WHEREAS, JOHN J. SISSOM has petitioned the Board of County Commissioners of
Garfield County, Colorado, for an exemption under C.R.S. (1973) Section 30-28-
101 (10) (a) -(d) as amended, and the Subdivision Regulations of Garfield County,
Colorado, adopted September 1, 1972 and amended April 14, 1975, Sections 1.02.17
(d) and 3.02.01, for the division of a 6.15 acre tract into two tracts of 3
acres and 3.15 acres, more or less, and said 6.15 acre parcel is more
particularly described as follows:
A parcel of land situated in the NE1/4SE1/4 of Section 13, in
Township 5 South, Range 91 West of the Sixth Principal
Meridian and in Lot 3 of Section 18, Township 5 South,
Range 90 West of the Sixth Principal Meridian, lying
Southerly of the centerline of a 60 foot road easement,
said parcel of land is described as follows:
Beginning at a point in the center of said 60 Foot road
easement whence the East Quarter Corner of said Section
13 being the same as the West Quarter Corner of said
Section 18 bears: N. 45° 01' 47" W. 805.09 feet; thence
S. 540 30' 59" W. 539.47 feet; thence N. 87° 09' 58" W.
598.16 meet; thence N. 230 16' 00" E. 426.70 feet to a
point in the center of said 60 foot road easement; thence
along the centerline of said 60 foot road easement S. r,30
03' 23" E. 67.20 feet; thence 97.14 feet along the arc
of a curve to the left, having a radius of 166.18, the
chord of which bears: S. 79° 48' 06" E. 95.76 feet; thence
N. 830 27' 11" E. 106.81 feet; thence 99.38 feet along
the arc of curve to the right, having a radius of 365.13
feet, the chord of which bears S. 88o 44' 59" E. 99.03
feet; thence S. 80o 57' 08" E. 127.43 feet; thence 99.71
feet along the arc of a curve to the right, having a
radius of 533.14 feet, the chord of which bears: S. 750
35' 41" E. 83.47 feet; thence S. 70o 14' 12" E. 134.62
feet; thence 85.55 feet along the arc of a curve to the
left, having a radius of 111.59 feet, the chord of which
bears: N. 870 48' 06" E. 83.47 feet; thence 79.71 feet
along the arc of a curve to the right, having a radius
of 185.02 feet the chord of which bears: N. 78° 10'
55" E. 79.09 feet; to the point of beginning, containing
6.15 acres, more or less.
WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board
of County Commissioners of Garfield County, Colorado, that he desires said
exemption for the purpose of re -sale into single-family residential acreage;
and,
WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board
of County Commissioners that there is a reasonable probability of locating

domestic water on each of said tracts, that there is adequate ingress and egress
to said tracts, that the location of septic tanks will be permitted by the
Colorado Department of Health, that the requested division is in accordance
with the general purposes and intent of the Subdivision Regulations of the State
of Colorado and the County of Garfield and should, therefore, be exempted from
the definition of the terms "subdivision" and "subdivided land" as set forth
in C.R.S. (1973) Section 30-28-101 (10) (a) - (d) as amended;
NOW THEREFORE, upon motion of VeJ6S1t..1?z- seconded by
6 v 2 and carried, said 6.15 acre tract of land is hereby
exempted from such definition and transfer of said tract may be made by
division into two tracts of 3 acres and 3.15 acres, more or less, all as is more
fully described above, and further, that said exemption is conditioned upon
the Petitioner obtaining a proper legal description of said tracts prior to
any conveyance thereof. A copy of the instrument(s) of conveyance when recorded
shall be filed with this Resolution. r
