(tSZi1 Section 30- 2B-101 (to1 (a) - (a) as amended, and the Subdivision Regulations of Garfield County, Co'lorado, adopted September 'l , 1972 and anended Apri 1 .l4, .l975, Sections I.02.17 (d) and 3.02.0.l for the dfvision of a 216.97 acre tract of land into six (6) tracts, three of which said tracts require an exemption being Zg.7Z acres, 19.89 acres, and 29.06 acres, in size, with the remaining three tracts in excess of 35 acres each, all said tracts more particular'ly described as fol lows: situated in the State of colorado, county of Garfield and in ]gwlsfip 5 South, Range 93 West of the Sixth principal Meri di an: Parcel 1 B-eingeTl of that part of the sEkSE% of section 9 that liesNortherly and Easterly of the northern boundary line ofcolorado state Highway .l3, containing approximitety 30 acres. Parcel 6EfifiTl of that part of the NEkNhl% and the Section l5 that lies Southerly and Wester)y boundary line of Colorado State Highway )3, NWlaNWk of of the Southern conta i ni ng WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board that there is a reasonable probability of locat'ing domestic water on each of said tracts, that there is adequate ingress and egress to said tracts, that the location of septic tanks will be permitted by the Colorado Department of HeaIth, that the requested division i.s in accordance with the general purposes and intent of the Subdivision Regulations of the State of Colorado and the County of Garfield and should, therefore, be exempted from the definition of the terms "subdivision" and "subdivided land" as set forth in C.R.S. (.I973) Section 30-28-101 (.l0) (a) - (a) as amended; NOt{ THEREF0RE, upon motion of Dlauern (en'sa seconded by I ^ fn{ VelaSloe- and carried, sai d 216.97 acre tract of land is hereby exempted from such definition and transfer of said tract may be made by division into six (6) tracts, three of which said tracts require an exemption being 29.72 acres, .l9.89 acres, and 29.06 acres, with the remaining three tracts in excess of 35 acres each, more or less, all as is more fu]ly described above. A copy of the instrument or instruments of conveyance when recorded shall be fi'led with this Reso'lution. approximately 29 acres .
