PETITION FOR EXEMPTION TO: BOARD OF COUNTY COMMISSIONERS, COUNTY OF GARFIELD, STATE OF COLORADO Your Petitioners, GEORGE H. REDDING, JR. and MARGARET W. REDDING of Cook County, State of Illinois ("Petitioners") hereby petition the Board of County Commissioners, County of Garfield, State of Colorado ("Commissioners"), to grant to Petitioners an exemption from the Subdivision Regulations of Garfield County, Colorado (Sept. 1972), pursuant to Sf 3.02.01 thereof, and pursuant to Colo. Rev. Stat. § 106-2-33 (3) (d) (1963), as amended, and as grounds therefor Petitioners would show the Commissioners: 1. Petitioners are presently the owners of certain real property situate in Garfield County, State of Colorado, which property has been the subject of acquisition and assemblage since March 11 1966. Petitioner's property is situate within parts of 2. Lots 3 and 8 of Section 29, T. 7 S., R. 88 W., 6th P.M. and is described on the attached Exhibit "A" to this Petition, and consists of approximately 5.005 acres of land, more or less, inclusive of the easement of access, and title is derived through the following instruments: a. Quit Claim Deed, dated March 24, 1972, between Mary Lu F. Seeburg and Petitioners, recorded August 9, 1972, as Document No. 254798 in Book 434 at Page 87 of the Office of the Clerk and Recorder, Garfield County, Colorado, a copy of which is attached to this Petition as Exhibit "B" hereto (Lot 3 of Section 29 of said Township and Range). b. Quit Claim Deed, dated March 24, 1972, between N. Marshall Seeburg & Sons, Inc. and Petitioners, recorded. August 9, 1972, as Document No. 254799 in Book 434 at Page 89 of the Office of the Clerk and Recorder, Garfield County, Colorado, a copy of which is attached to this Petition as Exhibit "C" hereto (Lot 8 and access easement of Section 29 of said Township and Range). 3. Because of certain title defects and uncertainties in the chain of title, particularly with respect to that part of Petitioner's property situate in Lot 8 of Section 29, T. 7 S., R. 88 W., 6th P.M., it has become necessary to obtain evidence of title from more than a single source. 4. A search of the recorded records in Garfield County, Colorado, discloses that Union Oil Company of California, and its predecessors in title may claim some interest to part of the real property described in Exhibit "A", particularly that part situate within Lot 8 of Section 29 of said Township and Range. 5. Accordingly, a quit claim deed has been prepared for execution and delivery to Petitioners by Union Oil Company of California affecting the approximate 3.131 acres of land, more or less, situate within Lot 8 of Section 29 of said Township and Range (Exhibit "D" to this Petition) and a right- of-way easement from the present county road to and from said parcel and the entire assemblage (Exhibit "E" to this Petition). 6. Said real property, in its entirety and as assembled, is to be used for single-family residential purposes. WHEREFORE, Petitioners pray that the Commissioners, pursuant to Subdivision Regulations, of Garfield County, Colorado t 3.02.01 (Sept. 1972) and Colo. Rev. Stat. § 106-2-33 (1963), as amended, grant 1. An exemption to Union Oil Company of California to permit the conveyance of the property as set forth in Exhibit "D" to this Petition together with the right-of-way -2- 1 1 1 1 1 1 1 1 1 1 1 1 1 1 1 1 1 1 1 1 1 1 1 easement appurtenant -thereto as set torth in Exhibit "E" to this Petition without said Union Oil Company of California being or becoming subject to the other provisions of said Subdivision Regulations; and, 2. An exemption, pursuant to the provisions'of 1[ 1.02.17 (d) of Subdivision Regulations of Garfield County, Colorado (Sept. 1972), that the real property described on Exhibit "A" hereto is not a "subdivision" or "subdivided land" within the meaning of said Subdivision Regulations so far as Union Oil Company of California and Petitioners are con- cerned. Dear Jerry and Larry: Enclosed is an exemption petition filed on behalf of George H. Redding, Jr. and Margaret W. Redding. This tract of land represents an assemblage of real property from several sources. Historically, the property represented the old Tony Zancanella farmstead. The house and several appurtenant outbuildings exist on the property. As is frequently the case in this area, the 5.007 acre parcel is situate within two separate homestead entries and the then surveys have created a great deal of confusion. The northerly part of the parcel is situate in Lot 3 of Section 29, and has one source of title, and the southerly part of the parcel is situate in Lot 8, and has an entirely different source of title. From my search of the records, it appears that the title to the southerly part of the parcel is entirely unmar- ketable because there is a complete break in the chain of title. We believe that color of title is created by several conveyances (see, Exhibits "C", "C-1" and "C-2" to Petition). However, prudence dictates that additional evidence of title be obtained from the present record owner of Lot 8, Union Oil Company of California. To this end Exhibits "D" and "E" have been obtained on behalf of the petitioners, but, at Gerald D. Hartert, Esquire Mr. Larry R. Schmueser Glenwood Springs, CO 81601 July 18, 1973 page two this point in time, not recorded. Union Oil Company of California is concerned, and I be- lieve correctly so, that it is necessary to obtain an exemption from the subdivision regulations to make these corrective con- veyances. I should add that the adjoining landowners have had a considerable amount of survey work done to establish their respective ownerships, and that several deeds have been ex- changed as a consequence of these surveys. This can be veri- fied by Neil S. Mincer, Esquire, Glenwood Springs, Colorado, local counsel for Union Oil Company of California. I am informed by the petitioners, if the exemption is given, that they intend to remove the existing house and certain of the outbuildings and construct a new, single-family residence on the 5.007 acre parcel. To me this is an updated duplication of the use which presently exists. If there are any questions I can answer please contact me.
