DIRECTOR DETERMINATION
Request for a Major Exemption for the Reid Parcel#2177-031-00-019
Garfield County File Number MAEA5909
Dear Ms. Chandler,
This letter is provided to you as the representative of the owners of a 39.77-acre
parcel of land located 1150 CR 233. A request for a Major Exemption to create
two new parcels and a remainder parcel has been reviewed by the Director of
Building and Planning. The Director Determination, whether to approve, approve
with conditions, or deny the request, considers the attached staff report regarding
the review of the application based upon the Unified Land Use Resolution of
2008, as amended. The Determination is hereby issued to approve the
application compliant with the following conditions:
1. That all representations made by the Applicant in a public hearing before the
Board of County Commissioners shall be considered conditions of approval
unless otherwise amended or changed by the Director.
2. The Applicant shall submit an exemption plat within 180 days of approval of
the Exemption from Subdivision Regulations compliant with State Statute and
County Regulations. No transfer of the property or issuance of building
permits may occur until such time as the Board of County Commissioners
approves and signs the exemption plat, and the plat is recorded with the
County Clerk and Recorder.
3. The Applicant shall submit all easement documents (ROW and utility), as well
as a letter of acceptance from the entity accepting such easement, prior to the
scheduling the plat for BOCC signature. These include:
a. The dedication of a right-of-way easement over the existing County Road
encompassing an area of 30 feet from each side of the centerline, along
the length of the parcel.

b. ROW dedications to the City of Rifle.c. Any necessary utility easements including the water distribution system
to serve the two new lots and the remainder parcel.
T.he signed mylar shall be submitted at least one week prior to scheduling theplat for signature by the Board of county commissioners. Adequate
recording fees shall accompany the mylar.
The property is located in School District RE-2 therefore the Applicant shallbe required to pay $200 for one additional parcel. This fee shall'be paid at orprior to the Board of county commissioners signing the exemption piat.
Prior to the Board o-f County Commissioners signing of the plat the Applicantshall provide the following information regarding- adequacy of the water
supply:
a- A minimum 24 hour pump test shall be performed on the weil(s) to beused. The results of the pump test shall be analyzed and summaiized in areport including basic well data (size, depth, static water level, aquifer,etc.) pumping rate, draw down, recharge and estimated long term yield.The report shall be prepared by a qualified engineer of g-round water
hydrologist and include an opinion that the well will be adeqtlate to supply
water for the proposed uses. The report shall also address the impacts toground water resources in the area.
b. Water use assumptions shall include an average of no less than 3.5people per dwelling, using 100 gallons of water per person per day, plus
and irrigation and livestock watering uses.
c. lf the well is shared, a legal well-sharing declaration addressing alleasements and costs associated with operation and maintenance of thesystem and identifying the person responsible for paying costs and how
assessment will be made for those costs.
d. At a minimum, the water quality of the well shall be tested by anindependent testin_g laboratory for the basic Colorado primary DrinkingWater Standards for inorganic chemicals (heavy metals, nitraie, sulfateand asbestos), bacteria and radioactivity. The results should show that theapplicable standards are met or otherwise identify a treatment system tomeet the standards. Testing for the Secondary Drinking Standards (taste,
odor, color, staining, scaling, corrosion, etc.) isrecommended.
This application and Determination will be forwarded to the Board of County
Commissioners for a period of 10-days pursuant to $4-104 B. for consideration ofcall-up to a public hearing.
