BEFORE THE BOARD OF COUNTY COMMISSIONERS OF
GARFIELD COUNTY, COLORADO
RESOLUTION NO. 7-i-//
WHEREAS, Richard A. Sherriff has petitioned the Board of County
Commissioners of Garfield County, Colorado, for an exemption from the
definition of the terms "subdivision" and "subdivided land" under C.R.S.
1973, 30-28-101 (10) (a) -(d) as amended, and the Subdivision Regulations
of Garfield County, Colorado, adopted January 2, 1979, Sections 2.02.21
(d) and 3.02.01 for the division of a 11.45 acre tract into two (2)
tracts of approximately 1.0 acre and 10.45 acres more or less, and said
1.0 acre tract is more particularly described as follows:
A parcel of land situated in Lot 1, Section 6, Township 6 South,
Range 89 West of the Sixth Principal Meridian, Garfield County,
Colorado, more particularly described as follows:
Commencing at an iron post and brass cap properly narked and
found in place for the S.E. Corner of Section 34, Township 5
South, said Range 89 West, thence S. 86°45'23" W. 683.28 feet
to a point common to the South right-of-way of an existing
County Road and an existing fence line, the True Point of
Beginning; thence S. 00°17'42" W. 255.62 feet; thence N.89°
42'18" W. 170.41 feet; thence N. 00°17'42" E. 255.62 feet to
said South County Road right-of-way and fence line; thence
S. 89°42'18" E. along said South right-of-way and fence line
170.41 feet to the True Point of Beginning; containing 1.000
acres more or less.
WHEREAS, the Petitioner has demonstrated to the satisfaction of the
Board of County Commissioners of Garfield County, Colorado, that he desires
said exemption for the purpose of resale of said tract into single-family
residential acreage.
WHEREAS, the Petitioner has demonstrated to the satisfaction of the
Board of County Codiissioners of Garfield County, Colorado, that there is
a reasonable probability of locating domestic water on each of said tracts,
that there is adequate ingress and egress to said tracts, that the location
of septic tanks will be permitted by the Colorado Department of Health,
that the requested division is in accordance with the general purposes and
intent of the Subdivision Regulations of the State of Colorado and the
County of Garfield, and should, therefore, be exempted from the definition
of the terms "subdivision and "subdivided land" asset forth in C.R.S.
1973, 30-28-101 (10) (a) -(d) as amended,
NOW,. THEREFORE, upon'the motion of ..TZ
seconded by Velc1Sc]o(z and carried, said 11.45 acre tract
of land is hereby exempted from such definitons and said tract may be divided
into two (2) tracts of 1:0 acre and 10:45 acres, more or less, all as is more
fully described above, and said divided tract may be conveyed in the form of
such smaller tracts without further compliance with the aforesaid subdivision
statutes: and regulations; provided, however, that said exemption is conditioned
on the Petitioner obtaining a proper legal description of said tracts prior'
to any conveyance thereof. Further, this exemption is granted on the condition
and with the express understanding and agreement of the Petitioner that no
further exemptions be allowed on said tracts. A copy of the instrument or
instruments of conveyance when recorded shall be filed with this Resolution.
