BEFORE THE BOARD OF COUNTY COMMISSIONERS OF
GARFIELD COUNTY, COLORADO
RESOLUTION NO. 61-(4
WHEREAS, Billie Lee Smith has petitioned the Board of County
Commissioners of Garfield County, Colorado, for an exemption from the
definition of the terms "subdivision" and "subdivided land" under C.R.S.
1973, 30-28-101 (10) (a) -(d) as amended, and the Subdivision Regulations
of Garfield County, Colorado, adopted January 2, 1979, Sections 2.02.21
(d) and 3.02.01 for the division of a 37.64 acre tract into three (3)
tracts of approximately 2.36 acres, 2.42 acres, and 32.68 acres more or
less, and said tracts "A" and "B" are more particularly described as
follows:
Tract "A"
Beg. at a pt. 30.0' West of the SE Cor. of the NESE of
Sec. 35 T.5 S. R.92 W.; thence N. 00°12'W. 442.33' to true
P.O.B.; thence N. 00°12' W. 218.00'; thence S. 89°54'49"
W. 472.0'; thence S. 00°12' E. 218.0'; thence N.89°54'49"
E. 472.0' to the true P.O.B. cont. 2.36 Ac.
Tract "B"
Beg. at a pt. 30.0' West of the SE Cor. of the NESE of
Sec.35 T. 5 S.-R.92W.; thence N. 00°12' W. 218.33' to the
true P.O.B.; thence N. 00°12' W. 224.0'; thence S. 89°
54'49" W. 472.0'; thence S. 00°12' E. 224.0'; thence
N. 89°54'49 E. 472.0' to the true P.O.B. cont. 2.24Ac.
All in the State of Colorado and County of Garfield.
WHEREAS, the Petitioner has demonstrated to the satisfaction of the
Board of County Commissioners of Garfield County, Colorado, that he desires
said exemption for the purpose of resale of said tracts into single=family'
residential acreage.
WHEREAS, the Petitioner has demonstrated to the satisfaction of the
Board of County Commissioners of Garfield County, Colorado, that there is
a reasonable probability of locating domestic water on each of said treefs,
that there is adequate ingress and egress`to said tracts, that the loca-
tion of septic tanks: will be permitted by the Colorado Department of.
Health, that the requested division is in accordance with the general
purposes and intent of theSubdivision Regulations of the State of:
Colorado and the County -of Garfield,:and should, therefore, be exempted
from the definition of the terms "subdivison" and "subdivided land
as set forth in C.R.S: 1973,30-28-101 (10) (a) -(d) as amended;
