SHARP and JOAN FRENCH, have petitioned the Board of County Commissioners of Garfield County, Colorado, for an exemption under C.R.S. (1973) Section 30-28-101 (10) (a) - (d) as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted September 1, 1972 and amended April 14, 1975, Sections 1.02.17 (d) and 3.02.01, for the division of a 43 acre tract into three (3) tracts of approximately 10, 14, and 19 acres, more or less, and said 43 acre tract is more particularly described as follows: A parcel of land in the NZNWQ of Section 17, Township 7 South, Range 87 West of the Sixth Principal Meridian, lying Southerly of the Northerly line of said Section 17, Northerly of the Northerly right-of-way line of a 60 foot road easement as constructed and in place and Easterly of the Westerly line of said Section 17, said parcel of land is described as follows: Beginning at the Northwest Corner of said Section 17, said Corner being found in place and properly marked thence S. 88° 27' 42" E. 2627.57 feet along the Northerly line of said Section 17, to the North Quarter Corner of said Section 17; thence S. 000 11' 40" E. 709.50 feet along the Easterly line of said N1/2NW4; thence S. 580 09' 19" W. 579.73 feet to a point on the Northerly right-of-way line of said road; thence along the Northerly right-of-way line of said road 110.84 feet along the arc of a curve to the right, having a radius of 123.59 feet, the chord of which bears: N 480 26' 31" W. 107.16 feet; thence 95.94 feet along the arc of a curve to the left, having a radius of 219.64 feet, the chord of which bears: N. 480 18' 21" W. 189.50 feet; thence N. 730 51' 43" W. 357.19 feet; thence 121.26 feet along the arc of a curve to the right, having a radius of 456.23 feet, the chord of which bears: N. 660 14' 52" W. 120.91 feet; thence 105.01 feet along the arc of a curve to the left, having a radius of 183.20 feet, the chord of which bears: N. 750 03' 15" W. 103.58 feet; thence S. 88° 31' 31" W. 78.47 feet; thence 146.74 feet along the arc of a curve to the right, having a radius of 387.81 feet, the chord of which bears: N. 800 38' 06" W. 145.86 feet; thence N. 690 47' 45" W. 213.93 feet; thence 117.25 feet along the arc of a curve to the left, having a radius of 451.81 feet, the chord of which bears: N. 770 13' 48" W. 116.92 feet; thence N. 840 39' 51" W. 289.51 feet; thence 196.68 feet along the arc of a curve to the left, having a radius of 578.81 feet, the chord of which bears: S. 85° 36' 05" W. 195.73 feet; thence 98.19 feet along the arc of a curve to the right, having a radius of 669.24 feet, the chord of which bears: S. 80° 04' 13" W. 98.11 feet; thence S. 840 16' 24" W. 165.95 feet; thence 90.08 feet along the arc of a curve to the left, having a radius of 395.50 feet, the chord of which bears: S. 770 44' 54" W. 89.89 feet to a point on the Westerly line of said Section 17; thence N. 00° 9' 9" E. 633.35 feet along the Westerly line of said Section 17, to the point of beginning, containing 43.00 acres, more or less. WHEREAS, the Petitioners have demonstrated to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that they desire said exemption for the purpose of re -sale into single-family residential acreage; and, WHEREAS, the Petitioners have demonstrated to the satisfaction of the Board of County Commissioners that there is a reasonable probability of locating domestic water on each of said tracts, that there is adequate ingress and egress to said tracts, that the location of septic tanks will be permitted by the Colorado Department of Health, that the requested division is in accordance with the general purposes and intent of the Subdivision Regulations of the State of Colorado and the County of Garfield and should, therefore, be exempted from the definition of the terms "subdivision" and "subdivided land" as set forth in C.R.S. (1973) Section 30-28-101 (10) (a) - (d) as amended; NOW THEREFORE, upon motion of f .ije. LP.rt:C seconded by Lay� Ue.1 uez._ and carried, said 43 acre tract of land is hereby exempted from such definition and transfer of said tract may be made by division into three (3) tracts of 10, 14, and 19 acres, more or less, all as is more fully described above, and further, that said exemption is conditioned upon the Petitioners obtaining a proper legal description of said tracts prior to any conveyance thereof, and further, that no additional exemptions on these tracts of 10, 14, and 19 acres be allowed.
