical Alternative. This alternative would authorize construction and reconstruction of the road to Forest Service standards and construction specifications. During construction a geotechnical engineer would be on-site to make modifications as needed in design standards. The entire road would also be gravelled. Decision Notice FONSI/DN - 1 Public Involvement The Rifle Ranger District sent letters in September 1996 to eight individuals, groups or agencies for public scoping on this proposal. In addition, an article was published in the local newspaper requesting comments, issues, or concerns. One comment letter was received. An Opportunity to Comment notice was published in the Glenwood Post newspaper on June 11, 1997. That notice announced the availability of the draft EA for public review and comment. Copies of the Opportunity to Comment notice and EA were mailed to ten individuals, or groups. The 30 day comment period ended on July 11, 1997. One request for a copy of the draft EA was received. No comments were received. Decision Based upon the analysis and evaluation described in the environmental assessment it is my decision to implement Alternative three, identified as the geotechnical alternative. This alternative would allow construc- tion of certain new portions of the Beaver Creek Road and reconstruction of other portions. A geotechnical engineer will be on-site while all road construction takes place, observing road cuts and fills. Forest Service road construction standards and construction specifications will be followed. Reasons for the Decision The selection action allows the Tucker and Frase Partnership to access their private inholding and utilize the land as proposed. In addition, a geotechnical engineer on-site will be able to mitigate unforseen circumstanc- es, particularity ground water seepage. Finding of No Significant Impact Effects to National Forest System Lands from this road reconstruction and construction and use proposal can be acceptably mitigated. Construction and use of the road will not affect public health and safety. There are no unique characteristics of the geographical area which would set it apart from similar areas where there is experience with road construction and use. The proposed road is not in proximity to historic or cultural resources, prime farm lands, wetlands, wild and scenic rivers or ecologically critical areas. The proposal to construct and reconstruction this road is not highly controversial. The effects of the proposed road on the human environment are not highly uncertain, nor do they involve unique or unknown risks. Authorizing construction, reconstruction and use of the road is not precedent -setting. It does not establish a precedent for future actions which may have a significant effect on the environment. It does not represent a decision in principle about a future consideration. There will not be significant cumulative impacts based on analysis which considered past, existing, and reasonably forseeable activities. The proposed road will not adversely effect districts, sites, highways, structures, or objects listed in or eligible for listing in the National Register of Historic Places nor will it cause loss or destruction of significant scientific, cultural, or historical resources. The road will not adversely affect endangered or threatened species or their habitat. Allowing construction and reconstruction does not threaten a violation of Federal, State, or local law require- ments imposed for the protection of the environment. FONSI/DN - 2 Decision Notice Findings Required by Other Laws and Regulations The environmental analysis documented in the EA is tiered to the Final Environmental Impact Statement for the White River National Forest Land and Resource Management Plan. I have determined that this decision is consistent with the Forest Plan. The activities and projects approved in this decision are consistent with standards and guidelines in Forest Direction and Management Direction on pages III -5 and III -62. Alternative three complies with other laws and regulations such as the Clean Water Act, Endangered Species Act, and the National Historic Preservation Act. There will be no adverse effects on any threatened or endangered species or on cultural resources. Executive orders 11988 and 11990, dealing with floodplains and wetlands will be complied with. implementation Date Pursuant to 36 CFR 215.8 (a)(3), this decision is not subject to a higher level of review. Implementation of this decision may begin immediately. The parcel is wholly surrounded by public lands (BLM & USFS). Tucker & Frase wish to manage their property as multi -use and harvest approximately 11 MMBF of timber (primarily spruce and fir with a minor amount of aspen) off over mature stands. The present access across USFS lands, along Beavet Creek, is inadequate as a major hauling route. USE PLANS. Prior to May 1, each year this permit is in effect, permittee shall notify the in writing of the approximate time when such use will commence, the anticipated duration of such use, the names and addresses of permittee's contractors or agents who will use the road on behalf of permittee, the estimated extent of use, and such other information relative to permittee's anticipated use as the Forest Service may from time to time reasonably request. If and when during the year there is any significant change with respect to the information so supplied by the permittee, the permittee will notify the promptly in writing of such change. The permittee shall N/A , or at other Forest Service approved intervals when the permittee is hauling over this road, furnish the scale records, or other records satisfactory to the which give the volume of road use in terms related to rates in clause 1 under the authority of this permit. 5. COMPLIANCE WITH LAWS AND REGULATIONS. The permittee, in exercising the privileges granted by this permit, shall comply with the regulations of the Department of Agriculture and all Federal, State, county and municipal laws, ordinances or regulations which are applicable to the area or operations covered by this permit. 6. USE NONEXCLUSIVE. The privileges granted in this permit to use this road are not exclusive. The Forest Service may use this road and authorize others to use it at any and all times. The permittee shall use said road in such manner as will not unreasonably or unnecessarily interfere with the use thereof by other authorized persons, including Forest Service. 7. RULES GOVERNING USE. The permittee, its agents, employees. contractors or employees of contractors, shall comply with all reasonable rules prescribed by the Forest Service for control and safety in the use of this road and to avoid undue damage to the road. Such rules will include: (1) Upon reasonable notice, closing the road or restricting its use when, due to weather conditions, or the making of alterations or repairs, unrestricted use would in Forest Service judgement, cause extensive damage, or create hazardous conditions; (2) Upon reasonable notice, closing the road during periods when, in Forest Service judgement, there is extraordinary fire danger; (3) Traffic controls, which in Forest Service judgement, are required for safe and effective use of the road by authorized users thereof; (4) Prohibition upon the loading of logs on trucks which such trucks are standing on the roadway surface, except to recover lost logs; and (5) Prohibition on the operation on this road of any vehicles or equipment having cleats or other tracks which will injure the the surface thereof; 2 USDA Forest Service FS -7700-41 (10/73) (6) Prohibition on the operation of log -hauling vehicles(of a width in excess of legal highway loads in the State and with a gross weight of vehicles and load in excess of legal highway loads in the State. If purchaser acquires a special permit from the State and adds a sixth tag axle to a five axle truck, the following restrictions will apply: The weight limit can be increased to 88,000 lbs. provided that the length is extended to a minimum of 57 feet. This length is measured from the center of the front axle to the center of the last axle. The maximum length of any vehicle using Forest Development roads is 75 feet in total length including cargo, unless a Forest Service permit authorizes additional length. (7) Regulation of the number of vehicles so as to prevent undue congestion of this road. (8) The Permittee shall not use an "active ingredient" as defined in Section 2 of the Federal Insecticide, Fungicide, and Rodenticide Act, as amended (86 Stat. 973), in violation of said act on the land described in this permit. (9) Other - Specify (Optional) 8. INSURANCE. Permittee or his contractors and assigns shall be required to carry public liability and property damage insurance for the operation of vehicles, in the amounts established by applicable State laws, cooperative agreements, or easements issued on the subject road or roads. In any event, the permittee must carry liability insurance and property damage insurance of not less than $100,000 for injury or death to one person, $300,000 for injury or death to two or more persons, and $100,000 for damage to property. The permittee itself shall be responsible for furnishing to the proof of satisfactory insurance when said insurance is to be furnished by other than the permittee. Proof of satisfactory insurance may be required by the District Ranger prior to hauling over the road(s) and will be for the duration of the permit and such insurance policy shall bear an endorsement requiring the issuing company to give 10 days prior written notice to the District Ranger , of cancellation or material change. 9. MAINTENANCE. The permittee shall bear the expense of maintenance proportionate to his use. This expense will be borne by Norman A. MAINTENANCE AND RESURFACING REQUIREMENTS AND SPECIFICATIONS. In the event the permittee is to perform his proportionate share of road maintenance, road resurfacing, or betterment, as determined and within time periods established by the Forest Supervisor, the Forest Service may require as a further guarantee of the faithful performance of such work that the permittee furnish and maintain a surety bond satisfactory to the Forest Service in the sum of dollars ($ ), or in lieu of a surety bond, deposit into a Federal depository, as directed by the Forest Service, and maintain therein cash in the sum of dollars ($ ), or negotiable securities of the United States having market value at time of deposit of not less than ($ ). As soon as security for the performance of road maintenance (and betterment) requirements or the settlement of claims incident thereto is completed, unencumbered cash guarantees or negotiable securities deposited in lieu of surety bond will be returned to the permittee. The bond currently on file shall be adquate at this time: At such time the bond for reconstruction of the road is cancelled a bond or approved letter of irrevocable credit may be used. Such letters of irrevocable credit shall be subject to Forest Service approval. 3 USDA Forest Service FS -7700-41 (10/73) 11. FIRE PREVENTION AND SUPPRESSION. The permittee shall take all reasonable precautions to prevent and suppress Forest fires. No material shall be disposed of by burning in open fires during the closed season established by law or regulation without a written permit from the Forest Service. 12. DAMAGES. The permittee shall exercise diligence in protecting from damage the land and property of the United States covered by and used in connection with this permit, and promptly upon demand shall pay the United States for any damage resulting from negligence, or from violation of the terms of this permit or of any law or regulation applicable to the National Forests, by the permittee, or by his agents, contractors, or employees of the permittee acting within the scope of their agency, contract, or employment. 13. OFFICIALS NOT TO BENEFIT. No member of or Delegate to Congress or Resident Commissioner shall be admitted to any share or part of this agreement or to any benefit that may arise herefrom unless it is made with a corporation for its general benefit. 14. OUTSTANDING RIGHTS. This permit is subject to all outstanding rights. 15. SUSPENSION. Upon the failure of the permittee, its agents, employees or contractors to comply with any of the requirements of this permit, the officer issuing the permit may suspend operations in pursuance of this permit. 16. TERMINATION. This permit shall terminate on February 28, 2002 unless extended in writing by the Forest Service. It may be terminated upon breach of any conditions herein. 17. In the event of any conflict between any of the preceding printed clauses or any provision thereof and any of the following clauses or any provisions thereof, the following clauses will control. 18. SAFETY. Unless otherwise agreed in writing, when Permittee's Operations are in progress adjacent to or on Forest Service controlled roads and trails open to public travel, Permittee shall provide the use with adequate warning of hazardous or potentially hazardous conditions associated with Permittee's Operation. A specific traffic control plan for each individual project shall be agreed to by Permittee and Forest Service prior to commencing operations. Devices shall be appropriate to current conditions and shall be covered or removed when not needed. Except as otherwise agreed, flagger and devices shall be specified in the "Manual on Uniform Traffic Control Devices for Streets and Highways" (MUTCD), and in specifications attached hereto. 19. Drivers of all vehicles hauling logs shall have a copy of page 1 of this agreement in their possession. This agreement will be presented, an request. to any Forest Officer. 20. SNOW REMOVAL. Snow removal shail be done in a manner to preserve and protect the roads, to the extent necessary to insure safe and efficient transportation of materials, and to prevent excessive erosion damage to roads. streams, and adjacent lands. REQUIREMENTS Snow Removal work by permittee shall include: 20.1 Removal of snow from entire road surface width including turnouts. 20.2 Removal of snow slides. earth slides. fallen timber, and boulders that obstruct normal road surface width. 20.3 Removal of snow, ice, and debris from culverts so that the drainage system will function efficiently. at all times. 20.4 All items of snow removal shail be done currently as necessary to insure safe. efficient transportation. Work shall be done in accordance with the foilowing minimum standards of performance: 20.5 Removal of material. Surface rock replacement shall occur on a yearly basis and the material shall be well -graded 3" minus crushed aggregate meeting public road authority specifications placed in locations mutually agreed upon. 8 USDA Forest Service T-806 DUST ABATEMENT FS -7700-41 (10/73) DESCRIPTION 1.1 This work shall consist of preparing Traveled Way and furnishing and applying Materials to abate dust. MATERIALS 2.1 The roads requiring dust abatement, type of dust abatement Material to be used, the rates of application, and frequency of applications will be shown on Dust Abatement Plan. The Dust Abatement Plan may be changed by written Agreement. 2.2 Water. The locations of Water Sources are shown on Sale Area Map. 2_3 Dust abatement Materials shall meet the requirements of the following subsections of Forest Service Specifications for Construction of Roads and Bridges or attached Special Project Specifications. Emulsified Asphalt 702 Blotter Material 703.12 Magnesium or Calcium Chloride Brine 723.01 Calcium Chloride Flake 723.02 Lignin Sulfonate 723.03 2.4 Testing of Materials. Certification and sampling of bituminous Materials lignin sulfonate, and magnesium chloride shall be in accordance with subsections 105.04 or 723.04 of Forest Service Specifications for Construction of Roads and Bridges. REQUIREMENTS 3.1 General. Dust abatement Materials shall be applied to the road surface as necessary to control road surface loss, provide for road user safety, and minimize damage to adjacent resources. 3.2 Compaction. When the methods listed below specify compaction, Traveled Way shall be compacted by an 8 to 10 ton pneumatic, steel -wheeled or equivalent vibrating roller making 2 passes over the full Traveled Way and Shoulder width, unless compaction is not required on the Dust Abatement Plan . 3.3 Preparation to Dust Abatement Materials Other Than Water. The following applies to all methods of preparation: Bituminous residue shall be scarified and pulverized to produce loosened Material not exceeding 4 inches in greatest dimension. Traveled Way shall be bladed in accordance with T-811. Prior to applying DO-6BA, DO-6PA, or DO -8, the top 2 inches of Traveled Way shall contain not less than 80 percent nor more than 120 percent of optimum moisture as determined by AASHTO T-99. Method C. Prior to applying other bituminous Material, Traveled Way shall have a moisture content between 1 and 3 percent. If surface dusting prevents the bituminous Material from penetrating, a light application of water shall be applied just prior to applying the bituminous Material. Lignin Sulfonate and magnesium chloride shall be applied when the top 1 inch of Traveled Way contains not less than 3 percent moisture, nor more than 120 percent of optimum moisture as determined by AASHTO T-99, Method C. Moisture content will be determined in accordance with AASHTO T-217 OR T-239. One or more of the following methods shall be used, as specified in the Dust Abatement Plan . Method 1. Compact Traveled Way and apply the dust abatement Material. Method 2. Develop a layer of loose Material approximately 1 inch in depth for the full width of Traveled Way. Apply the 9 USDA Forest Service FS -7700-41 (10/73) dust abatement Material to this loose Material and compact after penetration. If traffic makes maintenance of the loose Material difficult, 1 inch of the Material may be bladed into a windrow along the Shoulder. The specified moisture content shall be maintained in the windrow and the top 1 inch of Traveled Way. The windrow shall be bladed to a uniform Material. When the dust abatement Material has penetrated, Traveled Way shall be compacted. Method 3. Blade 1 inch of Material from Traveled Way into a windrow along the Shoulder. Maintain the specified moisture content in the windrow and the top inch of Traveled Way. Apply half the dust abatement Material. When the dust abatement Material has penetrated, the windrow shall be bladed to a uniform depth across dust abatement Traveled Way, and the remaining dust abatement Material shall be applied. Traveled Way shall be compacted. Method 4. Develop a layer of loose Material approximate. 2 inches in depth for the full width of Traveled Way. Apply half the dust abatement Material to the loose Material. Blade le top 2 inches into a windrow along the Shoulder. Apply the remaining dust abatement Material to Traveled Way and e Berm. Spread the Berm evenly across Traveled Way and compact. 3.4- Preparation for DustAbatementwith Water. Travelec Way shall be prepared in accordance with Specification T-811 Surface Blading when required. 3.5 Application Tolerance. Dust abatement Materials off- :r than water shall be applied within 0.05 gallons per square yard of the rate specified. 3.6 Mixing Requirements. DO-6BA, DO-6PA, and DO -8 hall be thoroughly circulated in the distributor within 1 hour of application. 3.7 Weather Limitations. Dust abatement Materials shai of be applied when it is raining. Bituminous Material shall be applied when the surface ter )erature of Traveled Way is 50 degrees Fahrenheit or higher. Lignin sulfonate and magnesium chloride shall be applied hen the atmospheric temperature is 40 degrees Fahrenheit or higher. 3.8 Blotter Material. Blotter Material shall be spread in a fficient quantity to prevent tire pickup. DESCRIPTION This work consists of surface blading native or aggregate roadbeds including shaping the crown or slope of traveled way, berms, and drainage dips. 2. MAINTENANCE a. Timing Surface blading shall be performed during the contract period as often as needed to provide conditions stated for the maintenance level of the road. b. General (1) The existing traveled way and shoulders, including turnouts, shall be bladed and shaped to produce a surface which is uniform, consistent to grade, and crowned or cross -sloped as indicated by the character of the existing surface unless otherwise shown in the Road Listing, to at least one-half (1/2") inch per foot of width, unless otherwise agreed. Surfacing materials shall be thoroughly loosened to the depth of potholes or corrugations. (2) Purchaser shall apply water in accordance with Section T-891 during blading when sufficient moisture is not present to prevent segregation. (3) Existing native rock or aggregate surfaced drainage dips shall be shaped to divert surface runoff to existing outlet. (4) Purchaser shall retain the surfacing on the roadbed and provide a thorough mixing of materials within the completed surface width. (5) Roadway backslope shall not be undercut. c. Compaction When roads require compaction this requirement will be included in the Road Listing. Compaction shall be performed in accordance with Special Project Specifications. d. Intersections At intersections, the roadbeds of side roads which are not closed or restricted from vehicular use shall be bladed to assure a smooth transition. Field evidence of closure or restrictions shall be considered to be signing, cross ditching in the road surface (traveled way), earth berms, or other devices placed to discourage or eliminate use by passenger cars. e. Cleaning of Structures Materials resulting from work under this Section shall not be allowed to remain on or in structures, such as bridges, culverts, cattle guards, or drainage dips, or other waterways. f. Berms Existing drainage berms shall be maintained to the condition of adjacent segments. New berms (windrows) shall not be created. 11 USDA Forest Service FS -7700-41 (10/73) T-831 - DITCH MAINTENANCE 1. DESCRIPTION This Section provides for routine maintenance of various types of drainage ditches to provide an unobstructed waterway. 2. MAINTENANCE REQUIREMENTS a. Ditches shall be maintained by removing rock, soil, wood, and other materials. Maintained ditches shall function to meet the intent of the original design. b. Backslopes shall not be undercut by removal operations. c. Suitable-material_removed from the drainage ditch may be blended into existing native road surface and shoulder or placed in designated berm. d. Material from ditch cleaning operations shall not contaminate aggregate surfaced roads. e. Slide and slough materials to be removed shall be those that can be removed by routine road maintenance equipment operating from the road surface. The slopes shall be reshaped as practical. Excess materials temporarily stored on the ditch slope or edge of the shoulder shall be removed daily, or as agreed otherwise. f. Furrow ditches shall be reshaped and blockages removed, except that blockages previously placed to divert water from the ditch into culverts or other drainage structures shall remain. Limbs and wood chunks in excess of one (1) foot in length and three (3) inches in diameter shall be removed from ditches and placed outside the roadway. Concentrations of any size material which may block ditches or culverts shall be removed also. g. h. Lead-off ditches shall be shaped to drain away from the traveled way. 12 USDA, Forest Service T-832 - REMOVE AND END HAUL MATERIALS FS -7700-41 (10/73) 1. DESCRIPTION Work consists of loading, hauling, and placing of slide, slough, or excess materials such as rock, soil, vegetation, and other materials in designated disposal sites. 2. MAINTENANCE REQUIREMENTS a. Excess materials generated by work under other Sections of this contract may be required to be removed, hauled, and disposed of under this Section. Material shall be disposed of at designated sites as identified by the authorized Forest Officer. b. When approved by Forest Service slumps or washouts shall be filled by compacting selected materials into roadway depressions. Compaction shall be by Method (2). c. All materials removed and placed in disposal sites shall be placed:. (1) Surfaces on which materials are to be placed shall be stepped or roughened prior to placing any material. Materials shall be placed in approximately horizontal layers no more than twelve (12) inches thick. Each layer shall be compacted by operating hauling and spreading equipment over the full width of each layer. d. Any damage to existing aggregate and pavement surfaces shall be repaired. 13 USDA Forest Service FS -7700-41 (10/73) T-834 DRAINAGE STRUCTURE MAINTENANCE 1. DESCRIPTION This work consists of cleaning and reconditioning culverts and other drainage structures. 2. MAINTENANCE REQUIREMENTS a. Drainage structures, inlet structures, culverts, catch basins, and outlet channels shall be cleaned and reconditioned. Catch basins shall be cleaned by removing the material within the area shown on Drawing 834-1. b. The transition from the ditchline to the catch basin shall be cleaned a distance of ten (10) feet from the culvert inlet. Outlet channels and lead-off ditches shall be cleaned a distance of ten (10) feet. Debris and vegetation shall be removed and placed so as to not enter the channel or ditch or obstruct traffic. Haul to designated disposal area. c. Hydraulic flushing of drainage structures is not allowed unless the runoff will not reach a live stream. d. Cleaning and reconditioning is limited to the first four (4) feet inside of inlet and outlet. Reconditioning of culvert inlet or outlet shall be by field methods such as jacking out or cutting away damaged metal which obstructs flow. Cut edges shall be treated with a zinc -rich coating. 14 USDA Forest Service FS -7700-41 (10/73) T-842 CUTTING ROADWAY VEGETATION 1. DESCRIPTION This work consists of cutting all vegetative growth, including trees and other vegetation, less than four (4) inches in diameter when measured six (6) inches above the ground, on roadway surfaces and roadsides. 2. MAINTENANCE REQUIREMENTS a. General (1) Brush, trees, and other vegetation shall be cut to a maximum height of six (6) inches above the ground surface or obstruction such as rocks or existing stumps. All limbs which extend into the treated area or over the roadbed to a height of fourteen (14) feet above the traveled way surface elevation shall be removed. (2) Signs, markers, and other road appurtenances are to be retained. Other items to remain will be marked on the ground. (3) Work under this Section, on the upper segment across National Forest System lands, will not be required to more than twelve (12) feet slope distance along backslope and fill slope. Work under this Section, on the lower segment across private lands (Honea property) will not be permitted more than 15 feet either side of existing centerline. (4) Work may be performed either by hand or mechanically unless specifically shown in the Road Listing. Self-propelled equipment shall not be operated on cut and fill slopes or in ditches. (5) Standing trees which are damaged seriously enough so they will die shall be removed if marked for cutting by Forest Service. (6) Mechanical brushcutters shall not be operated when there are personnel or occupied vehicles within four hundred (400) feet of immediate operating area. b. Cutting Side Vegetation (1) The width of vegetation to be removed shall be shown in the Road Listing. (2) Unless otherwise included in Special Project Specifications or marked on the ground: (a) Work shall commence at the edge of the traveled way and proceed away from the road centerline. (b) The starting point for cutting will be marked in the field or defined in Special Project Specifications for roads without a defined traveled way. c. Limbs (1) Trees in excess of four (4) inches diameter, when measured six (6) inches above the ground and standing within the treated area, shall be completely limbed to an elevation of fourteen (14) feet above the road surface. (2) Limbs originating less than five (5) feet outside but extending into the treated area within 14 feet in elevation of the road surface shall be cut to within twelve (12) inches of the trunk and produce a reasonably smooth face. d. Debris (1) Materials resulting from the cutting operation in excess of one (1) foot in length and three (3) inches in diameter or concentration which may plug ditches or culverts, shall not be allowed to remain on backslopes within the treated area, in ditches, or within watercourses. (2) Limbs and chunks in excess of three (3) inches in diameter shall be removed from the traveled way and shoulders. (3) Materials may be scattered downslope from the roadbed outside of the work area, excluding areas within high-water marks of streams. 15 USDA Forest Service FS -7700-41 (10/73) T-851 LOGGING OUT 1. DESCRIPTION This work consists of removal of fallen trees and snags which encroach into the roadway. 2. MAINTENANCE REQUIREMENTS a. Timber which meets Utilization Standards shall be limbed and rernoved or decked at agreed locations. b. Other materials shall be limbed and may be cut into lengths for handling and shall be decked outside ditches and drainages, off the traveled way and turnouts or at staked locations.
