MIPA 6136 and MIPA 6137 Dear Ms. Hotard; The Building and Planning Department has reviewed the additional materials submitted in response to the letter we sent to you on October 9, 2009. Thank you for such a quick and thorough response to the additional information — the operational descriptions of the drilling, completion and production processes were exactly what was necessary for staff to fully understand and determine potential impacts of that operation. I do have just one question regarding the additional information submitted — the access route specified is for PA 41-9, but is it the same route for both pads? The applications have been determined technically complete — this is the standard format letter that the County provides for a "technically complete" application. Of course we are now past the notice issues except for the posting requirement. I assume that the signs will be picked up when the copies are brought to our office tomorrow. The signs must be posted prior to Sunday the it of October to meet the minimum 30 -day requirement. As a matter of process, the Planning Commission and the BOCC shall hold am advertised public hearings on the proposed action at a regularly scheduled meetings The Applicant shall be solely responsible for the publication, property posting, and mailing of all notices. The Applicant shall present proof of publication and mailing at or before the meeting. The Hearings cannot occur if correct noticing requirements have not been met. Notice for the meeting shall be given as follows: 1. Notice by publication, including the name of the applicant, description of the subject lot, a description of the proposal and nature of the meeting, and the date, time and place for the hearing shall be given once in a newspaper of general circulation (the Rifle Citizen Telegram is the official newspaper) in that portion of the County in which the subject property is located at least thirty (30) but not more than sixty (60) days prior to the date such hearing, and proof of publication shall be presented at hearing by the applicant. 2. Notice by mail, containing information as described under paragraph (1) above, shall be mailed 108 Eighth Street, Suite 401 • Glenwood Springs, CO 81601 (970) 945-8212 • (970) 285-7972 • Fax: (970) 384-3470 to all owners of record as shown in the County Assessor's Office of lots within two hundred feet (200') of the subject lot, all owners of mineral interest in the subject property, and all tenants of any structure proposed for conversion to condominiums, at least thirty (30) but not more than sixty (60) days prior to such hearing time by certified return receipt mail, and receipts shall be presented at the hearing by the applicant. 3. The site shall be posted such that the notice is clearly and conspicuously visible from a public right-of-way, with notice signs provided by the Planning Department. The posting must take place at least thirty (30) but not more than sixty (60) days prior to the hearing date and is the sole responsibility of the applicant to post the notice, and ensure that it remains posted until and during the date of the hearing. I have previously provided the suggested public notice in Word format so necessary information could be inserted, such as the legal description of the subject site. The posters necessary to meet the requirement for posting of the property are currently available at our office. The posting and public notice documents for the public hearing are provided as a courtesy. The Applicant must verify that all information provided in these documents is correct. As always, it is the obligation of the Applicant to correct any deficiencies such that proper notice in form and substance can be established. Note: We had previously provided you with a draft referral form listing the federal, state and local agencies who will review the applications as well as their preference in receiving paper or CD copies of the applications. The request was for twenty-two (22) paper and twelve (12) compact disks of EACH application and supplemental information. We expect to receive those copies tomorrow, Friday the 16th of October. Our referral review timeframe is fairly short so we appreciate your efforts to provide this information in a timely manner. Feel free to contact me with any questions.
