PROJECT INFORMATION AND STAFF COMMENTS
REQUEST: Exemption from the Definition of
Subdivision.

LOCATION: A tract of land in the NE 1/4 Section
1, T7S, R89W; more practically
described as a tract of land located
approximately 1 1/2 miles southeast
of Glenwood Springs off of the State
Highway 82 frontage road.

I. RELATIONSHIP TO THE COMPREHENSIVE PLAN
The site is located in District F, Severe Environmental
Constraints. This is due primarily because of the steep
slopes and unstable slopes.
II. DESCRIPTION OF THE PROPOSAL
A. Site Description: The site is located in an area of
large lot single family residential uses near State
Highway 82. The site is on a hillside with slopes
ranging from approximately 5% to over 30% slope.
B. Project Description: It is proposed to split a 5.96
acre tract into two (2) lots of approximately 2.0 and
3.96 acres each. Each lot will have an existing
residence that shares an existing well adjudicated in
Division No. 5 water court in 1972. Each house has an
existing individual sewage disposal system. Access to
each parcel is provided by a frontage road off of
Highway 82.
III. MAJOR ISSUES AND CONCERNS
A. The 5.96 acres cannot be split into more than two (2)
parcels based on the minimum lot area for individual
sewage disposal systems of two acres. The exemption
plat should have a plat note stating "no further
exemptions from the definition of subdivision".
B. The existing well is share by both dwellings, which will
require equal rights and access to the well. The plat
should have legally described easement, at least ten
foot square around the well and ten feet wide along the
waterline to the adjoining property line. Additionally,
there should be a plat note stating "That each lot shall
own an equal one-half interest in the water rights,
equal responsibility for operation, repair and
maintenance expenses for the well".

C. Soils and geologic information indicate that soils in the
area may be subject to hydro -compaction, erosion and rock
fall. An additional plat note should state "That further
construction may require engineered design due to
possible soils and slope limitations".
IV. SUGGESTED FINDINGS
1. That proper posting and public notice was provided as
required by law for the meeting before the Board of .
County Commissioners.
2. That the meeting before the Board of County Commissioners l`(�

was extensive and complete, that all pertinent facts,
matters and issues were submitted, and that all
interested parties were heard at that meeting.
3. That for the above stated and other reasons, the proposed
exemption is in the best interest of the health, safety,
morals, convenience, order, prosperity and welfare of the
citizens of Garfield County.
V. RECOMMENDATION
APPROVAL, with the following conditions;
1. That the following plat notes be on the exemption plat:
a. That no further exemptions from the definition
subdivisioruwill be allowed o either lot.

of approval.
