September 12, 1975 Board of County Commissioners Garfield County Courthouse Glenwood Springs, Colorado Re: Senate Bill 35 Exemption Redstone Corporation Gentlemen: I have conducted the review of a request, for a: Senate Bill 35 Exemption. The lot that will be created by the exemption is approximately one acre below the minimum lot size as the property ,is now zoned. Utilities are provided with on -lot water ant.septic systems.. An aerobic treatment system is planned for ,the, new dwelling with the present water system planned to serve both_the present, and. future dwellings. The land is relatively flat with hpn;es immegiately, to the north of the present lot. I feel this area represents an expandable area,in,,terms, of future development because of the terrain. ad avari,iabi, .ity of„ground. The subdivision process should be used. to regulate the.censity and impact of any future development of this area U,pop..,thA _county rather than. an exemption procedure on one 2,Qt,,,.. ., Of the previous exemptions, several involve lots which fall under the minimum acreage. However, of those above exemptions containing building sites, most dealt with dwellings already constructed. and pre-existing or lots which were to be developed With Inuxricip_ai, water andpewer. In this case, the actions taken by the county in setting up the future development of this area off of ,thp county r gd.,,, ,should be done under the subdivision process.
