Howard Raley A tract of land located in the NE 1/4 NW 1/4 and Lot 2, Section 11, T6S, R92W; located approximately one mile east of Silt, off of State Highway 6 & 24. The site consists of 33.38 acres. Existing and proposed wells. Existing and proposed individual sewage disposal systems. ACCESS: Existing and proposed access off of County Road 218 and Hwy. 6 & 24. EXISTING ZONING: A/R/RD ADJACENT ZONING: A/R/RD and A/I I. RELATIONSHIP TO THE COMPREHENSIVE PLAN The site is located within the Silt Urban Area of Influence as shown on the Garfield County Comprehensive Plan Management District Map. II. DESCRIPTION OF THE PROPOSAL A. Site Description: The site is rural in nature, with moderate slopes and native types of vegetation. Land uses on the site and adjacent to it are mainly ranching and single family residential. B. Project Description: The applicant proposes to divide the 33.38 acre parcel into three lots, approximately 11 acres each. One lot has an existing single family residence while the other two are vacant. C. History: The Board of County Commissioners did conditionally approve an exemption request on this site in May, 1986. The present request excludes a fourth lot from the original request, south of Highway 6 & 24, which has been determined to be legally separate from the 33 acre parcel. III.MAJOR ISSUES AND CONCERNS 1. The Town of Silt has been contacted with no comments received at this time. 2. While the majority of the site has only slight soils limitations, those areas north of the Ware and Hinds Ditch have severe limitations to septic systems and building foundations. 1 • • 3. The applicant has submitted two domestic well permits for the site, and proposes to serve the three lots through shared well arrangements. 4. Due to the number of splits occurring and proposed out of the original parcel, no future divisions by exemption should be allowed on the site. IV. SUGGESTED FINDINGS 1. The proper posting and public notice was provided as required for the meeting before the Board of County Commissioners. 2. That the meeting before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that meeting. 3. That for the above stated and other reasons, the proposed exemption is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. V. RECOMMENDATION APPROVAL, with the following conditions: 1. That the following plat notes be included on the recorded Exemption Plat: a) No further divisions by exemption from the definition of subdivision will be allowed. b) That all irrigation ditches and easements be recognized and maintained as existing and in place. c) That each lot may be subject to engineered foundations and septic systems. 2. That the applicant shall establish an access point and easement for Lot 3, and include this easement on the Exemption Plat. 3. That proof of a legal and adequate source of water for each lot be submitted. Should a shared well be utilized, each parcel shall receive a deeded interest in an existing well, and that easements for waterlines, access and maintenance of the well be shown on the Exemption Plat. 4. That all shares of irrigation water associated with the property be divided proportionately between the lots. 5. That School Impact fees in the amount of $200 per lot be paid for the creation of two new lots. 6. All representations of the applicant, either within the application or stated at the hearing before the Board of County Commissioners, shall be considered conditions of approval.
