HomeMy WebLinkAbout3.0 ResolutionRESOLUTION WHEREAS, Charles C. Rand and Lydia Q. Rand have petitioned the Board of County Commissioners of Garfield County, Colorado, for an Exemption under C.R.S. 106-2-33(3) (d) (1963 as amended) for the division of a 25.64 acre tract of land into tracts of 16.002 and 9.640 acres and more particularly described as follows: Tract A. 16.002 acres located in a portion of Lots 9, 10, 18, and 19, Section 32, Range 87 West, Township 7S, and more particularly described as follows: Beginning at a point whence an iron post with a brass cap found in place and properly marked for the S.E. corner of Section 33 in said Township and Range bears S. 82° 38' 00" East 848.04 feet and South 66° 56' 42" East 7923.014 feet thence S. 82° 38' 00" East 530.09 feet, thence South 026 30 15" West 1335.12 feet, thence North 820 38' 00" 517.80 feet, thence North 01° 58' 45" East 1336.21 feet to the point of beginning. Tract B. 9.640 acres located in a portion of Lots 9 and 18 of Section 32, Township 7 South, Range 87 West, and more particularly described as follows: Beginning at a point whence an iron post with a brass cap found in place and properly marked for the S.E. corner of Section 33 in said Township and Ranee bears South 82° 38' 00" East 318.75 feet and South 66° 56' 42" East 7923.014 feet, thence South 82° 38' 00" East 318.75 feet thence South 02° 46' 00" West 1334.56 feet, thence North 82° 38' 00" West 312.63 feet, thence North 02° 30' 15" East 1335.12 feet to the point of beginning. WHEREAS, the Petitioners have shown to the satisfaction of the Board of County Commissioners of Garfield County, Colorado that they desire said exemption for the purpose of re -sale into singel-family residential acreaoe, and WHEREAS, Petitioner has demonstrated to the satisfaction of the Board that there is a reasonable probability of locating a water well on each tract, that there is adequate in°ress and egress to said tracts, that the location of septic tanks will be permitted by the Colorado Department of Health, that the requested division is in accordance with the general purposes and intent of the subdivision regulations of the State of Colorado and the County of Garfield and that said division will actually restrict the density of housing within said area and should therefore be exempted from the definition of the terms "subdivision" and "subdivision land" as set forth in C.R.S. 106-2-33(3)(d) (1963 as amended); 1 NOW THEREFORE, upon motion of seconded by and unanimously carried said 25.64 acres tract of land is hereby exempted from such definition and transfer of said tract may be made by division into two tracts all as is more fully described in the Petition pertaining hereto. A copy of the instrument or instruments of conveyance when recorded shall be filled with this Resolution. Dated this /s� i day of December, 1975.
