Pursuant to C.R_S. (1973) Section 30-28-101 (10) (a) - (d) as amended, and
the Subdivision Regulations of Garfield County, Colorado, adopted Oanuary 2, 1979

WITNESSETH, that the said part ies of the first part, for and in consideration of the sum of

hereby confessed and acknowledged, have granted, bargained, sold and conveyed, and by these presents do
grant, bargain, sell, convey and confirm unto the said partied of the second part, their heirs and assigns forever, not
in tenancy in common but in joint tenancy, all the following described lot or parcel of land, situate, lying and
being in the County of Garfield and State of Colorado, to wit:
A tract of land in the Southwest corner of the WANE. of Section 36,
Tp. 5 S., R. 90 W., 6th P.M., lying Northerly of U. S. Highway No. 6 & 24
and described as follows:
Beginning at a point on the Northerly line of said highway whence
the North Quarter corner of said Section 36 bears N. 39°36' W., a
distance of 1848.97 feet; thence N. 05°03' E. 98.41 feet; thence S.
81°11' E. 174.64 feet; thence S. 06°22' E. 98.41 feet to a point on the
Northerly line of said highway; thence along a curve to the left, the
chord of which bears N. 81°54' W. 159.00 feet along the northerly line
of said highway; thence along a curve to the left, the chord of which
bears N. 83°11' W. 34.99 feet along the Northerly line of said highway
to the point of beginning; EXCEPT beginning at a point on the west
property line, from which point the N1 corner of Section 36, T. 5 S.,
R. 90 W., bears N. 40°11'30" W. a distance of 1,835.3 feet; thence
S. 75°32' E. a distance of 155.0 feet to the south property line; thence
along the south property line along the arc of a curve to the left having
a radius of 1,949.9 feet, a distance of 153.1 feet (the chord of this
arc bears N. 82°05' W. a distance of 153.1 feet) to the SW property
corner; thence N. 4°57' E. along the west property line a distance of
17.7'feet, more or less, to the point of beginning.
Together with, but not subject to the warranties hereunder, the right
of ingress and egress over and across a strip of land 20 feet in width
along the easterly boundary of the above-described property, which said
20 -foot easement shall extend from the County road to a line, as extended,
by the Northerly line of the described property, the Westerly boundary
of said easement to be a line equal to the Easterly line of the described
property and the Easterly boundary of said easement to be a line 20 feet
East of said Easterly boundary of the described property and parallel
thereto.
Together with, but not subject to the warranties hereunder, all well
rights, ditch rights, waters and water rights used upon or in connection
with tho above-described property.
Subject to a first Deed of Trust to secure that certain prowiaaory note of
even date is the mount of $13,500.00 given by Marshall H. Dean and Olive

and agree to pay.
TOGETHER with all and singular the hereditaments and appurtenances thereunto belonging, or in anywise
apporudning, and the reversion and reversions, remainder and remainders, rents, issues and profits thereof; and
all the estate, right, title, interest, claim and demand whatsoever of the said part iesof the first part, either in
law or equity, of, in and to the above bargained premises, with the hereditaments and appurtenances.
