HomeMy WebLinkAbout1.0 Application• • PETITION FOR EXEMPTION TO: BOARD OF COUNTY COMMISSIONERS OF GARFIELD COUNTY, COLORADO RICHARD SIERZANT hereby petitions the Board of County Comndssioners of Garfield Coutnty, Colorado, to adopt a Resolution excepting the relocation of a common boundry from the definition of the terms "subdivision" and "subdivided land" under C.R.S. 1973, 30-28-101(10) (a) and from regulation under the Garfield County Subdivision Regulations, as amended, and as reason therefor state as follows: 1. Sierzant is the owner of both contiguous parcels of land depicted upon the attached plat containin 3.64 acres and 6.26 acres, respectively, which plat was prepared by Scarrow & Walker, Inc., under the hand and and seal of Robert A. Wamsley, L. S. No. 7972, dated August 6, 1975 and August 7, 1975 respectively. 2. Sierzant proposes to relocate a common boundry between said parcels, Exhibit A. 3. The parcel of land containing 3.64 acres and 6.26 acres has been in existence since a time prior to the adoption of the legislation known as "Senate Bill 35" and prior to the adoption of Garfield County Subdivision Regula- tions. 4. The parcel of land containing 3.64 acres and 6.26 acres respectively has been and will be used as building sites. 5. The new parcels of land containing 3.64 acres and 6.26 acres respectively, will remain the same in size after common boundry is relocated. • • 6. That Sierzant does not own any other property which is contiguous to the two parcels of land depicted on the attached plat. 7. That the water supply located on the tract con- taining 6.26 acres is now and has teen from the Crystal Springs. 8. That any sanitary s€eeage treatment system con- nected to eny residence located on the tract containing 3.64 acrec or 6.26 acres respective=ly, will be a septic teak end leech field. 9. Dated and signed this • day of August 1975. ear' Fichaid Sic ,z.n RESOLUTI0 N WHEARAS, Richard Sierzant has petitioned the Board of County Commissioners of Garfield County, Colorado, for an exemption under C.R.S. 1973, 30-28-101(10) (a) and (d), and the Garfield County Subdivision Regulations, as amended, and WHEREAS, the Board finds that the relocation of a common boundry between 3.64 acres situated in the E2SE4f Section 14, Township 7 South, Range 88 West of the 6th P.M. and 6.26 acres situated in the NE 4SE 4 and in the SE 4NE w Section 14, Township 7 South, Range 88 West of the 6th P.M. into the two parcels of land more particularly described on Exhibit "A" attached hereto and by this reference made a part hereof, will not be made for the purpose of evading State and County statutes and resolutions pertaining to the sub- division of land and that the same should be exempt from the definition of the terms "subdivision" and "subdivided land" and from regulation under the Garfield County Subdivision Regulations, as amended.
