B. Project Description: The applicants propose to divide the8.5 acre tract into 4 lots, approximately 2 acres each insize. (See page g ) --
C. History: The 8.5 acre parcel has been in existence since
1956, based on the Assessorrs office records.
MAJOR ISSUES AND CONCERNS

based on flooding, seasonal high water table, and stones inthe soi1.
3.Flood Plain mapping on the site indicates that a majorportion of the site lies within the 100 Year Flood Plain.
More detailed flood plain mapping should be completed by aqualified engineer or hydrologist. This mapping shouldestablish building envelopes on each lot outside of the I00Year Flood Plain adequate in size to accommodate asingle-family residence and individual sewage disposal
sys tem.
4. Should appropriate building envelopes outside the I00 Year
Flood Plain not be available, the applicants should either
reduce the number of lots and/or adjusL their configurationto provide for the building envelopes, or submitapplications for Flood Plain Special Use Permits, which
would be necessary to develop the lots. Flood Plain SpecialUse Permits are required for improvements within t,he 100
Year Flood P1ain, and require evidence adequate to assure
that the carrying capacity of the altered/relocated water
course is maintained.

Where building envelopes outside of the 100 Year Flood Plain
are not available, the applicants shall either modify their
request to comply with Condition 2 (C) r or submit
applications for Flood Plain Special Use Permits for all
proposed building sites within the 100 Year Flood Plain, in
accordance with the Garfield County Flood Plain
Regulations. Said Special Use Permits and associated
engineering shall be reviewed and approved prior to final
approval of the Subdivision Exemption.
That the applicants shall submit approved contracts with the
Basalt Water Conservancy District providing for individual
well permits on each of the proposed lots. In addition,
copies of existing well permits for the site shall be
submi tted .
That School Impact fees, in the amount of $ZOO per Iot, be
paid for the creation of three new lots.
That the applicants shalI apply for and receive driveway
access permits, as required by the Garfield County Road and
Bridge Department. Copies of said permits shall be
submitted to the Planning office.
That all representations of the applicants, either within
Lhe application or stated at the meeting before the Board of
County Commissioners, shalI be considered conditions of
approval.

Thls particular applicatlon, if approved, would be immsdiately adJacentto our main Ilne rlght of way of the Aspen Branch whlch runs between
Glenwood Springs and Woody Creek. Because we do have rail trafflc overthis partlcular r1ne, our company 1s very apprehenslve and concerned atthe prospect of havlng thls subdivlslon adJolning our rlght of way. rf
the proposal is granted, there would be an lncrease in auto vehicular
trafflc 1n thls lnnediate area. As Garfleld County ls no doubt aware, if
there are not sufflclent publlc crosslngs to aIlow adequate access across
our tracks to and from the developnent area, then we predlct that many
who would use the subJect area would enter or depart by unauthorlzed andunsafe methods, such as uslng prlvate crossings, whlch ls strlctlyprohlbited by our Ralrroad, or by entering or leaving the proposed area
by crossing our tracks where no type of crosslng at all exists.
No infornation has been submltted as to how drainage w111 pass across the
Rallroad rlght of way. Any utllity crosslngs wilr requlre permits or
llcenses from the Rallroad and plans must be approved by the D&RGW ln
advance.
rf Garfield County commlssloners grant the requested approval of theexemptlon, we wourd like to insist that the following three (3)
condltlons, whlch our company feels should be met to preserve the publicsafety, be made a condition to the grantlng of the applicatlon sought bythe above referenced appllcant. They are:
