APPLICABILITY
The Board of County Commissioners has the discretionary power'to exempt adivision of land.from the--definition of subdivision and thereby from theprocedure in- thesei Regu'lationsr proVided the Board determines that suchexemption will not i-ppair or <ref eat tne stated purpose of t.1re sul.rdivi sionRegulations nor be detrimental Eo the general public welfare. The Boardshall make exenption decisions in accordance with the requirements ofthese regulations. ' 19. Additional yrrovisions:
a. The real property to be conveyed shall be described by survey to be com-
missioned and paid for by Purchaser.
Conveyed with the subject property shall be a license to use, maintain, and
improve, at Purchaser's expense, the existing septic tank and leach field.
This license sha1l terminate at such time as City sewer lines are extended
to the real property and this license shall be exercised in a manner so as
to not unreasonably interfere with the surface use of the affected real
property.
This contract is contingent upon the Purchaser obtaining, at its expense, on
or before the date of closing, subdivision or exemption from subdivisionpursuant to Garfield County regulations. Application for: such subdivision
or exemption may be made by Purchaser in the name of Sel1er.
20. If this proposal is accepted by Seller in writing and Purchaser receives notice of such acceptance on or before
Aucrust 10 , 19 88, this instrument shall become a contract betrveeu Seller and Purchaser and shall
inure to the benefit ofthe heirs, successors and assigns of such parties, except as stated in paragraph 7.
