WHEREAS, Rifle Southern Baptist Chapei, Inc. has petit'ioned the Board of County Commissioners of Garfield County, Co'lorado, for an exernntion from the definition of the terms "subdivision" and "subd"ivided land" under C.R.S.1973,30-28-l0l (.l0) (a)-(d), as anrended, and the Subdivision Requla- ti ons .of Garf i e'l d County, Col orado, adopted January 2, 1979 , Secti ons 2 .02.21(d) and 3.A2.01 for the divis'ion of a 3.0 acre tract described as follows: that parcel of land as described in Document 1i0.252323 as filed in ihe Officeof the Clerk and Recorder of Garfield County, Cololado into 2 tracts of approx- irnately .l.0 and 2.0 acres each, more or 1ess, which proposed div'ided t.racts are more particularly described as follows: Tract A: Beginning at the Northwest Corner of a two acre parce'l as platted on a survey by Pioneer Engineering and Survqying Company, Job #79-36, dated Nov. 26, 1979; thence N.87055'00" E. , 274.92 feet; thence N.0023'0d"E., .l55 feet, more or less; thence S.750U.,285 feet, more or less along the southeqn right of way 'line of 01d 6 & 24 H'ighrrray; thence S.0u00'30" ltl.,92 feet, rnore or less to the point of beginning, containing less than I acre in the State of Colorado and County of Garfield. Containing 2.000 acres, more or less, in the State of Colorado and County of Garfield. WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board of County Conrm'issioners of Garfield County, Colorado, that the proposed division does not fall within the purposes of Part l, Article 28, Title 30, uotorado i(evtseci Starutes l973, as amendeci, for rhe reason rhat the impact created is not large enough to proceed throuqh the full subdivision rev'iew; and iP WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board of County Conrm'iss'ioners of Garfield County, Colorado, that there'is a reasonable probability of locating domest'ic water on each of said tracts, that there is adequate ingress and egress to said tracts, that the location of septic tanks will be permitted by the Colorado Department of Health, that the requested division is not part of an existing or larqer development and does not fall lv'ithin the general purposes and intent of the subdivision requlations of the State of Colorado and the County of Garfield, and should, therefore, be exempted fron the definition of the terns "subdivision" and "subdiv'ided land" as set forth in C.R.S. 1973, 30-28-l0l (.l0) (a)-(d), as amended; NOtl, THEREFORE, BE IT RES0LVED that the division of the ahove described tracts "A" and "8" from the above described 3.0 acre tract is hereby exempted from such definitions and said tract may be djvided into tracts "A" and "B", all as is rnore ful'ly described above, and said divfded tract may be conveyed in the form of such smaller tracts without further compiiance r^rith the aforesaid sub- division statutes and requ'lations; provided, however, that this exemption 'is granted on the condition and with the express understand'ing and agreement of the Petitioner that no further exemptions be allowed on said tracts'rrA'r and "8", and that a copy of that'instrument or instruments of conveyance when recorded shall be filed with this Resolution.
