WHEREAS, LEE HOLMES, has petitioned the Board of County Commissioners of
Garfield County, Colorado, for an exemption under C.R.S. (1973) Section 30-28-
101 (10) (a) - (d) as amended, and the Subdivision Regulations of Garfield
County, Colorado, adopted September 1, 1972 and amended April 14, 1975, Sections
1.02.17 (d) and 3.02.01, for the division of a 632.87 acre tract of land into
two tracts of approximately 7.27 and 625.60 acres, and more particularly
described as follows:
Lots 9, 14, 15 Section 13
Lot 1, Section 24, T7S, R89W, containing 70.97 acres.
Lot 3, and part of Lot 2, Section 20, T7S, R88W,
containing 5.00 acres.
Part of Lot 4 and part of Lot 9, Lots 10, 11, 14, 15, 16,
17 part of SZ SE4 Section 18. Lots 1, 3, 4, 5, 6, 7, 10,
part NE4 NE4 and of Lots 8, 9, 11, 12, 15, 16, 17, in
Section 19 part of Lots 8, 9, 13, Section 20 T7S, R88W.
Lots 1, 3, 4, 6, 7, 8, 10, 11, 12, 13, 16 in Section 13 lot
23 part Lot 25 Section 12, T7S, R89W of the 6th P.M. Total
556.90 acres.
WHEREAS, the Petitioner has shown to the satisfaction of the Board of
County Commissioners of Garfield County, Colorado, that he desires said
exemption for the purpose of re -sale into single-family residential acreage;
and,
WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board
that there is a reasonable probability of locating domestic water on each of
said tracts, that there is adequate ingress and egress to said tracts, that the
location of septic tanks will be permitted by the Colorado Department of Health,
that the requested division is in accordance with the general purposes and
intent of the Subdivision Regulations of the State of Colorado and the County
of Garfield and should, therefore, be exempted from the definition of the terms
"subdivision" and "subdivided land" as set forth in C.R.S. (1973) Section 30-
28-101 (10) (a) - (d) as amended; I
NOW THEREFORE, upon motion of P! L ,yt ECY1.567.-- seconded by

and carried, said 632.87 acre tract of land is

hereby exempted from such definition and transfer of said tract may be made
by division into 2 tracts of 7.27 and 625.60 acres, more or less, and further
that a proper legal description be prepared prior to the conveyance of said
tracts. A copy of the instrument or instruments of conveyance when recorded shall
be filed with this Resolution.
