At a meeting of the Board of County Commissioners for Garfield County, Colorado,
held in the Commissioners' Meeting Room, Garfield County Administration Building, in
Glenwood Springs on, Monday, the 1st day of May 2006, A. D. there were present:

when the following proceedings, among others were had and done, to -wit:

A RESOLUTION CONCERNED WITH A ZONE DISTRICT/ TEXT AMENDMENT FOR
LOT 47 OF THE VALLEY VIEW VILLAGE PUD,
OWNED BY EDWARD AND IDA LEE HOAGLUND
WHEREAS, the Board of County Commissioners of Garfield County, Colorado,
received a Zone District/Text Amendment application from Edward and Ida Lee Hoaglund
for Lot 47 of Valley View Village PUD, Garfield County, State of Colorado; and
WHEREAS, the Zone District/Text Amendment proposes the following changes to
Lot 47 as follows: To Amend the text and district of lot 47 from Neighborhood
Commercial to Mixed Use.
The zone district at the time of the proposed change was Neighborhood Commercial
(NC). Listed below are the uses by right, conditional uses and special uses in the
NC zone.
Uses by right: Retail establishments not exceeding 15,000 square feet of building area for
each principal use, including grocery, dry goods, hardware, bakery, liquor, drug, florist,
books and similar uses.
Personal service establishments not exceeding 5,000 square feet of area for each principle

use, including barber, beauty, self serve laundry, dry cleaning, photo and art studios, travel
agency, shoe repair, health spa, private clubs, indoor eating and drinking establishments
(which may include liquor), banks, and similar uses.
Offices for business and professional uses.
Gasoline service stations with two or less service bays, which must be sited with limited
vehicular access and service areas reasonably screened from public view, self service
storage facilities,
Unmanned carwash facilities (coin operated self service or automatic touch free) with four
or less wash bays and vacuum stations, which must be sited with limited vehicular access.
Uses, conditional: Church, community building, day nursery and school, auditorium, public
building for administration, fraternal lodge, art gallery, museum, library.
Uses, special: Extraction and processing of natural resources
WHEREAS, on February 8t 2006, the Garfield County Planning Commission, in a
public meeting, recommended that the Boara of County Commissioners approve the Zone
District/Text Amendment with conditions; and
WHEREAS, on May1st 2006, the Board of County Commissioners held a public
hearing upon the question of whether the Zone District/Text Amendment should be
granted, granted with conditions, or denied at which hearing the public and interested
persons were given the opportunity to express their opinions regarding the modification
and amendment; and
WHEREAS, the Board of County Commissioners, on the basis of substantial
competent evidence produced at the aforementioned hearing, has made the following
determination of facts:
1. Proper publication, public notice, and posting were provided as required by law for
the meeting before the Planning Commission and the hearing before the Board of
County Commissioners.
2. The meeting before the Planning Commission and the hearing before the Board of
County Commissioners were extensive and complete; all pertinent facts, matters
and issues were submitted and that all interested parties were heard at those
hearings.
3. The application is in compliance with the standards set forth in §4.12 of the Garfield
County Zoning Resolution of 1978, as amended.

4. That for the above stated and other reasons, the proposed Zone Text/District
Amendment is in the best interest of the health, safety, convenience, order,
prosperity and welfare of the citizens of Garfield County.
NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Garfield County Colorado that based on the determination of facts set forth above, the
Zone Distric llText Amendment for Lot 47 of Valley View Village PUD is approved as follows
The zone district for Lot 47 of Valley View Village PUD shall be known as "Mixed
Use" (MU) as follows:
Uses by right Retail establishments not exceeding 15,000 square feet of building area for
each principal use, including grocery, dry goods, hardware, bakery, liquor, drug, florist,
books and similar uses.
Personal service establishments not exceeding 5,000 square feet of area for each principle
use, including barber, beauty, self serve laundry, dry cleaning, photo and art studios, travel
agency, shoe repair, health spa, private clubs, indoor eating and drinking establishments
(which may include liquor), banks, and similar uses,
Offices for business and professional uses.
Gasoline service stations with two or less service bays, which must be sited with limited
vehicular access and service areas reasonably screened from public view.
Single family residential, multi -family residential, townhouses, and condominiums and
customary accessory uses including buildings for shelter or enclosure of animals or
property accessory to use of the lot for residential purposes, fences, hedges, gardens,
walks, and similar landscape features
Open Space, parks, bike paths, stormwater detention facilities and the like
Uses, conditional: Church, school, community building, day nursery, self service storage
facilities.
Uses, special: Public gatherings, commercial park, and group home for the elderly.
Minimum Lot Area:
(1) 600 Square feet for townhouse and condominiums, zero lot -line attached single

family dwellings.
(2) 7,500 square feet for single-family detached dwellings and two-family dwellings.
(3) 9,000 square feet for three (3) family dwelling building plus 3,000 square feet for
each additional attached unit on the same lot, which will allow for further subdivision
of condominiums and townhomes.
(4) 7,500 square feet for commercial uses.
Maximum Lot Coverage
(1) Residential uses: Not more than eighty percent (80%) shall be covered by buildings,
parking areas and streets.
(2) Commercial uses: Not more that eighty percent (80%) shall be covered by buildings,
parking areas and streets.
(3) The maximum number of dwelling units per building shall be as follows: townhomes;
4 units per building, condominiums and multi family; 8 units per building.
Minimum Setbacks:
(1) Residential Uses: Front yard: Twenty five (25) feet from the front lot line, if there is a
front facing garage: or no setback if there is a side -facing garage or at least twenty
five (25) feet of common open space between the curb line and the lot line, rear
yard: Ten (10) feet from the rear lot line: Side yard: Zero (0) feet from the side lot
line. Ten (10) feet from the one side of end units.
(2) Commercial Uses: Front yard: Twenty five (25) feet from front lot line: Rear Yard:
Twenty five (25) feet when adjacent to residential uses or ten (10) feet when not:
Side yard: Zero (0) feet from side lot lines or ten (10) feet when on a comer lot.
(3) Single Family Detached Residence: Front yard: Twenty (20) feet from front lot line:
Side yard; five (5) feet: Rear yard; Ten (10) feet: Comer lot; side yard abutting the
right-of-way, Ten (10) feet.
Maximum Heigl>lts of Buildings: Forty (40) feet.
Maximum Parking:
(1) Residential Uses: Two (2) spaces per dwelling unit
(2) Commercial Uses: Retail and Personal Service; one (1) space per 200 square fee of
floor area, excluding storage areas. Office; one (1) space per 300 square feet of

floor area. Service Stations; four (4) spaces excluding serves area and bays. Self
Service Storage; one (1) space for every two storage units. Other uses: see
sections 10.0 and 11. 00 of Battlement Mesa Planned Unit Development District
Regulations, as amended.
Additional Regulations:
All uses shall be subject to the provisions under sections 10.0 and 11.0 of Battlement Mesa
Planned Unit Development District Regulations, as amended.
