DESCRIPTION OF THE PROPOSAL The Board of County Commissioners (the Board) approved the Final Plat for Phase A of Valley View Village PUD which is located in Battlement Mesa in December, 2003. More specifically, Lot 46 of Phase A was approved with eleven building envelopes designated for either townhome or condominium configurations for a total of 54 dwelling units. In fact, the Board has approved several of these configurations in the recent past pursuant to the re -subdivision / condominiumization regulations. Presently, the Applicant requests approval from the Board to amend the Final Plat for Lot 46 of Phase A in order to amend two of the eleven building envelopes so that the structures inside them may be reduced from a six-plex to a four-plex in envelope 46F and from a six-plex to a duplex in envelope 46G. This request reduces the originally approved density for Phase A from 54 dwelling units to 48 dwelling units. II. AUTHORITY Section 6:10 of the Subdivision regulations states that an amendment may be made to a recorded plat, if such amendment does not 1) Increase the number of subdivision lots or dwelling units, or 2) Results in the major relocation of a road or add new roads. This request will not result in either of the two aforementioned standards, is consistent with the Preliminary Plan, and is consistent with the zoning dimensional requirements of the MDR zoning of the parcel. Therefore, Staff finds these standards are met. Lot 46 Phase A Valley View Village BOCC — 06/13/05 Page 2 III. STAFF RECOMMENDATION The Applicant has provided all required documentation and has satisfied the applicable standards for a plat amendment. Therefore, the Planning Staff recommends that the Board of County Commissioners, pursuant to Section 6:10 of the Subdivision Regulations of 1984, as amended, approve this amended plat request with the following conditions: 1. That all representations of the Applicant, either within the application or stated at the meeting before the Board, shall be considered conditions of approval. 2. Within 90 days of approval, the Amended Final Plat shall be reviewed (paper copy), then signed and dated (mylar copy) by the County Surveyor, than signed and dated by the Chairman of the Board and recorded in the Clerk and Recorder's Office of Garfield County. The Amended Final Plat shall meet the minimum CRS standards for land survey plats, as required by Colorado state law, and approved by the County Surveyor and shall include, at a minimum, the information outlined in Section 5:22 of the Garfield County Subdivision Regulations. The exterior boundary line of lot 46 should be a heavier line type. The flood plain line should be less evident. 2. The reception number for the 50 foot gas line needs to be filled in. 3. Exterior boundary corners for lot 46 need to indicated as found or set and the type of monument used. 4. Only information pertain ate to lot 46 need be shown on this plat. 5. If indeed this plat is referred to as "Phase A", then it needs to be named as such in the title and certificate of ownership and dedication.
