Pursuant to C.R.S. (1973) Section 30-28-101(f0) (a)-(d)
as amended, and the Subdivision Regulatj-ons of Garfield Cunty,
Colorado, adopted September L, 1972 and amended April 14, 1975,
Sections 1.02.17(d) and 3.02.01, the undersigned C. HUMBERT REES
respectfully petitions the Board of County Commissioners of
Garfield County, Coloado, to exempt by resolution the division
of approximately 224 acres located in Sections 9, 10 and 15,
Township 55, Range 93 West of the Sixth Principal Meridian,
more fully hereinafter described on the attached Exhibit rrArr
from the definitions of "subdivision" and t'subdivision 1and"
as the terms are used and defined in C.R.S. (1973) Section
30-28-101(a)-(d) and the Garfield County Subdivision Regulations,
for the reasons stated below:

Dear Mr. Witkowski-:
Pursuant to our telephone conversati_on earlier thisweek whereby you clarified that because of the highway goingthrough the Rees property that we would be creatiig two parcelseach, j-f we sold off the land in the surveyed q,rarf,e, quartersectionsr w€ now propose to seek a senate eirr-:s exemption.Encl-osed is a drawing of the same six 40 acre tracts which Mr.Rees proposes to selt.
we _propose to have a total of 7 parcels out of the 240acres of which 76.2L is in highway, llaving a net of 223.79 acres.As we discussed, parcer 7 is irreaay a separate parcel sinceit is separated from any of Mr. Reei' othlr land by the highwayso it is not really a pirt of the senate Bill 35 ei<emption.
By subtracting the approximate 6.82 acres for parcel_ 7 wearrive at a net of 276.97-icres, which will be divided into6 parcels. The average acreage for these 6 parcels is 36.16acres, howeverr_they will range from 19.89 alres for the smallestto 54.66 acres for the largest.
As you can see from the drawirg, we have foll_owed the highwayand grouped the parcels according t5'trre adjoining quarter quartersections. rn parcel 2 we have .6a"a a 60 f6ot stii-$ from theadjoining quarter quarter section to guarantee that there isat l-east 60 feet of frontage on Highwiy 13 for parcel z. we hadpreviously proposed to only give ri .ui"*ent, but feel it wouldbe a better practi-ce for pir6e1 2 to own its access frontage.
Once again, the acreagfe figures we have included on our
drawing for each of the 7 parcels have been computed from thedata off of the Highway Department map and even though it isadmittedly not exact, they are computed estimates and certainlynot guesses. However, although we have used all that data that
we have to arrive at the acreages, it is not possible to determine
such without a physical survey. With regard to the requestedexemption, it appears to us that the decisj-on of the Commissionerwill be based upon a general policy rather than specific acreagesto the end that, for example, it presumably would not be materialwhether a given acreage was 16 or 23 rather than the 19.89 acres
which we have computed for Parcel 4.
Since it is necessary to obtain an exemption to seIl theland we are filing a petition for the Senate BilI exemption in yourusual form with this letter. rt is my understanding that we canschedule this matter for hearing with the commissioners on Monday,August 8, 1977. So, assuming approval is given, plr. Rees couldproceed to seI1 the parcels. Mr. Rees will be out of town next
Monday, but f believe that we can answer any questions regardingthe l-and, so that his presence would not be needed at the hearing.rf everything looks in order, would you advise me of a time tohave a hearing before the Commissioners?
