RESOLUTION
WHEREAS, WILLIAM R. SLATTERY and JUDITH J. SLATTERY and PATRICK B. CORYELL
and CHARLES R. CORYELL, owners, have petitioned the Board of County Commissioners
of Garfield County, Colorado for exemption of certain lands pursuant to the
provisions of C.R.S. (1973) Section 30-28-101 (a) (d) as amended, and the
Subdivision Regulations of Garfield County, Colorado, adopted September 1, 1972
and amended April 14, 1975, Sections 1.02.17 (d) and 3.02.01, for the division
of a .22 acre, more or less, tract into two tracts of approximately .11 acre,
more or less, each and a 34.1 acres, more or less, tract into two tracts of
approximately 1.0 acre, more or less, and 33.1 acres, more or less, to enable
said petitioners to trade or exchange portions of such divided tracts in order
to obtain access for the petitioners Coryell to the remainder of their parcel
of land and enable each party to make better use of the lands owned by them;
and,
WHEREAS, said Board is convinced that the dispositions of said properties
by the owners are not made for the purpose of evading the provisions of the
statute and subdivision regulations, and should be exempt from the definitions
of "subdivision" and "subdivision land" as the terms are used and defined by
statute and subdivision regulations;
NOW, THEREFORE, upon motion of ,c,te 2106 rec.
seconded by
and
unanimously carried, the Board of County Commissioners of Garfield County, Colorado
hereby grants the exemptions as requested; however, the granting of the requested
exemptions is specifically conditioned upon the petitioners causing the parcels
to be traded or exchanged to be surveyed by a licensed surveyor, furnishing this
Board with copies of the surveyed descriptions of said parcels for its records
and use and no deeds shall be exchanged or recorded by and between said petitioners
until after delivery of,the aforesaid survey descriptions of the parcels to this
Board; and
BE IT FURTHER RESOLVED, that such exempted tracts once each is conveyed as

set forth in the joint petition shall not thereafter be separately conveyed, but
each shall constitute a single lot or parcel of land with the parcel of land of
each of the respective separate owners lying contiguous to the exempted or
divided parcels of land.
