Exhibit A contains maps with harvest areas and road locations with letters of approval for 1999 thru 2003. 2. Individual stand prescriptions and marking guidelines were developed by Intermountain Resources and approved by Woodland Management Consultants. They are based on the silvicultural practices noted in the Tepee Park Forest Management Plan and adhere to Best Management Practices for Colorado. Extensive training and supervision of the logging crew has insured that the residual stand and all other resources are protected and enhanced. The Division of Wildlife has not inspected the harvest area. Per the minutes of the August 5, 2002 Board of County Commissioners meeting, Brett Ackerman gave the following testimony; "It is more appropriate for the forest service to mark trees, and if the DOW is included in the SUP they should be removed." Mr. Mark Bean October 25, 2002 Page 2 3. To date 460 acres have been harvested with a volume of 4 million board feet. Proposed changes were submitted to your office on September 18,2002 by Jim Beckwith. 4. Concerning aspen, Resolution 97-70,#13 states,"There will be no harvesting of aspen trees from the site, with the exception of incidental cutting of trees, approved by the inspector agreed to by the City of Rifle and the County." To date only incidental aspen trees have been harvested. 5. As of this date all road -cut and fill slopes and abandoned landings have been grass seeded. A sample tag is shown in Exhibit B. Special consultant, Mr, William Gherardi, continues to participate weekly on this process. This is earliest date we anticipate to have cutting areas defined and available for initial timber harvesting. This time period is when we plan to conduct our major harvesting activities for this year and into next. During this period, timber harvesting will be performed by one principle logging contractor. Frozen ground conditions and a low volume of public traffic will permit ideal "low impact" harvesting operations. All harvesting activities are planned to minimize effects ori water quality. This should result in balancing harvest management operations throughout the four rns j or drainages - i.e. Beaver, Porcupine, West Manun and Tepee Creeks. We received a map from Chris Meyers, Intermountain Resources, showing the proposed 1999/2000 road construction and logging areas. Most of the proposed activity is within the Beaver Creek watershed on private land but, some road construction within the watershed is on public lands. A portion of the roads and Togging areas are outside the watershed. Upgrading Garfield County Roads 320 and 317 is also included in the proposed work. Approximately 7.5 miles of roads will be constructed or upgraded within the watershed and 90 to 100 acres of area will be logged. ',', August 11, 199 Aid G 1 8 1999 George Foley, acting District Ranger, U.S. Forest Services, said that the plans for the proposed road on public lands have been submitted and reviewed but no permit has been issued to date. According to County Planner, Mark Bean, the plans for County Road 320 and 317 have been submitted and are under review. No approvals have been given by Garfield County at this time. The water quality base line data has been collected except for one last reading which is scheduled for the week of August 16, 1999. Upon final approval by Garfield County and permit issuance by 1:he U.S. Forest Service, we would recommend that the City approve the 1999/2000 plan by Intermountain Resources. Our road construction contractor is Masterson Construction. Mr. Masterson has been constructing roads for Intermountain Resources for three years and has extensive knowledge on Colorado's Best Management Practices (BMP's) regarding road construction, as well as a broad background constructing roads on national forest lands. Roads will be flagged -in prior to beginning construction. A11 construction will follow the requirements of the '[epee Park Forest Management Plan (the plan) and conditions of the Fifer Letters dated March 3, 1997 and April 22, 1997. Additionally, we adhere to recommended practices in BMP's for Colorado forests. Construction will be .a combination of a dozer and excavator. All necessary support vehicles will be on -sine, as well. Revegetation techniques will follow the guidelines of the BMP's and the plan. Required seed will be broadcast spread at the recommended rate; mulcing will be applied per guidelines also. UPCOMING LOGGING ACTIVITY Our intent is to have. jointactivities in the Beaver Creek, Porcupine Creek and West Mamm Creek drainages. Our initial and major harvest and log removals will occur in the Porcupine Creek and West Mamm Creek drainages this operating season. Harvest activities will commence about August 15th. We plan to deck the majority of the logs harvested and haul them when the ground is frozen. This will help mitigate damage to and erosion from roads. We will employ a variety of silvicultural practices in our harvest. This will favor diversity in the stand structure and will support diverse wildlife species. The practices will include areas of group selection, shelterwood removal and individual tree selection. A commercial thinning is an option on a portion of Tepee Creek. Aspen stands will be harvested by coppice cuts. We will have a minimum of one logging contractor operating the area. The logging methods consist of feller -benchers and associated equipment and the possibility of a hand falling side. When log removals begin in earnest, we expect to move 10 +/_ loads per day. At this time, we do not foresee hauling logs after January, 2002. The minimum inventory for "emergency erosion control" is contained the the BMp's in the plan. We will typically use water bars on skid trails requiring erosion control measures. We may supplement this with a layer of slash on portion of the area. Spacing of water bars is dependent on the slope of the skid trail. SUMMARY OF PERVIOUS YEARS' REVEGETA,TION EFFORTS There was no logging activity last year. However, we did perform some additional grass seeding on a couple of areas where prior seeding did not take on national forest lands from road construction in 1999. We will have a minirrul.m of one logging contractor operating on the ranch. The logging methods consist of feller-bunchers and associated equipment and the possibility of a hand failing side. When log removals begin in earnest, we expect to remove 10 +/- loads per day. Mr. Bill Sappington, Public Works Director City of Rifle PO Box 1908 Rifle CO 81650 RE: Intermountain Resources - Watershed permit No. 1-97 Dear Bill: August 29, 2001 In response to the concerns of some Beaver Creek residents expressed to City personnel regarding turbidity of Beaver Creek, I made a site visit on August 28, 2001. The site visit was made with Chris Meyers of Intermountain Resources and Bill Gherardi, Consulting Forester. Following in a brief summary of observation made of the date of the site visit: • The roads constructed during the previous two years are in excellent condition. The drainage structure (ditches, culverts, catch basins, etc.) are functioning very well. Revegetation is well established and the road surface is good. I saw no erosion anywhere on the existing road. • A new road on private land was constructed in early July primarily to provide access to the forest fire at the head of Porcupine Creek. Although most of the road is in the Porcupine. Creek Basin, it originates on Beaver Creek just below Teepee Park and traverses along the west side of the drainage. This road will become the access for logging and will be brought up to Forest Service Road standards in the next 6 weeks. Culverts are on-site. • Some erosion has occurred along the new road but there is no evidence of any impact on Beaver Creek water quality because the road is far from the creek and separated by vegetated areas. • A large trench has been dug along the property line at the gate separating private land from public land. The purpose of the trench is to prevent vehicular trespassing which was occurring. The trench does not have an outlet, therefore no erosion has occurred and no impact to Beaver Creek is evident. None -the -less the trench and the embankment of excavated material are relatively close to Beaver Creek and the permit holder has agreed to "dress -up" the trench, refill most of it and revegetate the area. This will be done in the next few weeks. • No logging has taken place to date except for minor amounts associated with the roadwork. Most of the 2001/2002 winter logging will occur in Porcupine Creek Basin although a small amount in the West 1/2 of Section 31 in the Beaver Consulting Engineers and Hydrologists 909 Colorado Avenue ■ Glenwood Springs, CO 81 601 • (970) 945-6777 ■ Fax (970) 945-1137 Mr. Bill Sappington Page 2 August 29, 2001 Creek Basin is planned for this winter. Access to the site will be across Beaver Creek via an existing road crossing with culvert. The culvert is marginally acceptable and is scheduled to be replaced next summer. In summary we found no evidence of any activity which has impacted Beaver Creek. Certain recent activity in the process of being completed to acceptable standards. Leavenworth & Karp PC PO Drawer 2030 Glenwood Springs CO 81602 RE: City of Rifle - Beaver Creek Watershed Permit 1-97 Intermountain Resources Dear Jim: 3s3 June 25, 2002 On June 19, 2002 Resource Engineering, Inc. conducted the annual inspection of the Tepee Park logging activity in Beaver Creek. We also reviewed the proposed 2002/2003 activities. We made the field trip with Mr. Chris Meyers of Intermountain Resources, LLC. Most of the proposed 2002/2003 logging will take place outside of the watershed boundary governed by the permit. The activities within the permit area includes limited logging in the "blow -down" area of Section 31. This activity consists of removing trees which have been blown down by recent wind storms. All of the activity is outside the riparian zone as is required by the permit. Road construction activities are as proposed and approved in the permit. Applicant has committed to meeting the requirements of the Water Quality Plan. Our inspection of current and previous activities indicates that Intermountain Resources has complied with the conditions of the permit. Roads are in good condition with no significant erosion. Revegetation is taking hold as expected. We specifically looked for any signs vehicle maintenance activity in the riparian zone and found none. We saw no evidence of dumping of oil or hazardous materials, however, we cautioned Mr. Meyers about such activity and asked that he remind his personnel to avoid any disposal of hazardous materials on-site. Mr. Meyers stated that they have regular meetings with employees and subcontractors to reinforce safety issues and water quality concerns so that the importance of these matters is passed on to all employees working in the watershed. We believe that this is important to achieve the goal of protecting water quality. It should be noted that RESOURCE obtained water samples at the three Beaver Creek stations on June 19, 2002. The samples were sent to ACZ laboratories for analysis and the results will be provided to the City when available. The field analysis for turbidities were as follows: Station 1 - City Intake Station 2 - Green Gate Station 3 - Tepee Park 1.34 NTU 2.39 NTU 8.03 NTU We noted that there were cattle in Beaver Creek above the City's intake and below the Green Gate during our sampling period. This activity would have likely impacted the turbidity at Station 3. At this time the SUP application materials you submitted do not include all required information per Garfield County Regulations. More specifically, your application refers to previous materials submitted to this office as part of a former SUP and that this office will need to collect those materials to add to your current submission. As you are aware, you have been directed to submit a new, stand alone application. As such, you are required to submit all new and up-to-date information required to complete a new application. Therefore, the application you submitted to this office is deemed incomplete and our department will not be able to process the submission any further until the following information has been provided: Please submit the following information required from the "Application Form": 1) A copy of the deed and legal description of the property. If you are acting as the agent for the property owner, you must attach an acknowledgement from the property owner that you may act on his / her behalf; 2) Your application refers to the "Official Forest Management Plan" (OFMP) which you have neglected to submit with your application materials. You specifically mention this plan in your responses to Garfield County Zoning Resolution Sections 5.03 and 5.03.07 regarding the mitigation of impacts. While you indicate the OFMP and resolution 97-70 were approved by Garfield County, it appears these documents are approximately 5 years old and may need to be amended as to best available science practices regarding impacts. Please amend the OFMP and submit it to this office as part of your SUP application; 3) Please respond more adequately to Sections 5.03.07(B), (C), (D), and (F) of the Garfield County Zoning Resolution. You have only briefly indicated this information is available in either the OFMP or Resolution 97-70. This is not adequate. Please respond more fully to these standards in a narrative form with information from either of the aforementioned documents; 4) Your submission neglected to address Sections 5.03.07(2)(A), (B), and (C) of the Garfield County Zoning Resolution. I assume this information may be discussed in the OFMP. Please provide the specific information required in these sections in order for your application to be deemed complete; 5) The SUP application requires an Applicant to specifically respond to Section 5.03.08 the Garfield County Zoning Resolution in its entirety. Your submission neglected to address this section. More importantly, your submission continues to refer to the OFMP which was approved by the county in 1997 which is five years old at this point. Please review fully the aforementioned section and respond appropriately as there may be new items / standards which require a response that are different from your earlier OFMP; 6) Please address Section 9.03.01 of the Garfield County Zoning Resolution in your additional comments as part of your amended application submission. Please provide these items as soon as possible if you wish your application to be reviewed in a timely manner. They are based on the silvicultural practices noted in the Tepee Park Forest Management Plan and adhere to Best Management Practices for Colorado. Extensive training and supervision of the logging crew has insured that the residual stand and all other resources are protected and enhanced. The Division of Wildlife has not inspected the harvest area. Per the minutes of the August 5, 2002 Board of County Commissioners meeting, Brett Ackerman gave the following testimony; "It is more appropriate for the forest service to mark trees, and if the DOW is included in the SUP they should be removed." Proposed changes were submitted to your office on September 18,2002 by Jim Beckwith. 4. Concerning aspen, Resolution 97-70,#13 states,"There will be no harvesting of aspen trees from the site, with the exception of incidental cutting of trees, approved by the inspector agreed to by the City of Rifle and the County." To date only incidental aspen trees have been harvested. 5. As of.this date all road -cut and fill slopes and abandoned landings have been grass seeded. A sample tag is shooin in Exhibit B. Approximately 7.5 miles of roads will be constructed or upgraded within the watershed and 90 to 100 acres of area will be logged. August 11, 199 tkU G 1 6 1999 George Foley, acting District Ranger, U.S, Forest Services, said that the plans for the proposed road on public lands have been submitted and reviewed but no permit has been issued to date. According to County Planner, Mark Bean, the plans for County Road 320 and 317 have been submitted and are under review. No approvals have been given by Garfield County at this time. The water quality base line data has been collected except for one last reading which is scheduled for the week of August 16, 1999. Upon final approval by Garfield County and permit issuance by 1:he U.S. Forest Service, we would recommend that the City approve the 1999/2000 plan by Intermountain Resources. Our road construction contractor is Masterson Construction. Mr. Masterson has been constructing roads for Intermountain Resources for three years and has extensive knowledge on Colorado's Best Management Practices (BMP's) regarding road construction, as well as a broad background constructing roads on national forest lands. Roads will be flagged -in prior to beginning construction. All construction will follow the requirements of the Tepee Park Forest Management Plan (the plan) and conditions of the Fifer Letters dated lv[arch 3, 1997 and April 22, 1997. Additionally, we adhere to recommended practices in BMP's for Colorado forests. Construction will be .a combination of a dozer and excavator. All necessary support vehicles will be on-site, as well. Revegetation techniques will follow the guidelines of the BMP's and the plan. Required seed will be broadcast; spread at the recommended rate; mulcing will be applied per guidelines also. UPCOMING LOGGING ACTIWTiy Our intent is to have, jointactivities in the Beaver Creek, Porcupine Creek and West Mamm Creek drainages. Our initial and major harvest and log removals will occur in the Porcupine Creek and West Manan Creek drainages this operating season. Harvest activities will commence about August 15th. We plan to deck the majority of the logs harvested and haul thorn when the ground is frozen. This will help mitigate damage to and erosion from roads. We will employ a varier), of silvicultural practices in our harvest. This will favor diversity in the stand structure ;and will support diverse wildlife species. The practices will include areas of group selection, shelterwood removal and individual tree selection. A commercial thinning is an option on a portion of Tepee Creek. Aspen stands will be harvested by coppice cuts. We will have a minimum of one logging contractor operating the area. The logging methods consist of feller -benchers and associated equipment and the possibility of a hand failing side. When log removals begin in earnest, we expect to move 10 +/ loads per day. At this time, we do not foresee hauling Logs after January, 2002. Mr. Bill Sappington, Public Works Director City of Rifle PO Box 1908 Rifle CO 81650 RE: Intermountain Resources - Watershed permit No. 1-97 Dear Bill: August 29, 2001 In response to the concerns of some Beaver Creek residents expressed to City personnel regarding turbidity of Beaver Creek, I made a site visit on August 28, 2001. The site visit was made with Chris Meyers of Intermountain Resources and Bill Gherardi, Consulting Forester. Following in a brief summary of observation made of the date of the site visit: • The roads constructed during the previous two years are in excellent condition. The drainage structure (ditches, culverts, catch basins, etc.) are functioning very well. Revegetation is well established and the road surface is good. I saw no erosion anywhere on the existing road. • A new road on private land was constructed in early July primarily to provide access to the forest fire at the head of Porcupine Creek. Although most of the road is in the Porcupine Creek Basin, it originates on Beaver Creek just below Teepee Park and traverses along the west side of the drainage. This road will become the access for logging and will be brought up to Forest Service Road standards in the next 6 weeks. Culverts are on-site. • Some erosion has occurred along the new road but there is no evidence of any impact on Beaver Creek water quality because the road is far from the creek and separated by vegetated areas. • A Targe trench has been dug along the property line at the gate separating private land from public land. The purpose of the trench is to prevent vehicular trespassing which was occurring. The trench does not have an outlet, therefore no erosion has occurred and no impact to Beaver Creek is evident. None -the -less the trench and the embankment of excavated material are relatively close to Beaver Creek and the permit holder has agreed to "dress -up" the trench, refill most of it and revegetate the area. This will be done in the next few weeks. • No logging has taken place to date except for minor amounts associated with the road work. We also reviewed the proposed 2002/2003 activities. We made the field trip with Mr. Chris Meyers of Intermountain Resources, LLC. Most of the proposed 2002/2003 logging will take place outside of the watershed boundary governed by the permit. The activities within the permit area includes limited logging in the "blow -down" area of Section 31. This activity consists of removing trees which have been blown down by recent wind storms. All of the activity is outside the riparian zone as is required by the permit. Road construction activities are as proposed and approved in the permit. Applicant has committed to meeting the requirements of the Water Quality Plan. Our inspection of current and previous activities indicates that Intermountain Resources has complied with the conditions of the permit. Roads are in good condition with no significant erosion. Revegetation is taking hold as expected. We specifically looked for any signs vehicle maintenance activity in the riparian zone and found none. We saw no evidence of dumping of oil or hazardous materials, however, we cautioned Mr. Meyers about such activity and asked that he remind his personnel to avoid any disposal of hazardous materials on-site. Mr. Meyers stated that they have regular meetings with employees and subcontractors to reinforce safety issues and water quality concerns so that the importance of these matters is passed on to all employees working in the watershed. We believe that this is important to achieve the goal of protecting water quality. It should be noted that RESOURCE obtained water samples at the three Beaver Creek stations on June 19, 2002. The samples were sent to ACZ laboratories for analysis and the results will be provided to the City when available. The field analysis for turbidities were as follows: Station 1 - City Intake Station 2 - Green Gate Station 3 - Tepee Park 1.34 NTU 2.39 NTU 8.03 NTU We noted that there were cattle in Beaver Creek above the City's intake and below the Green Gate during our sampling period. This activity would have likely impacted the turbidity at Station 3. Be assured that my intentions to improve the health of the Teepee Park forest and Beaver Creek watershed through selective timber harvest are not in conflict with your own intentions to represent the collective best interests of your constituents. I feel that we can, and must, work together to accomplish a mutually beneficial objective. Long before I authorized felling of the first tree in Teepee Park, I studied circumstances pertaining to age and declining health of the forest, diminished soil moisture and stream flows, and increased fire hazard resulting from inability to apply sound forest management practices. I witnessed expanding mortality caused by pine and spruce beetles, and the inadequate replenishment of timber stocks caused by excessive density. I saw firsthand the reduction in big game habitat in areas of extreme density or uncleared blowdowns, with accompanying reduction in forage. I observed streamflows below whatthey could be with proper ecosystem management. And I saw us on the brink of a catastrophic wildfire. When I was convinced that selective harvest was essential to the health of this forest ecosystem, I hired Mr. Gherardi of Woodland Management Consultants for the very purpose of providing professional guidance to improve the forest. Mr. Gherardi was recommended to me primarily for his experience, abilities, and familiarity with the property. It also appealed to me that Garfield County's consultant would be the same person who would guide me in this harvest, so that we could be in harmony. My objective as expressed clearly to Mr. Gherardi was to improve forest health, stimulate new growth, enhance wildlife habitat, and increase stream flows. I specifically instructed Mr. Gherardi to selectively harvest a limited percentage of mature trees to open the canopy; to remove all damaged, sick or infested trees to eliminate beetle infestation or disease; to accelerate new growth through greater availability of nutrients, sunshine and moisture; and to protect and enhance wildlife and stream habitats through implementation of proven forest enhancement techniques. Studies show that a professionally managed limited harvest will increase moisture penetration through the canopy and into the forest floor without increasing runoff, thus stabilizing seasonal stream volume. I believe this will enhance the cool, pure water necessary for survival of resident pure -strain Colorado River Cutthroat trout in time of drought. About 40 other firefighters bpfister@,express-news.net June 24, 2002 Garfield County Commissioners 109 8th Street Glenwood Springs, CO 61601 Re: Teepee Park Forest Management Plan (TPFMP) County Road 317, Beaver Creek Road (CR 317) Special Use Permit (SUP) Gentlemen, As a downstream property owner from the Teepee Park logging property, I have some concerns that I would like to address regarding the TPFMP, The Special Use Permit, and the impact on CR 317. Garfield County (GarCo) has issued a Special Use Permit dependant on the TPFMP (dated March 3, 1995) that will also utilize CR 317 to haul logs and associated equipment to and from the owners property. The TPFMP booklet includes detailed information pertaining to the logging process and the subsequent access to and from the subject property. It is my understanding that the TPFMP was mitigated with the City of Rifle and GarCo to ensure that the logging project can take place within the Beaver Creek Watershed with minimal impact to the drainage basin if the plan was followed. It was also my understanding that a forestry inspector (Bill Giardy) was to be hired by GarCo to regulate and ensure compliance with the TPFMP. The following non-compliance issues that have been observed by others and myself are listed below. The first line is an abbreviated version of the intent of the TPFMP on that stated page #. The following observed statements are the facts and opinions from the users of and owners within the Beaver Creek Drainage. TPFMP Pg 2&32 -Harvest Plan Map depicting the existing and proposed roads. Observed The main haul road for harvesting timber on the Westerly side of Beaver Creek is actually constructed two drainages north of the proposed route and is an area where the existing hillside slope is at a 50% or greater grade. The existing road below the 10400 contour is also in an area slated only for helicopter yarding. Will another route be constructed on the original alignment to harvest the timber as shown on page 32? Was this new alignment, (over 2 miles long), shown on a revised TPFMP and approved by GarCo or the City of Rifle? See attached maps. TPFMP Pg 33All roads will be single lane w/turnouts 12'-14' wide w/ ditches, seeding & mulching cut and fill slopes with straw or fabric. Observed The existing haul road appears to be approx. 20 feet wide, no ditch and is within a cleared swath of aspen trees at least 75-100 feet wide in the areas with shallower slopes. No apparent mulching was seen on the cut/fill slopes. What does the inspection report show? TPFMP Pg 34-spec(a) Road section over 100' long, crossing slopes over 65%, placement of fill prohibited. Observed Utilizing a USGS quad sheet in the area of the newly constructed haul road it is apparent that the slopes do exceed 65%. The haul road is constructed in a cut/fill balance along its entire length without regard to the slopes. The fill slopes extend downhill for approx. 10'-20' with no benching or retention. The numerous boulders excavated from the roadbed were cast downhill to the demise of the (once) thick aspen trees. TPFMP Pg 34-spec(b) On slopes greater than 50% with the road 15' wide, and the fill is more than 4 feet in depth, the fill shall be compacted on a bench with approx. 1 foot lifts. Observed In my observation there is well over a mile of roadway constructed on slopes greater than 50%, with standing live aspen trees within the fill slope of the roadway, it is obvious that there was no compacted bench. 1 1'PFMP Pg 40--- Winter Operating October 15 -April 15, The flatter area around Teepee park can be harvested during early winter, depending on snow depth. Observed The logging began in the fall and continued into April at the highest point on the Property, above the Porcupine Creek slides. The haul road system was plowed to bare ground, from the top of the mountain down to the most Southerly natural gas well on Beaver Creek. The road was plowed only as a single lane, with no turnouts. Was GarCo aware of the plowing, lack of turnouts and the blatant disregard for safety of the general public and landowners which utilize the road to access public & private lands for winter recreation? Who would be liable when someone gets hurt or killed? TPFMP Pg 41The WPZ (watercourse protection zone) assures that the integrity of the riparian zone will Be maintained with the lack of harvesting, timber falling or skidding. Observed The TPFMP has little resemblance to what is taking place on the ground now, only a field inspection of the riparian zones will verify if they are in compliance to the WPZ. Does the GarCo inspector's notes verify compliance within the Beaver Creek Watershed? TPFMP Pg46-48-Fire Safety, The contractor working on the property is required to submit a fire plan and a Suppression Resource Inventory to the GarCo Sheriff when operating in fire season. A brightly colored fire tool box, inspected, approved and sealed by the Sheriff or GarCo will be required on each work site, while work is being performed. The contractor also shall be required to clean the belly pans on all equipment frequently, with frequent inspections. Water truck or pumper to be on site during periods when fire danger is high. Observed From my observation of the logging equipment parked and transported along CR 317 the safety equipment was not apparent, the equipment was greasy with debris still in place from the previous job. Furthermore the large chains on the skidder tires and the steel tracked grouser lugs on the harvesters do produce sparks when operated on rocky ground such as this entire project area. A fire started in this area, with the prevailing westerly winds, would walk over the ridge to the East and burn the headwaters of the Beaver Creek Watershed very quickly. At this time of extreme fire danger in the West who is verifying the conformance of the two (2) full time crews in the woods? Do the GarCo inspector notes verify their conformance with the TPFMP? Is there a water truck available, ready and on site, now? TPFMP Pg 49--- "The concentration of fuels in the form of logging slash is a major problem in harvest Operations." Limbs in excess of 4" in diameter will be lopped to 30" from the ground. Observed The piles of logging slash at the yarding areas are in excess of 10' high, maybe up to 20' tall with the majority being tree tops. TPFMP Pg 49Administration will be under the supervision of a Tucker & Frase Forester. This includes the marking of trees, WPZ, EEZ, roads, cable corridors, yarder sets and landings. Also, monitoring of road construction and logging activities as needed for the life of the project. Observed Who is responsible for this supervision and monitoring? GarCo? Loggers? Landowner? Where are the inspection reports? Who is paying the tab? GarCo taxpayers? TPFMP Pg 53Recreation and Visual Resources, "The Tucker-Frase property is not open to the public but horsemen and hikers are allowed to use the road along Beaver Creek through Teepee Park to pack trails over Battlement Mesa and USFS land to the South." Observed The gates were closed and posted to all persons that wished to access through the property and tresspass charges were brought against any caught on the historical trail. This access has never been denied in the past with the previous owners (pre 2000), and was not just foot and horseback. Other activities include motorcycle and snowmobile riding that were and still are enjoyed as long as you are not caught trespassing through their property. With this dedication of access, the historical history and the continuity of uninterrupted travel, why and how are the current owners legally able to deny access? 2 TPFMP Pg 55— The noise from the log trucks to be mitigated by lower speeds and common courtesy. Observed Jake brakes reverberate through the valley by trucks going too fast, they cannot and do not stop when meeting uphill traffic. Does common courtesy to the truck driver mean: 'get out of my way, back up downhill, put it in the ditch and hope I don't run you over'. Colorado law states that uphill traffic has the right-of-way. Did GarCo revise the State Statute when issuing the S.U.P.? Do the log trucks have special preference over all users of the CR 317? (see photo of log truck taken on CR 317, June 12, 2002, 4 p.m.) Why did GarCo permit the `turnouts' to be constructed on the right hand side on the road and not within visual distance of one another? Who is liable for my family getting run over by a speeding, overloaded log truck on a dusty, washboarded road on a weekday evening or weekend day? TPFMP Pg 55—Landowner to apply Mag Chloride once a year and water truck to be available to reduce dust levels during log hauling. Observed No mag chloride has been applied, no water truck, Washboards all the way to N.F. gate (see photo for dust cloud hanging in valley) TPFMP Pg 58Log Trucks will be 5 axle with a max. weight limit of 70,000 pounds. Observed Hauling weight must be in excess of #70,000 (scale slips?) because both cattle guards are recently bent, ruts and washboards in gravel, collapsed and plugged culvert ends, subsidence along the most recent installed culverts, etc.. TPFMP Pg 58-- Hours of operation will be between 6am-5pm—to fluctuate slightly with seasons. Observed Log trucks up the road @4-8am, down road @6-10pm, winter -summer, 7 days a week. TPFMP Pg 58Season of operation expected May or June through December— Observed In 2001, they began logging and trucking in late summer and continued until lower frost law in March 2002, log trucks stopped, continued logging until April. Was the S.U.P. issued with the knowledge that they would be plowing and working all winter? In conclusion, from the above non-conformance issues, the intent of the TPFMP has been not been implemented as stated and certified to by Jeff J. Calvert and David E Levy on page 57 of said TPFMP. The regulation and monitoring of the TPFMP has been non-existent and it appears that the only intent this document was created for was to apease GarCo and the City of Rifle's concerns and obtain the Special Use Permit to Log the property. Once the necessary documents and lawsuits were finalized the contractor logging the property did as they please with no regulation and no recourse from anyone. In my opinion, as well as other users and owners within the Beaver Creek Watershed, the Special Use Permit should be REVOCTED and not renewed until all non-compliance issues are remedied. This should include at a minimum of, but not be limited to, the following: abandonment and reclamation of all roads not in the TPFMP; monitoring and regulation of constructing the road system per TPFMP; harvest of trees only in the permitted areas, by permitted systems; dust control and regular maintenance of CR 317 and the National Forest Access; Pilot cars in radio communication with the log trucks to stop them at `turnouts'. The Health, Safety and Welfare is at stake for every downstream user of the Beaver Creek Watershed and the City of ' ' the loggers take their profits elsewhere, at our expense.
