RICHARDSO|I and MAR,JORIE RICHARDSON have petitioned the Board of County Commjssioners of Garfield County, Colorado, for an exemption under C.R.S. (.l973) Section 30-28-l0l (.l0) (a) - (d) as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted Septgx15.. 1, 1972 and amended April .l4, .l975, Sections .l.02..l7 (d) and 3.02.0.l, for the division of a 16.4.l acre tract into 3 tracts of approximately 3.44,5.g?, and 7.05 acres, more or Iess, and nrore particularly described as folIows: (See attached Exh.ib'its A, B, and C) t^IHEREAS, the Petitioners have shown to the sat'isfaction of the Board of County Comm'issioners of Garfjeld County, Colorado, that they desire said exemption for the purpose of re-sale irrto single-family residential acreage, and WHEREAS, Petit'ioners have denmnstrated to the satisfaction of the Board that there is a reasonabie probability of locating domestic water on each of said 3.44, 5.92, and 7.05 acre tracts, that there is adequate inqress and egress to said tracts, that the location of sept'ic tanks be permitted b-v the Colorado Departrnent of Health, that the requested division is 'in accordance wjth the general purposes and intent of the subdivision regulations of the State of Colorado and the County of Garfield and that said division will actually restrict the density of housinq within said area and should therefore be exenrpted from the definition of the terms "subdivision" and "subdiv'ided land" as set forth in C.R.S.
